<br />standing indebtedness against said estate.
<br />2. That all state and federal inheritance taxes owing by said estate have been paid in full.
<br />3. That the final account of the executor herein is a full, true and correct account of all
<br />monies and personal property that has come into his hands or under his control, and that he is
<br />entitled to all the credits claimed in said acaunting by him, and that said account is in every
<br />respect a full, true and correct account of his acts and doings as such executor and should be
<br />wholly approved as and for his final account in said estate.
<br />4. That there remains in the hands of said executor the sum of $18,550.52 in cash and the
<br />following described notes, mortgages, bonds and stocks, as shown by said inventory to -wit:
<br />Three $1000 United States Savings Bonds, Series G, and
<br />Five $100.00 United States Savings Bonds, Series E,

<br />Two shares of stock, Certificate No. 6, of the McGrath Apartment Building
<br />Liquidation Trust, dated September 3, 1940;
<br />Nine $1000.00 real estate bonds of the Avalon Terrace of Chicago, Illinois;
<br />First mortgage real estate bond given by Herman Kruse and Bertha M.L.Kruse,
<br />for $4000.00, dated November 29, 1930, extended to November 1, 1945, with
<br />interest at 52A secured by mortgage on all of the NE4 of Section 25, Township
<br />13, North, Range 9, West of the 6th P.M. in Howard County, Nebraska. Endorsement
<br />of $1000.00 paid on October 10, 1942;
<br />First mortgage bond of Cora A.Schelbe, for $1500.00, dated September 15, 1936,
<br />and due September 1, 1941 with semi - annual interest at 5 %, secured by real estate
<br />mortgage on all of the S111kA of Section 2, Township 13 North,Range 5, West of the
<br />6th P.M. in Merrick County,.Nebraska;
<br />Mortgage note of Floyd H.Tracy and Marie Tracy, for $3200.00, dated July 1, 1940,
<br />semi - annual interest at 42 %, and secured by mortgage on the NISE4 of Section 32,
<br />Township 13 North,Range 9, West of the 6th P.M., and the W2SW4 of Section 33,
<br />Township 13 North,Range 9,West of the 6th P.M., all in Merrick County, Nebraska;
<br />Mortgage note of Fred C.Rembolt and May Rembolt,da.ted April 25, 1939, for $7500.00,
<br />with interest at 4% payable semi-annually, secured by mortgage on the SE4 of Section
<br />5, and the W-22-W2 of Section 9, all in Township 12 North, Range 5, ,'Jest of the 6th-P.M.)
<br />in Merrick County, Nebraska. Endorsement of $500.00 on October 24, 1942 and $2500.00
<br />on April 22, 1943;
<br />Unsecured note of Paul Cornelius, dated June 6, 1942, for $9000.00, payable one year
<br />after date, with interest at �%, payable annually;
<br />And oven account of Paul Cornelius for $2000.00, money borrowed about September 1, 1942;
<br />to be distributed in accordance with the terms and provisions of the Last Will and Testament of
<br />the said Marcus Cornelius, deceased; the court further finds that the said Paul Cornelius in-
<br />dividually has made full settlement as per written agreement filed in said estate matter, with
<br />the heirs at law, legatees and devisees of said estate, and paid them their proportionate share
<br />and interest on the same., for all of said bonds, notes, mortgages, stocks and money due upon said
<br />open account of $2000.00, and t'nat all of said personal property as hereinbefore set forth and
<br />described should be assigned, se.t.over and transferred to the said Paul Cornelius as his own
<br />property forever.
<br />5. That the said Marcus Cornelius died testate on the 29th day of November, 1942, at Grand
<br />Island in Hall County, Nebraska, being at the time of his death a resident and inhabitant of
<br />Grand island ,Hall County, Nebraska, and being possessed of real and personal property in said
<br />Hall County, Nebraska, to be administered upon; that on the 7th day of January, 1943, the Last
<br />Will and Testament of the said Marcus Cornelius, deceased, was duly and regularly proved, estab-
<br />lished and admitted to probate by order of this court; that on the 7th day of January, 1943, the
<br />said Paul Cornelius was duly and regularly appointed Executor of said estate and qualified as
<br />such Executor by giving bonds in the sum of 41o,000.00 as required by law -and the order of this
<br />Court, and which bond ?tTas accented and approved by this court; that said decedent's wife, Adelia
<br />Cornelius, died at Grand Island,Hall County, Nebraska, on the 29th day of November, 1942, and
<br />upon the evidence submitted the court finds that the said Adelia Cornelius predeceased her said
<br />husband, Marcus Cornelius, the decedent herein, although they passed away on the same day; the
<br />court further finds the said Marcus Cornelius left as his sole and only heirs at law, devisees
<br />and legatees, the following named persons, to-wit:

<br />Rosalie Bartz Cornelius Phillips, Nebraska unrelated
<br />Nellie Cornelius Hunt Phillips, Nebraska Niece
<br />Catherine Cornelius Bartz Grand Island,Nebraska Niece
<br />Helen Cornelius Killian Phillips, Nebraska Niece
<br />William Cornelius Bellefourche,So.Dak. Brother
<br />John Cornelius Grand Island,Nebraska
<br />Brother;
<br />All over the age of twenty -one years.
<br />6. That the said Marcus Cornelius died seized of the following described real estate,to -wit:
<br />Lot Five (5), Block Nineteen (19), of Charles Wasmer's Addition to the City of Grand Island,
<br />Nebraska, as surveyed, platted and recorded.
<br />The Southwest Quarter of the Southwest Quarter (SW4SW4) of Section Fifteen (15), Township
<br />Twelve (12) North,Range Eight (5),West of the 6th P.M., Merrick County, Nebraska; the North
<br />Half (N2) of Section Twenty -two (22), and the North Half of the Southwest Quarter (N2SW4) of
<br />Section Twenty -two (22), and all that part of the North Half of the Southeast Quarter (N2SE4)
