<br />ROSA C. PLEYTE, DECEASED. )
<br />Now on this 5th day of April, 1944, this cause came on for hearing upon the final report of
<br />Frank C.A.Pleyte, Executor of the Estate of Rosa C.Pleyte, deceased, and upon his petition for the
<br />allowance and anproval of'said report, settlement of said estate and his discharge herein, and the
<br />- ,Court having examined the records and files herein, and being fully advised in the premises finds
<br />that due and legal notice has been given to all persons of the time and place fixed by the Court
<br />for the hearing on the same and further finds that said report is true and correct in all things,
<br />and that the same ought'to be approved and allowed as and for the final report of said Executor,
<br />said estate settled and closed and the Executor discharged.
<br />The Court further finds that the said Rosa C.Pleyte departed this life on March 30, 1942, and
<br />that at the time of her death she was a resident and inhabitant of Hall County, Nebraska; that
<br />she left surviving her as her heirs at law and only heirs at law three children, they bein -Frank
<br />C.A.Pleyte, a son; Nellie Day Rapp and Consuelo M.Dickey, daughters; that she left a Last Will
<br />and Testament which was by the consideration of this Court duly proven, allowed and admitted
<br />to probate on the 4th day of October, 1943 and Letters Testamentary were duly issued by this
<br />Court to the said Frank C.A.Pleyte on the Estate of Rosa C.P1eyte, deceased.
<br />The Court further finds that due and legal notice has been given to all persons of the time and
<br />place fixed by the Court for filing claims against said estate, and that the time so fixed has
<br />fully expired, and that all persons having claims against the estate and not filed within the
<br />time limited by the Court are forever barred and excluded from setting up or asserting any such
<br />claim against said estate.
<br />The Court further finds that the said Executor has paid the funeral expenses and all debts
<br />against said estate, and the costs of of these proceedings and has made due distribution of the
<br />personal property in said estate 6".F---the deceased to the legatees under the Will of the deceased,
<br />and that nothing further remains inthe hands of the Executor belonging to said Estate.
<br />The Court further finds that the._,estate is not subject to an inheritance tax under the laws
<br />of the State of Nebraska nor to a Federal Estate Tax under the laws of the United States.
<br />The Court further finds that the said Rosa C.Pleyte was possessed of the following described
<br />real estate located in the State of Nebraska at the time of her death, to -wit: Lot Three (3),
<br />Block Twent y -two (22), Nagy's Addition to the City of Grand Island,Hall County, Nebraska; that
<br />said real estate passed and descended pursuant to the terms and provisions of the Last Will.and
<br />Testament as therein specifically -set forth.
<br />IT IS THERrFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of the said
<br />Frank C.A.Pleyte, Executor of the Estate of Rosa C.Pleyte, deceased, be and the same hereby is in
<br />all things, approved and allowed as and for the final report of said Executor and said estate is
<br />hereby settled and closed and said Executor discharged.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims against
<br />said estate, if any such there be, are forever barred, enjoined and excluded from setting up or
<br />asserting any such claim against said estate.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the distribution of personal
<br />property by the Executor, be, and the same is hereby approved and said Executor is released from
<br />further liability on his bond.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the real estate hereinabove des-
<br />cribed be found to pass and descend to the parties named in the Last Will and Testament of the said
<br />Rosa C.Pleyte, deceased, in manner and form as therein specifically provided.

<br />Certificate of Probate of Will and Final Decree - IN THE MATTER.OF THE ESTATE OF ROSA C.PLEYTE,
<br />DECEASED, with the original record thereof, now remaining in said Court, that the same is a correct
<br />transcript thereof, and of the whole of such original record; that said Court is a Court of Record
<br />having a seal, which seal is hereto attached; that said Court has no Clerk authorized to sign cer-
<br />tificates in his own name, and that I am the legal custodian of said Seal and of the Records of said
<br />Court, and that the foregoing attestation is in due form of law.

<br />I, John J.Price, of the County of York and State of Nebraska., being of full age, sound mind
<br />and disposing memory, do make, publish and declare this my last will and testament, in manner and
<br />form following:
<br />1. I give and bequeath all my moneys, bonds, evidences of indebtedness, securities for money;
<br />my stock, goods, chattels and personal estate; and I give and devise all my lands, tenements and
<br />hereditaments, and real estate of every tenure of or to which I shall, at my death, have power to
<br />dispose by will, unto and to my children, Catharine Kaspari, Mary Cunningham and Gertrude Johnson, .
<br />their heirs, executors, administrators, successors and assigns, as trustees and upon trust as
<br />follows:
<br />(a). That said trustees shall, as executors of my estate, pay my just debts and funeral expenses,
