<br />WILL AND DECREE
<br />LAST WILL AND TESTAMENT
<br />OF
<br />ADAM HSSSEL
<br />IN THE NAME OF GOD, AMEN:

<br />I, Adam Hessel, residing in the City of Grand Island,Hall County, State of Nebraska, being of
<br />lawful age, of sound and disposing mind and memory, and not under any restraint, do hereby make,
<br />publish and declare this to be my last Will and Testament, as follows:-
<br />FIRST:
<br />I order and direct that my executor hereinafter named pay all my just debts, fundral and
<br />testamentary expenses, as soon after my death as conveniently may be done.
<br />SECOND.
<br />I give and.bequeath to my wife, Lizzie fiessel, all of the personal property which I own at the
<br />time of my death, which shall include all property owned by me, except the real estate hereinafter
<br />disposed of in paragraph "third."
<br />THIRD.
<br />I give, bequeath and devise all real property which I own at the time of my death to the use of
<br />my said wife, Lizzie Hessel, for and during her natural life; and* after the death of my said wife,
<br />I give, bequeath and devise the sum of $150.00 to my son, Albert Hessel, who has always cared for
<br />us and helped us at home; that after payment of said amount, I then give, bequeath and devise all
<br />of my estate in equal shares to my four children, Fred Hessel, Anna Fecht, Albert Hessel and Lillie
<br />Vick, their heirs and assigns, in fee simple absolute.
<br />FOURTH.
<br />In the event my wife, Lizzie Hessel, should predecease me, or if my wife and I shall die in or
<br />as a result of a common accident of disaster, I first give, bequeath and devise the sum of $150.00
<br />to my son, Albert Hessel; and thereafter,give, bequeath and devise all of my property, real, per-
<br />sonal or mixed, to my four children above named, in equal shares, and to their heirs and assigns,
<br />in fee simple absolute.
<br />FIFTH.
<br />Lastly, I make, constitute and appoint my son, Albert Hessel, to be the executor of this, my
<br />last Will and Testament, and hereby revoke all former wills by me made.
<br />IN WITNESS WHEREOF, I have hereunto subscribed my name on

<br />this 30th day of April, 1941, declaring the foregoing instrument
<br />Testament, in the presence of each and all of the subscribing wi

<br />This instrument was signed by the testator, A(.am Hessel, on the 30th day of April, 1941, in
<br />our presence, he declaring the same to be his last Will and Testament, and requesting us to
<br />become witnesses thereto, whereupon, we, in his presence and in the presence of each other,
<br />subscribed our names thereto as such witnesses.

<br />I, Paul N.Kirk, Judge of the County Court, in and for said County, do hereby certify that on
<br />the lst day of December, 1943, the instrument purporting to be the last will and testament of
<br />Adam Hessel,decea.sed, was filed for probate in this Court. That on the 30th day of December,
<br />1943, said instrument to which this certificate is attached was duly proved, probated and allowed
<br />as the last will and testament of the real and personal estate of said Adam Hessel, deceased, and
<br />the same was ordered to be recorded in the records of the Court aforesaid.

<br />hearing on the Final Report of the Executor has been given in the manner and form provided by law,
<br />and that no objections have been filed thereto; whereupon, said cause came on to be heard, and the
<br />Court being fully advised in the premises, finds that the Executor has complied with all the orders
