In the Matter of the Estate } of } D E C_RE E Rasmus Mortensen, Deceased. ) Now on this 16th day of May, 1944, this cause came on to be heard upon the verified petition of James Mortensen for settlement of said estate under the Small Estates Act of the State of Nebraska; said. hearing having been continued from the 28th cay of February, -1944; and it appearing to the court that due notice of the time and place for said hearing has been given as required by law, and that the only person, who might be interested in said estate, who has appeared in this action, was the County of Hall, which has filed a claim for old age assistance, and it appearing to the court that by agreement said. old age assistance claim has been settled in the sum of 4200.00 and declared to be payable six months after the date of said settlement, and the same to be a lien upon the real estate hereinafter described, and there being no further objections by any Berson or persons claiming to be interested in said estate, whether as heirs, creditors or otherwise, said cause came on to be heard upon the allegations contained in the petition, evidence was taken, anc after hearing the evidence, the court finds: That the petitioner, James Mortensen, ha.s proved that the amount and value of this estate does not exceed the limit prescribed in the Small Estates Act of this State; IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the regular administration of this estate be and the same is hereby dispensed with. The Court further finds that the name of the deceased person is Rasmus Mortensen,'that he died on January 9, 1944, that he left no widow him surviving, that he died intestate, that the sole heir =at law is James Mortensen, his son, who is of lawful age, to -wit, the age of 44 years; that the correct description of the real estate involved in this estate is an undivided one -half interest In Lots Four (4) and Five (5) in Block 110, McColl & Leflang's Second Addition to Wood River, Nebraska; that the character thereof is a small house and two lots in the village of Wood River, Hall County, Nebraska. The Court further finds that the interest of the said Rasmus Mortensen in said above described real estate is wholly exempt from attach ment, execution and other mesne process, and is not liable for the payment of the debts of the deceased; that the interest of the said Rasmus Mortensen was subject to unpaid taxes, unpaid real estate mortgage, funeral expenses paid by the said James Mortensen; that it was the home and homestead of the said Rasmus Mortensen at the time of his dea.th, he occupying the same with his sister -in -law over the age of 80 years, one Elizabeth Pounder, unable to *cork, and that he was the head of a family entitled to homestead, his family consisting of himself and the said Elizabeth Pounder. The Court further finds that the net value of the interest of the said Rasmus Mortensen in said property, even if subject to the payment of claims, is far less than the claims entitled to prefer- ence, and that there was no value in said real estate for the payment of claims of general creditors, if any such there be. The court further finds that the court costs and attorney fees in this matter, expenses of last illness, funeral expenses and all claims entitled*to preference have been paid by the said James Mortensen, the sole heir at law. The court further finds that the property in this estate was not subject to state inheritance tax or federal estate tax. This court does therefore enter and make this Final Decree as follows, to -wit: IT IS, THEREFORE, ORDERED, ADJUDGED A4D DECREED: - That said aforedescribed real estate, to -wit: the undivided one -half interest of the said Rasmus Mortensen in and to said real estate, is hereby made subject to and the same is hereby declared to be a lien upon said real estate of the claim of the County of Hall, Nebraska, in the sum of $200.00, payable on or before six months after May 1, 1944. That the sole and only heir at law of the said. Rasmus Mortensen, deceased, is James Mortensen, age 44, residence - Wood River, Hall County, Nebraska, and that the interest of the said Rasmus Mortensen in the said.foregoing real estate be and the same is hereby set off unto him, free and clear from the claims of any person interested in said estate, whether creditors, heirs at law, or any other persons interested in said. estate, except the lien of the County of Hall, in the sum of $200.00.
