OMAN <br />M.Baker, deceased, was filed for x)robate in this Court. That on the 25th day of April, 1940, said <br />instrument to which this certificate is attached was duly proved, probated and allowed as the <br />last will and testament of the real and personal estate of said George M.Baker, deceased, and the <br />same was ordered to 'he recorded in the records of the Court aforesaid. <br />IN WITNESS WHEREOF) I have hereunto set my hand and affixed the estate, and <br />not filed herein, if any such there be, are 'forever barred and excluded from setting up-or assert- <br />ing any such claims against said estate. <br />The Court further finds that under the last will and testament of George M.Baker, deceased, it <br />was provided that Marie Fagan and William Fagan, Jr.', should hold in trust the shares of Lillian <br />Thirifay and Margaret Power until each had arrived at the age of fifty years. <br />The Court further finds that Margaret Power has not yet reached the age of fifty years. <br />The Court further finds that the balance of the estate in the amount of $60.25 be divided <br />equally among Marie Fagan, Lillian Thirifay and Margaret Power, and that the Executors pay to <br />Marie Fagan and William Fagan,Jr., the amount of $20.08, the share of Margaret Power, and they <br />hold same until she reaches the age of fifty years. <br />The Court furthe~ finds that distribution has been made to Lillian Thirifay of all of her <br />interest in the personal property, as shown by her receipt filed herein, and the interest of <br />Margaret Power has been turned over to Marie Fagan and William Fagan,Jr., as trustees, as shown the matter of the estate ) CASE N0. 3015 <br />of ) <br />George M.Baker, Deceased. ) FINAL DECREE <br />Now, on this 19th day of July, 1944, this cause came on for hearing upon the final report of <br />Marie Fagan and William Fagan Jr., executors of the last will and testament of George M.Baker, <br />deceased, and upon their petition for settlement of said estate and their discharge herein, said <br />hearing having been continued from the 5th day of July, 1944, <br />The Court, having examined said report and.the records and files in said estate, and being <br />finds that due and legal notice has been given to all persons in- <br />duly advised in the premises, <br />terested in said estate of the time and place fixed for hearing upon said final report, as hereto- <br />fore ordered, and no one appearing to object to said final report, the Court examined the same, <br />together -with the vouchers and files and the testimony in sunnort thereof, and being duly advised <br />in the premises, the Court finds that said report is true and correct in all things and ought to <br />be approved and allowed as and for the final report of said executors. <br />This matter further came on for hearing upon the application of the executors to fix the fees <br />of the executors and the attorney and the Court further finds that the executors are entitled <br />for their services to the s,.lm of 4180.00, and Wm.Suhr, Attorney, is entitled to the sum of $150.00. <br />IT IS, THEREFORE, ORDERED BY THE COURT that the executors pay executors' fees in the amount of <br />$180.00 a,nd attorney's fees in the amount of $150.00. <br />This came coming on further to be heard, the Court finds that the executors have paid the <br />executors the sum of $180.00 for their services and have paid Wm.Suhr $150.00 as attorney's fees, <br />and that there remains in the hands of the executors the sum of $60.25. <br />The Court further finds that said George M.Baker departed this life on the 28th day of March, <br />1940, and at the time of his death he was a resident and inhabitant of the county of Hall and state <br />of Nebraska, and the Court further finds that a petition was filed by the heirs at law, legatees <br />and devisees,for the probate of an instrument purporting to be the last will and testament of <br />George M.Baker, deceased., the Court thereupon fixed the 25th day of April, 1940, as the date for <br />making proof of said last will and testament, and due notice of the filing of said petition and of <br />the time and T)lace fixed for the hearing thereon was given by the Court in the manner provided by <br />law, and on said date, April 25, 1940, said instrument was duly proven, allowed, and admitted to <br />probate in this Court as and for the last will and testament of said George M.Baker, deceased, and <br />letters testamentary Arere duly issued thereon to Marie Fagan and William Fagan,Jr., executors as <br />named in said last will and testament, and they thereupon qualified as such. <br />The Court further finds that due and. legal notice has been given to all persons of the time <br />and place fixed by;the Court for filing of claims against said estate, and that the time for filing <br />claims expired on the 22d day of May, 1940; that all claims filed have been paid. <br />IT IS, THEREFORE, ORDERED BY North Range seventeen (17), W.I.M.,and <br />-eight <br />Lots Two (2), Three (3), Four (4), in Section Two <br />Southwest quarter of Northeast quarter and and <br />(2), Township Eighteen (18) North,Range Eighteen (19), <br />containing 153.92 acres, located in Dewey County, state of Oklahoma. <br />The east half of the northeast quarter and the east half of the southeast quarter, excepting that <br />part thereof conveyed by George M.Baker to Nettie Reinhard by warranty deed recorded in Book ?3 of <br />Register Deeds Hall County, Nebraska, of section <br />deeds at page 253 in the office of the of of <br />Twenty -eight (28), Township Eleven (11) North,Range Nine (9) West 6th P.M., in Hall County, <br />Nebraska. <br />Cemetery Lot - west half of Lot 98, Row °G ", Grand Island Cemetery, in Hall County, Nebraska. <br />.and that under the last will and testament of George M.Baker, deceased, said real estate was <br />devised to Marie Fagan, Lillian Thirifay, and Margaret Power, in equal shares. <br />The Court further finds that the executors have paid the inheritance tax due. <br />
