<br />said. hearing having been continued from the 28th cay of February, -1944; and it appearing to the <br />court that due notice of the time and place for said hearing has been given as required by law, <br />and that the only person, who might be interested in said estate, who has appeared in this action, <br />was the County of Hall, which has filed a claim for old age assistance, and it appearing to the <br />court that by agreement said. old age assistance claim has been settled in the sum of 4200.00 and <br />declared to be payable six months after the date of said settlement, and the same to be a lien <br />upon the real estate hereinafter described, and there being no further objections by any Berson <br />or persons claiming to be interested in said estate, whether as heirs, creditors or otherwise, <br />said cause came on to be heard upon the allegations contained in the petition, evidence was taken, <br />anc after hearing the evidence, the court finds: <br />That the petitioner, James Mortensen, ha.s proved that the amount and value of this estate does <br />not exceed the limit prescribed in the Small Estates Act of this State; <br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the regular administration of <br />this estate be and the same is hereby dispensed with. <br />The Court further finds that the name of the deceased person is Rasmus Mortensen,'that he died <br />on January 9, 1944, that he left no widow him surviving, that he died intestate, that the sole <br />heir =at law is James Mortensen, his son, who is of lawful age, to -wit, the age of 44 years; that <br />the correct description of the real estate involved in this estate is an undivided one -half interest <br />In Lots Four (4) and Five (5) in Block 110, McColl & Leflang's Second Addition to Wood River, <br />Nebraska; that the character thereof is a small house and two lots in the village of Wood River, <br />Hall County, Nebraska. <br />The Court further finds that the interest of the said Rasmus Mortensen in said above described <br />real estate is wholly exempt from attach ment, execution and other mesne process, and is not liable <br />for the payment of the debts of the deceased; that the interest of the said Rasmus Mortensen was <br />subject to unpaid taxes, unpaid real estate mortgage, funeral expenses paid by the said James <br />Mortensen; that it was the home and homestead of the said Rasmus Mortensen at the time of his <br />dea.th, he occupying the same with his sister -in -law over the age of 80 years, one Elizabeth <br />Pounder, unable to *cork, and that he was the head of a family entitled to homestead, his family <br />consisting of himself and the said Elizabeth Pounder. <br />The Court further finds that the net value of the interest of the said Rasmus Mortensen in said <br />property, even if subject to the payment of claims, is far less than the claims entitled to prefer- <br />ence, and that there was no value in said real estate for the payment of claims of general creditors, <br />if any such there be. <br />The court further finds that the court costs and attorney fees in this matter, expenses of last <br />illness, funeral expenses and all claims entitled*to preference have been paid by the said James <br />Mortensen, the sole heir at law. <br />The court further finds that the property in this estate was not subject to state inheritance <br />tax or federal estate tax. <br />This court does therefore enter and make this Final Decree as follows, to -wit: <br />IT IS, THEREFORE, ORDERED, ADJUDGED A4D DECREED: - <br />That said aforedescribed real estate, to -wit: the undivided one -half interest of the said <br />Rasmus Mortensen in and to said real estate, is hereby made subject to and the same is hereby <br />declared to be a lien upon said real estate of the claim of the County of Hall, Nebraska, in the <br />sum of $200.00, payable on or before six months after May 1, 1944. <br />That the sole and only heir at law of the said.
