NW)ps I I' "OH) !IN <br />THEAUGUSTINECO. 20112.2.41 <br />pa.ny, all in Township Twelve (12) North, Range Eight (8), West of the 6th P.M., in Merrick <br />County, Nebraska, containing 504 acres, more or less; <br />the court further finds that in accordance with the terms and provisions of the Last Will snd-Testa- <br />ment of Marcus Cornelius, the said Paul Cornelius had the option of purchasing all of said land in <br />Xerrick County, Nebraska, on the basis of the appraised value of three disinterested appraisers to <br />be appointed by the County Court of Merrick County, Nebraska, and that in accordance with the terms <br />and provisions of the Last Will and Testament of the said Marcus Cornelius, deceased, the said Paul <br />Cornelius elected to purchase all of said land in Merrick County, Nebraska, upon the appraised value <br />thereof; that said. lands in Merrick County, Nebraska, were duly and regularly appraised for the sum <br />of $20,160.00 and that the said Paul Cornelius has settled with the heirs, legatees and devisees of <br />said estate for s<l.id real estate in Merrick County, Nebraska, and that he is entitled to have the <br />same assigned, transferred and setover to him as his own property forever. <br />7. The Court further finds that under and by virtue of the power vested in the executor under <br />the terms and provisions of the Last Will and Testament of said Marcus Cornelius, the said executor, <br />Paul Cornelius, in order to settle said estate and convert the same into cash, sold Lot 5, in Block <br />19, in Charles Warmer's Addition to the City of Grand Island,Nebraska, to V.E.Evans, for a net return <br />of $7162.75 and conveyed the same to said Grantee by Ekecutor's Deed therefor. <br />It is therefore Considered, Ordered and Decreed by this Court that the final account and report <br />of said Executor be and hereby is approved, settled. and allowed as the final account of said Executor. <br />It is further considered, ordered and decreed by the Court that all right, title interest and estate <br />in and. to Lot 5, in Block 19, in Charles Wasmer s Addition to the City of Grand island, Nebraska., as <br />surveyed, platted and recorded, be and the same hereby is assigned, transferred and setover to the <br />said V.E.Evans in accordance.7,Tith the terms and provisions of the Last Will and Testament of the said <br />Marcus Cornelius, deceased, and under the power vested in said Executor.-under said Will to sell said <br />real estate for the purpose of settling and. distributing said estate.. -Lt is further considered, <br />ordered and decreed by the Court that all right, title, in and estate in and to the Southwest <br />Quarter of the Southwest Quarter (SW4SW4) of Section 15, Township 12 North, Range 8 West of the 6th <br />P.M.; the North Half (N2) of Section 22, the North Half of the Southwest Quarter (N2SW4) of Section <br />22 and all that part of the North Half of the. Southeast Quarter (N2SE4) of Section Twenty -two (22) <br />lying north of the right of .,ray of the Union Pacific Railroad Company, all in Township 12 North, <br />Range 9, West of the right P.M., in Merrick County, Nebraska, containing 504 acres, more or less, <br />be and the same her=eby is assigned, transferred and setover to the said Paul Cornelius as his own <br />property forever, in accordance with the terms and provisions of the Last Will and Testament of the <br />said Marcus Cornelius, deceased, and.under the proceedings had in said estate matter appraising said <br />land and fixing the fair market value thereof for the purposes of said sale and settlement with the <br />heirs, legatees and devisees interested therein.. <br />It is further considered, ordered and decreed by the court that all right, title and interest <br />in and to the following described bonds, notes, mortgages and stocks, to -wit: <br />Three $1000.00 United States Savings Bonds, Series G, and Five $100.00 United States Savings <br />Bonds, Series E, face value $3500.00; <br />One share of stock, Certifica.te No. 35, of the DeVon Fairfield Building Trust, dated <br />September 3, 1935; <br />Ten shares of stock, Certificate No. 3, of the Birchwood Manor Apartment Building trust, <br />dated December. 28, 1934; <br />Two shares of stock, Certificate No. 6, of the McGrath Apartment Building Liquidation Trust, <br />dated September 3, 1940; <br />Nine $1000.00 real estate bonds of the Avalon Terrace of Chicago, Illinois; <br />First mortgage real estate bond given by Herman Kruse and Bertha M.L.Kruse, for $4000.00, <br />dated November 29, 1930 extended to November 1, 1945, with interest at 52%, secured by <br />mortgage on all of the �1E4 of Section 25, Township 13 North,Range 9, West of the 6th P.M. <br />in Howard County, Nebraska.. Endorsement of $1000.00 paid on October 10, 1942; <br />First mortgage bond of Cora A.Scheibe, for $1500.00, dated September 15, 1936, and due September <br />1, 1941, with semi - annual interest at 5 %, secured by real estate mortgage on all of the S2NW4 <br />of Section 2, Township 13 North,Range 8, West of the 6th P.M. in Merrick County, Nebraska; <br />Mortgage note of Floyd H.Trace and Marie Tracy, for $3200.00, dated July 1, 1940, semi - annual <br />interest at 42 %, and secured by mortgage on the N-ISE4 of Section 32, Township 13 North,Range <br />9, West of the 6th P.M., and the W2SW4 of Section 33, Township 13 North,Range 8,West of the <br />6th P.M., all in Merrick County, Nebraska; <br />Mortgage note of Fred C.Rembolt and May Rembolt,dated April 25, 1939, for $7800.00,with <br />interest at 42y payable semiannually secured by mortgage on the SE4 of Section 8, and the <br />W2W2 of Section 9, 11 in Township 12 North,Range 8 West of the 6th P.M., in Merrick County, <br />Nebraska. Endorsement of $500.00 on October 24, 19+2 and $2500.00 April 22, 1943; <br />Unsecured note of Paul Cornelius, dated June 6, 1942, for $9000.00, payable one year after date, <br />with interest at 3 %, payable annually; <br />And open account of Paul Cornelius for $2000.00, money borrowed about September 1, 1942, <br />be and the same hereby are assigned, transferred and set over to the said Paul Cornelius as his <br />own property forever, in accordance with the terms and provisions of a certain written contract <br />dated December 15, 1943, and filed with the court in said estate matter between the said Paul <br />Cornelius, as party of the first nart' and Rosalie Bartz Cornelius, Nellie Cornelius Hunt, Catherine <br />Cornelius Bartc, Helen Cornelius Killian, William Cornelius, and John Cornelius, parties of the <br />second part, whereby the said Paul Cornelius purchased and settled in full with the respective <br />parties of the second part for their proportionate share and interest in all of said bonds, notes, <br />mortgages and stocks. <br />It is further considered, ordered and decreed by the Court that said Executor be discharged <br />upon his filing receipts in this court showing the payment of $1229.16 to each of the following <br />named persons to -wit: Rosalie Bartz Cornelius Nellie Cornelius Hunt Catherine Corneliu B rtz <br />and Helen Cornelius Killian, and the sum of $6145.80 to William Cornoel Uf snn the sum oif 6 M -K <br />to John Corcelius, and that his bondsmen be released fro ?�� bilit y �aug :Kirk <br />County Judge <br />
