V1. <br />I further revoke paragraph V1 in said Will and substitute therefor the following I further provide <br />and it is my Will, that upon the payment by my son William of six Hundred Dollars ($600.00) to my <br />executors, said executors shall cancel the balance of his indebtedness, regardless of the amount of <br />the same and they shall release the mortgage held by-me on William's farm; I further provide and <br />it is my will, that upon the payment by my son August of Five Hundred Dollars ($500.00) to my <br />executors, said executors shall cancel the balance of his indebtedness, regardless of the amount <br />of the same and they shall release the mortgage held by me on August's farm; I further provide and <br />it is my Will, that upon the payment by my son Arthur of Five Hundred Dollars ($500.00) to my <br />executors, said executors shall cancel the balance of his indebtedness, regardless of the amount of <br />the same and they shall release the mortgage held by me on Arthur's farm • I further provide and it <br />is my Will, that upon the payment by my son John of Two Hundred Dollars $200.00) to my Executors, <br />said. <br />The Court further finds that said Claus Luebbe,at the time of his death,was a widower and that he <br />left the following heirs -at -law and only heirs -at- law,to -wit: Arthur Luebbe,a son,August Luebbe, <br />a son,Charles Luebbe,a son,John Luebbe,a son,William Luebbe,a son,Emma Peters,a daughter,all over <br />the age of 21 years,and the following children of'a predeceased daughter Anna Weller,to -wit: <br />Glen Weller,Clinton Weller,Helen Dankert,Aldine Luethaeuser,Frances Maglecic,all over the age of <br />21 years,and Phyllis Weller,age 11,Heyward Weller,age 15,and Calvin Weller,Jr.now age 19. <br />FOURTH <br />The Court further finds that on the 9th day of September,1943,an order of this Court was made <br />allowing creditors three months from and after the 6th day of October,1943,in which to file their . <br />claims with proof thereof in the office of the County Judge of Hall County,Nebraska,against said <br />estate and said Executors one year in which to settle said estate,and further ordering that notice <br />to creditors be published in the Grand Island Independent,a legal newspaper published and circu- <br />lating in Hall County,Nebraska,for three successive weeks prior to the 6th day of October,1943, <br />and that a hearing on claims filed against said estate would be held at the office of the County <br />Judge of Hall County,Nebraska,on the 8th day of January,1944,at 9 o'clock A.M.,and-it appears by <br />proof on file that notice of said order was published as ordered by this Court. <br />FIFTH <br />The Court further finds that on the 10th day of September,1943,said Arthur Luebbe and August <br />Luebbe,Executors of said estate,filed in this Court their inventory of the property of said estate <br />and that according to said inventory,the deceased died seized and possessed of the following <br />described property,to -suit: <br />I <br />Lot Four (4) in Block Seven (7) in Windolph's Addition to the City of Grand Island,Nebraska <br />Chattel property in said inventory listed totaling $3542.34 <br />9. <br />The Court further finds that according to the terms,conditions and rovisions of said Last Will <br />and Testament and Codicil thereto of said deceased,said Lot Four (Z in Block Seven (7) in Wind - <br />olph's Addition to the City of Grand Island,ivebraska,was devised unto Charles Luebbe in fee simple <br />absolute ;$1800.00 of said personal property was bequeathed as follows:Charles Luebbe $500.00;
