<br />property which I may own, excepting notes, mortgages, bonds and like investments. In addition
<br />thereto and in lieu of her statutory rights in my estate, I give her the use of and income from
<br />all notes, mortgages, bonds and like investments which I may own at the time of my death, for and
<br />during the term of her natural life.
<br />111.
<br />It shall be the dusty of my executors to promptly pay to my wife the interest and income from
<br />said investments when the same is paid to them. In addition thereto, I provide that in the event
<br />my wife finds that for her personal comfort she may need more than the income from said notes and
<br />bonds, then my executors shall pay to her such sums as she may need for her comfort and support,
<br />to be taken from the corpus of my estate; and if they find it necessary to call upon those of my
<br />sons who are indebted to me, such sons shall pay whatever my wife may need, in proportion to the
<br />amount owing by them as shown by the face of their promissory notes. I further provide that in
<br />the event there be any money on hand, or money on deposit in bank, such money I give to my wife
<br />to be hers forever.
<br />1V.
<br />At the death of my wife, I give to my said son Charles Luebbe, Five Hundred ($500.00) Dollars,
<br />and to my daughter Mrs. Emma Peters I give the sum of One Thousand ($1,000.00) Dollars, and to my
<br />daughter Mrs. Anna Weller, I give the sum of Two Thousand ($2,000.00) Dollars, to them and to their
<br />respective heirs forever; which legacies shall be due and payable six months after the death of
<br />my wife, or in the event that I survive her, six months after my death.
<br />V.
<br />In the event that John, William, August or Arthur shall during my lifetime, make partial pay-
<br />ments on what they owe me, such payments shall not be considered or taken into consideration in
<br />the provisions of this will, nor shall any payments made to my wife on the principal of said
<br />notes, be taken into account and it is my intention and my will that Charles, Emma and Anna
<br />shall receive the legacies above named, so ong as my estate is of an amount sufficient to pay
<br />such legacies.
<br />Vi.
<br />I further provide and it is my will that upon the payment by my son William of One Thousand
<br />($1,000.00) Dollars, my executors shall cancel the balance of his indebtedness, regardless of the
<br />amount of the same and shall release the mortgage held by me on his farm. It is my will and I
<br />further provide that upon the payment by my son August of One Thousand ($1,000.00) Dollars to my
<br />executors, they shall cancel the balance of August's indebtedness to me, regardless of the amount
<br />of the same and August shall be entitled to a release of the mortgage held by me on his farm. I
<br />further provide and it is my will that upon the payment by Arthur of One Thousand ($1,000.00) Dol-
<br />lars to my executors, they shall cancel the balance of his indebtedness to me, regardless of the
<br />amount of the same, and Arthur shall be entitled to a release of the mortgage held by me on his
<br />farm. It is my will and I further provide that upon the payment by my son John of Five Hundred
<br />($500.00) Dollars, my executors shall cancel the.balance of his indebtedness, regardless of the
<br />amount of the same and they shall release the mortgage held by me upon his farm.
<br />V11.
<br />I further provide that the amount of Thirty -five Hundred ($3500.00) Dollars as shown in the
<br />foregoing paragraph, shall be paid to my children Charles, Emma and Anna as set out in the paragraph
<br />numbered 1V of my will.
<br />Vill.
<br />I provide that my said sons Arthur and August shall receive One Hundred ($100.00) Dollars, that
<br />is Fifty ($50.00) each and no more, for their services as executors of this will and as succeeding
<br />trustees to hold the investments from which my wife shall receive the income.
<br />ix.
<br />The rest and residue of my estate which at this time consists chiefly of notes and mortgages,
<br />I give to my seven children share and share alike, that is to say to my sons Charles, August,
<br />John, Arthur and William, and to my daughters Emma and Anna, and to their respective heirs forever,
<br />but the income and interest therefrom shall go ash already provided, to my wife so long as she may
<br />live. - X.
<br />In the event that any of my children contest or cause this will to be contested, then that child
<br />or person shall receive Twenty -five ($25.00) Dollars as a legacy out of my estate and no more and
<br />any further amount given him or her in this will, shall be cancelled and revoked and shall be
<br />made a part of the residue of my estate in which, however, such person shall have no part nor
<br />participate.
<br />X1.
<br />I have arranged with the firm of Mayer & Mayer, attorneys in Grand Island,Nebraska, that they
<br />shall act as attorneys for my executors and shall have charge of the probate of this will and the
<br />administration of my estate, at such fees as shall be fixed by the County Judge of Hall County.
<br />They shall act as legal advisors to my executors and trustees, until my estate has been closed,
<br />legacies paid and final distribution made either as executors or as trustees.

<br />The foregoing, consisting of three (3) pages, was at the date thereof, signed, sealed, published
<br />and declared by said testator as and for his last will in our presence, and we in his presence,
<br />and at his special request, and in the presence of one another, have subscribed our names as wit-
<br />nesses hereto.

<br />CODIDIL
<br />I, Claus Luebbe, of Grand Island, Nebraska, make this a Codicil to my Last Will, which Will
<br />was executed on the 24th day of September, 1937, consisting of three pages, in the presence of
<br />Jessie Overdorff and Dixon Glade, and. I hereby ratify and confirm said Will in every particular
<br />excepting the changes which I set forth in this Codicil.
<br />My daughter Anna Weller has departed this life since said Will was executed, leaving eight
<br />children, and the general condition of the country, especially in Nebraska, not having improved
<br />since the date of ^aid Will, it is my intention to reduce some of the legacies so that my sons
<br />will be better able to continue farming.
<br />IV.
<br />I therefore provide that paragraph 1V of my said Will shall be changed in this, that my son
<br />Charles shall have and receive Five Hundred Dollars ($500.00) and my daughter Mrs. Emma Peters
<br />shall have and receive Five Hundred Dollars ($500.00) and the children of my deceased daughter
<br />Anna shall have and receive One Hundred Dollars ($100.00) each as follows: Clinton $100.00, Glen
<br />$100.00, Calvin $100.00, Heyward $100.00, Helen $100.00, Aldine $100.00, Frances $100.00, and
<br />Phyllis $100.00, and I hereby revoke the legacy of One Thousand Dollars ($1,000.00) given to my
<br />said daughter Emma Peters and I hereby revoke the legacy of Two Thousand Dollars ($2,000.00) given
