That on the 24th day of November, <br />1943, said instrument to which this certificate is attached was duly proved, probated and allowed <br />as the last will and testn.ment of the real and personal estate of said Maud E.Ald.en, deceased, and <br />the same w9s ordered to be recorded in the records of the Court aforesaid. <br />In Witness Whereof, I have hereunto set my hand and. affixed the seal of the County Court, this <br />24th day of November, 1943- <br />(SEAL) Paul N.Kirk,County Judge <br />and. said M.J.Alden, named in said Will, was appointed Executor thereof upon his furnishing bond in <br />the sum of $15,000.00 as ordered by this Court, which bond. Teas furnished and approved; the Court <br />further finds that said Maud E.Alden, nt the time of her deatt,, eras a married woman and that she <br />left the f,11Oring heirs-at-law and only heirs-at-law, to -wit: Malverd J.Alden, her husband, <br />Warren H.Alden, her son, and Velma Ralph, her daughter, all over.. the age of 21 years. <br />FOURTH. <br />The Court further finds that on the 3rd day of December, 1943, an order of this Court was made <br />nllor�aing creditors three months from and after the 29th day of becember, 1943, in which to file <br />their claims against said estate and said Executor one year in which to settle said estate, and <br />further ordering that notice to creditors be published in the Grand Island Independent, a legal <br />newspaper published and circulating in Hall County, Nebraska, for three successive weeks prior to <br />the 29th day of December, 1943, and that a hearing on claims filed against said estate would be <br />held at the office of the County Judge of Hall County, Nebraska., on the 31st day of March, 1944, <br />at 9 o'clock A.M., and. it appears by proof on file that notice of said Order was published as <br />ordered by this Court. <br />FIFTH. <br />The Court further finds that on the 31st day of March, 1944, an order of this Court was entered <br />herein barring and excluding any claims from being, set up or asserted against said estate, the time <br />having elapsed for filing any such claims. <br />SIXTH. <br />The Court further finds t_nnt on the 15th day of April, 1941, said M.J.Al*den, Executor of said <br />estate, filed in this Court, his inventory of the property of said estate and that according to said <br />Inventory, the deceased died seized and possessed of the following described property, to -wit: <br />North Half of the Southeast Quarter (N-�SEA) of Section Thirty- three (33) in Township Twelve (12) <br />North,Range Twelve (12),West of the 6th P.M. in Hall County, Nebraska. <br />Southwest Quarter (311:1j) of Section Eighteen (18) in ToT,Tnship Fifteen (15) North,Rni; t ;e Sixteen (16), <br />West of the 6th P.M. in Sherman County, Nebraska.. <br />South Half_ of the Southeast Quarter (SiSF) of Section Five (5) in Township Thirteen (13) North, <br />Range Nine (9),West of the 6th P.M. in Howard County, Nebraska. <br />An undivided one -half interest in Lots One (1), Two. (2) and Three (3)in Block Six (6) of the <br />Original Town of St. Libory in Ho%Tard County, Nebraska, and in the following described tract <br />situn.ted in Ho%rard County, Nebraska, more particularly described as follows, to-wit: <br />Beginninv at the Southeast corner of Block Six (6) in the Original Townsite of St. Libory, in <br />.ard County, Nebr< skn, and running thence southeasterly in a continuation of the easterly line <br />of said Block Six (6) and parallel thex er,rith, Forty (140) feet; thence in a southwesterly direction <br />one hundred thirty -two (132) feet; thence northerly to the southwest corner of said Block Six (6); <br />thence in a northeasterly direction, parallel with said Block Six (6), one hundred thirty -two (132) <br />feet to the place of begin: i.ng. <br />Lot Five (5) in Block Fourteen (14) in Russel Wheeler's Addition in the City of Grand Island, <br />1�ebras >a. <br />and personal property of t_'le value of 412, 160.81. <br />The Court further finds that on the 27th day of October, 1943, M.J.Alden filed in this Court an <br />assignment unto Warren H.Alden and Velma Ralph, chnre and. share alike, all of his right, title <br />and inter st in and to the personal nroperty bel*�nq n to his �hTife, PQaud E.Aclden, which assignment <br />was duly witnessed and acknowledged by said Malverd J.Alden; tr',at according to the terms of said <br />assignment and the terms, conditions and provisions of said Last Will and Testament of said deceased, <br />the personal property of said estate w,-,.s bequeathed unto Warren H.Alden and Velma Ralph, in fee <br />simple, share and share alike, and the real estate belonging to said testatrix, T"Tas devised and <br />bequeathed in fee simple, as follows: Unto Malverd J.Alden, an undivided one - third, unto Warren H. <br />Alden, an undivided one-third, and unto Velma Ralph,' an undivided one - third. <br />SEVENTH. <br />The Court further finds that all claims against said estate, including the costs of administra- <br />tion thereof, have been fully paid by said Executor, including the expenses of the last illness and <br />burial of said Maud E.Ald.en, deceased, and that the final report is correct in all respects and <br />should, be approved and allo?,Ted; that since the failing of said report, said Executor has made dis- <br />tribution of the $8,276.4 cash on hand unto Velma. Ralph and Warren H.Alden, share and share alike, <br />their receipts for which are duly filed in this estate with this Court and said Warren H.Alden and <br />Velma Ralph have petitioned the Court for an order directing the Executor to assign all remaining <br />chattel property unto M.J.Alden, Trustee, as follows: <br />Broadhurst and Alden YDromissory note of $2,875.00 secured by real estate mortgage <br />Contr!ct of Isaac and Myrtle Rayno, secured by real estate situate in St.Libory, Nebraska.. <br />An undivided one -half interest in the St. Libory Lumber Company of St. Libory, Nebraska. <br />Series E.War Bond of the maturity value of $$112.50 <br />T,rhich said Execiator has done, and that said Executor has accordingly fully administered and dis- <br />tributed. this estate according to the terms and conditions of said Last Will and Testament and <br />assignment of said Malverd J.A lden and according to the petition of said Warren H.Alden and Velma <br />Ralph, and that there is nothing further for him to do herein; that there is due and payable no <br />inheritance tax to the County Treasurer of Hall County, Nebras'�a., the County Treasurer of Sherman <br />County, Nebrnska, or the County Treasurer of Ho�-,Tard County, Nebraska.. <br />The Court further finds that M.J.Alden and Malverd J.Alden are one and the same persons and was <br />7 <br />C <br />n <br />1 <br />
