505 <br />WILL AND DECREE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />IN THE MATTER OF ) <br />THE ESTATE OF ) FINAL DECREE. <br />FRANK.J.COATES, deceased. ) <br />STATE OF NEBRASKA )as. <br />COUNTY OF HALL ) <br />At a session of the County Court held in and for said County of Hall and State of 4braska, <br />this 23rd day of August, 194+, Present: Charles ossert, County Judge. <br />BE IT REMEMBERED, that on the 29th day of July, 1944, Harriett E.Coates, Executrix of the Estate <br />of Frank J.Coates, deceased, filed in this Court her final account as such Executrix and a petition <br />praying that said account be allowed, for a decree of heirship, an order of distribution, a final <br />settlement thereon and discharge. <br />For these purposes, the 2311 day of August, 19414, at 10 o'clock A.M. in the Bounty Court Room in <br />said County was assigned as the time and place for hearing said petition, examining and allowing <br />said account; and it was ordered that notice of the pendency of said petition be given to all <br />persons interested in said estate by publishing such notice in the Grand Island Independent, a <br />legal newspaper printed in said County, for three successive weeks prior to said day of Oearing; <br />and it appears by proof on file that said notice was given as ordered by Court; and that no objections <br />have been made nor filed thereto. <br />Upon examination of the record and the evidence in this matter and being duly advised in the <br />premises, the Court finds as follows: <br />FIRST <br />That Frank J.Coates departed this life on the 11th day of October, 1934, at Grand Island, in <br />Hall County, Nebraska, testate, and at the time of his death, he was a residFnt of Hall County, <br />Nebraska. SECOND <br />That on the 19th day of October, 1934, Harriett E.Coates filed in this Court, instrument pur- <br />porting to be the Last Will and Testament of said Frank J.Coates, deceased, and codicil thereto, <br />wherein said petitioner was named Executrix, and a petition offering said Will and Codicil for <br />robate, alleging that said. Frank J.Coates departed this life on October 11, 1934, in Hall County, <br />�ebraska; and on the 19th day of October, 1934, an order of this Court was made therein assigning <br />the 13th day of November, 1934, at 10 o'clock A.M. in the County Court Room in said County as the <br />time and place for hearing said petition, proving said Will and Codicil and admitting the same to <br />probate and ordering that notice of the pendency of said petition and hearing thereon be given to <br />all persons interested in said matter by publishing said notice in the Grand Island Independent, <br />a legal newspaper printed in said County, for three successive weeks prior to said day of hearing, <br />and it appears by proof on file that notice of said order was so given. <br />THIRD. <br />The'Court further finds that on the 13th day of November, 1934, said instruments were proven, <br />allowed and admitted to probate as the Last Will and Codicil thereto of said Frank J.Coates, deceased, <br />which Last Will and Testament and Codicil thereto are in words as follows: <br />LAST WILL AND TESTAMENT OF FRANK J.COATES. <br />IN THE NAME OF GOD, AMEN. <br />We whose names are hereto subscribed, do hereby certify that Frank J.Coates, the Testator, signed <br />his name to the foregoing instrument consisting of two pages of typewritten matter, in our presence <br />and, in the presence of each of us and he at the same time declared the said instrument to be his <br />Last Will and Testament and we at his request and in his presence did sign our names hereto as <br />attesting witnesses. <br />Talmage Smith of Grand Island,Nebr. <br />C.E.Grundy of Grand Island, Nebr. <br />I, Frank J.Coates, of Grand Island, Hall County, Nebraska, being of sound mind and memory, and <br />in full possession of all my mental faculties, and in good health, but realizing the uncertainty of <br />life, do make, declare and publish this, my last will and testament. <br />FIRST. <br />I direct that my Executrix hereinafter appointed, shall pay all just debts and claims against my <br />estate, as soon as possible after my death. <br />SECOND. <br />I hereby appoint my wife, Harriet E.Coates to be Executrix of my estate without bond. <br />THIRD. <br />I hereby appoint my wife, Harriet E.Coates, to be guardian of my minor children without bond. <br />FOURTH. <br />I give and bequeath to my beloved wife, Harriet E.Coates, one -third (1/3) of all the property, <br />real or personal, of which I may be possessed at the time of mydeath. <br />FIFTH. <br />The balance of my estate: towit, the remaining two - thirds (2/3) I give and bequeath in equal <br />portions to my sons, George Francis Coates, Mercer Mattes Coates, Stanley Ferris Coates, Donald <br />Robert Coates, and to my daughterp,Lucile Mary Beck and Evelyn Ruth. <br />SIXTH. <br />Should there be any other children born to me after the execution of this will said child or <br />said children shall participate in the two- thirds (2/3) portion of the estate in the same manner as <br />the six children heretofore named. <br />SEVENTH. <br />The Executrix of my estate shall have full authority to sell all property, both personal and <br />real, in such manner as she may deem best. She is given authority if any property is not readily <br />salable to hold the same until she ca.n secure for it what in her opinion is a fair price and she is <br />given authority to trade such property as not readily salable for other property which in her judg- <br />ment may be for the best interest of the estate. <br />EIGHTH <br />Liquidation of the estate is not to be hurried. The Executrix is not required to close the <br />estate on any specified date but shall take what steps she thinxs best to conserve the value of <br />the estate so that in due time herself and the other heirs will secure the largest returns pos- <br />sible. NINTH. <br />I hereby revoke any and all former wills by me made. <br />TENTH. <br />In Testimony Whereof, I have hereunto set my hand to this my last will and testament, this <br />23rd day of March, A.D. , 1925, at <br />Talmage Smith Frank J.Coates <br />C.E.
