1. <br />I hereby nominate and appoint my dear husband M.J.Alden, Executor of this Will and provide <br />that he need give no surety on his bond as such, and direct him out of my personal property, to <br />pay all my just debts, including expenses of my last illness and burial, as soon after my death <br />as may conveniently be done. <br />2. <br />Inasmuch as my separate estate consists of property which I inherited from my late mother, <br />Amy D.Harrison, and she having t (7ld me that any of her property remaining at the time of my <br />death, should go to our two children, Warren and Velma, and that also being my wish and will, <br />I accordingly herewith devise and bequeath, subject only to the statutory rights of my husband <br />Ma.lverd J.Alden,, which rights I hereby grant unto him, a.11•of my property, both real and personal <br />wheresoever situated, unto our two children Warren Harrison Alden and Velma Alden Ralph, in fee <br />simple absolute, share and share <br />For these purposes, the 9th day of August, 1944, at 10 o'clock A.M. at the County Court Room <br />complusion, subscribed her <br />in said County was assigned as the time and place for hearing said petition, examining and allow- <br />ing said ac.counl;,:and it was ordered that notice of the pendency of said petition be given to all <br />of each of us, and at the same time and in our presence <br />persons interested in said estate by publishing such notice in the Grand Island Independent, a <br />and hearing,declared the same to be her Last <br />legal newspaper printed in said County, three successive weeks prior to said day of hearing, and <br />lie at her special instance <br />it appears by proof on file that notice was given as ordered by Court and that no objections to <br />and request and in her presence and in the <br />said final account have been made or filed and that the same has been approved by Warren H. <br />Alden and Velma Ralph. <br />Upon examination of the record and the evidence in this matter and being duly advised in the <br />premises, the Court finds as follows: <br />FIRST. <br />That Maud E.Alden departed this life on the 29th day of August, 1943, while temporarily <br />residing in Los Angeles, California, testate, and at the time of her death she was a resident of <br />Hall County, Nebraska. <br />SECOND. <br />That on the 27th day of October, 1943, M.J.Alden, filed in this Court an instrument purporting <br />to be the Last Will and Testament of said Maud E.Alden, deceased, wherein said petitioner was <br />named Executor, and a petition offering said Will for probate, alleging that said Maud E.Alden <br />departed this life on August 29, 1943, while temporarily residing in Los Angeles, California, <br />and on the 27th day of Oc -tober, 1943, an order of this Court was made therein assigning the <br />24th day of November, 1943, at 10 o'clock A.M. in the County Court Room in said County as the <br />time and place for hearing said ?etition, proving said Will and admitting the same to probate <br />and ordering that notice of the pendency of said petition and hearing thereon be given to all <br />persons interested in said matter by publishing said notice in the Grand Island Independent, a <br />legal newspaper printed in said County, for three successive weeks prior to said. day of hearing, <br />and it appears by proof on file that notice of said order was so given. <br />THIRD. <br />The Court further finds that on the 24th day of November, 1943, said instrument was proven, <br />allowed and admitted to probate as the Last Will and Testament of said Maud E.Alden, deceased, <br />which Last 11111 and Testament is in words as follows: <br />LAST WILL AND TESTAMENT <br />I, Maude E.Alden, of 7915 Towne Avenue, Los Angeles, California, being of sound mind and <br />disposing memory, do hereby make, publish and declare this my Last Will and Testament, hereby <br />revoking any and all
