<br />Now, on this 241' day of May, 1944, this cause came on for hearing upon the final report of
<br />Dena Jones, executrix of the last will and testament of the above named deceased, and upon her
<br />petition for a settlement of said estate and for her discharge herein, and the Court, having
<br />examined said report and the records and files in said estate, and being fully advised in the
<br />premises, finds that daze and legal notice has been given to all persons interested in said estate
<br />of the time and place fixed for hearing upon said final report, as heretofore ordered by the Court,
<br />and no one appearing to object to said report, the Court examined the same, together with the
<br />vouchers on file, and testimony in support thereof, and being duly advised in the premises, finds
<br />that said report is true and correct in all things, and ought to be approved and allowed as and
<br />for the final report of said executrix.
<br />The Court further finds that the above named deceased departed this life on the 7th day of
<br />November, 1943, and at the time of her death was a resident and inhabitant of Hall County, Nebraska..
<br />The Court further finds that the above named Nannie Manley prior to her marriage to Frank Manley,
<br />was Nannie Enevoldson and that she, under the name of Nannie Enevoldson, executed her last iaill
<br />and. testament on the _ h day of January, 1937, which last will and testament has been admitted
<br />to probate herein, and that said Nannie Enevoldson, the testatrix, and the said Nannie Manley, is
<br />one and the same person.
<br />The Court further finds that on the 10 day of November, 1943, a duly verified petition praying
<br />for the allowance and probate of said last will and testament of Nannie Manley, formerly Nannie
<br />Enevoldson, was filed in this Court, and the Court thereupon fixed the 8 day of December, 1943,
<br />as the date.for making proof of said last will and testament, that due notice of the filing of
<br />said petition and of the time and place fixed for hearing thereon was given in the manner provided
<br />by law, and on said date, the 9 day of December, 1943, said instrument was duly proven, allowed and
<br />admitted to probate in this Court as and for the last drill and testament of Nannie Manley, formerly
<br />Nannie Enevoldson, and letters testamentary were duly issued thereon to Dena ones, executrix as
<br />named in said last will and testament, and she thereupon duly qualified as such.
<br />The Court further finds that due and legal notice has been given to all persons -of the time and
<br />.place fixed by the Court for the filing of claims, and that said time has fully expired, and that
<br />all persons having claims against said estate, if any such there be, and not filed herein, are
<br />forever barred. and excluded from setting up or asserting any such claims against said estate.
<br />The Court further finds that said deceased was the owner, in fee simple, of the following des-
<br />cribed real estate:
<br />Lot 5 in Block 29, in Russel Wheelers Addition to the city of Grand Island, in Hall
<br />County, Nebraska..
<br />The Court further finds that Frank Manley, the surviving husband, has executed and filed
<br />herein a waiver and disclaimer, wherein and whereby he has waived all of his right, title, and
<br />interest in and to said estate and conveyFd to the devisees named in said last will and testament
<br />all of his right, title, and interest in and. to the aforesaid described real estate, and that said
