<br />Now,on this 17th day of May,1944,this cause came on for hearing upon the pleadings and the evidence,
<br />and was submitted to the Court,and on consideration whereof the Court finds:
<br />That due and legal notice of this proceeding has been given to all persons interested in said matter,
<br />both creditors and heirs,as required by law.
<br />That all of the statements and allegations set forth in said petition are true;
<br />That said P.C.Kelley,also known as Peter C. Kelley ,deceased,died,intestate,on the 17 day of May,1939,
<br />in Hall County,Nebraska ;that he was at the time of his death a citizen and resident of said Hall
<br />County,'Nebraska.
<br />That said P.C.Kelley,also known as Peter C.Kelley,was seized and possessed of the following desettla-
<br />ed real estate situated in Hall County,state of Nebraska,to -wit:
<br />The east twenty -two (22) feet of Lot Five (5) in Block Twenty (20),in the Village of Alda,
<br />That said real estate did not constitute the homestead of said decedent.
<br />That no application has been made in the state of Nebraska for the appointment of an administrator
<br />of the estate of said deceased.
<br />That said P.C.Kelley,also known as Peter C.Kelley,left surviving him,as his sole and only heirs
<br />at law,the following;
<br />Kate K.Morse,a daughter,
<br />Helen E.Kelley,a daughter,
<br />Robert L.Kelley,a son,
<br />Daisy Kelley,& daughter,
<br />all of legal age ;that the wife of said P.C.Kelley,also known as Peter C. Kelley, predeceased him.
<br />IT IS, THEREFORE, DETERMINED AND DECREED BY THE COURT that said Kate K.Morse, daughter, Helen E.Kelley,
<br />daughter,Robert L.Kelley,a son,and Daisy Kelley,a daughter,were the sole and-only surviving heirs
<br />at law of the said P.C.Kelley,also known as Peter C.Kelley,deceased,and said real estate passed
<br />and descended,under the.laws of descent of the state of Nebraska,as follows:
<br />To Kate K.Morse,an undivided one- fourth interest,
<br />To Helen E.Kelley,an undivided one - fourth interest,
<br />To Robert L.Kelley,an undivided one - fourth interest,and
<br />To Daisy Kelley,an undivided one- fourth interest,
<br />that the wife of said decedent predeceased him.
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that the above described real estate be,
<br />and the same is hereby,assigned to said Kate K.Morse,Helen E.Kelley,Robert L.Kelley,and Daisy Kelley,
<br />an undivided one - fourth interest each.
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that all claims and demands against the
<br />estate of P.C.Kelley,also known as Peter C.Kelley,deceased,whether due or to become due,whether
<br />absolute or contingent,be,and the same are hereby forever barred.
