<br />and on said time he was a resident and inhabitant of Cheyenne, Wyoming; that he left a last will
<br />and testament which instrument was duly proven, allowed, and admitted to probate in the District
<br />Court of the First Judicial District in Laramie County, Wyoming; that said will was duly proven,
<br />allowed, and admitted to probate in this Court on the 11th day of January, 1943, and recorded in
<br />this office.
<br />The Court further finds that the said James Leaden died seized in fee simple title of an un-
<br />divided one -half interest in Lot 1, Block 110, Railroad Addition to the City of Grand Island, Hall
<br />County, Nebraska., and an undivided one -half interest in Lot 178, Section G, Grand Island Cemetery,
<br />Hall County, Nebraska.
<br />The Court further finds that under provision of said last will and testament the above described
<br />real estate did pass and descend at the death of the said James Leaden to his brothe--, Frank Roche
<br />Leaden, in absolute title.
<br />The Court further finds that said estate is not subject to state inheritance tax or United
<br />States inheritance tax in the State of Nebraska; that the funeral expense of the last illness and
<br />the Court costs herein have been paid.
<br />IT IS THEREFORE ORDERED BY THE COURT that said estate be closed and settled; that the Executor
<br />be discharged, and his bonds released; and that the costs of these proceedings having been paid,
<br />said estate is hereby closed and settled.

<br />STATE OF NEBRASKA ) At a session of the County Court held in and for said County of Hall,
<br />COUNTY OF HALL ) ss' State of Nebraska, this 16th day of February, 1944,
<br />Present: Paul N.Kirk, County Judge.
<br />BE IT REMEMBERED that on the 18th day of January, 1944, Arthur Luebbe and August Luebbe,
<br />Executors of the Estate of Claus Luebbe, deceased, filed in this Court their final account as
<br />such Executors and a petition fraying that said account be allowed, for a decree of heirship, an
<br />order of distribution, a final settlement thereon and discharge.
<br />For these purposes, the 16th day of February, 1944, at 10 o'clock A.M. at the County Court
<br />Room in said County was assigned as the time and place for hearing said petition, examining and
<br />a.11ow:ing� said account; and it was ordered that notice of the pendency of said petition be given
<br />to all persons interested in said estate by publishing such notice in the Grand Island Independent,
<br />a legal newspaper printed in said County for three weeks prior to said day of hearing; and it
<br />appears by proof on file that said notice was given as ordered by Court and that no objections
<br />to said final account have been made or filed.,
<br />Upon examination of the record and the evidence in this matter and being duly advised in
<br />the premises, the Court finds as follows:
<br />FIRST.
<br />That Claus Luebbe departed this life on the 9th day of August, 1943, at his home in-Hall
<br />County, Nebraska, testate, and at the time 2 his death he was a resident of Hall County,
<br />Nebraska.
<br />SECOND.
<br />That on the 14th day of August, 1943, said Arthur Luebbe and August Luebbe filed in this
<br />Court instruments purporting to be the Last Will and Testament and Codicil thereto of said
<br />Claus Luebbe, deceased, wherein said petitioners were named Executors, and a petition offering
<br />said Will and Codicil for probate, alleging that said Claus Luebbe departed this life on August
<br />9, 1943, in Hall County, Nebraska, a widower, and on the 16th day of August, 1943, an order of
<br />this Court was made therein assigning the 9th day of September, 1943, at 10 o'clock A.M. in the
<br />County Court Room in said County as the time and place for hearing said petition, proving and
<br />allowing said Will and Codicil to probate a6d ordering that notice of,the pendency of said
<br />petition and hearing thereof be given to all bersons interested in said matter by publishing said
<br />notice in the Grand Island Independent, a legal newspaper printed in said County, for three
<br />successive weeks prior to said day of hearing, and it appears by proof on file that notice of
<br />said order was so given,,
<br />THIRD.
<br />The Court further finds that on the 9th day of September, 1943, said instruments were proven,
<br />allowed and admitted to probate as the Last Will and Testament and Codicil thereto of said Claus
<br />Luebbe, deceased, which mast Will and Testament and Codicil thereto are in words as follows:
<br />LAST WILL OF CLAUS LUEBBE
<br />I, Claus Luebbe, of Grand Island, Nebraska, make this my last will, hereby revoking all former
<br />wills by me made.
<br />I appoint my sons Arthur Luebbe and August Luebbe, joint executors of this will and provide
<br />that they need give no surety on their bonds.
<br />1.
<br />The only real estate I own is my property in Grand Island, Nebraska, which I give to my dearly
<br />beloved wife Margaretha Luebbe, for and during the term of her natural life and upon her death,
<br />I give and devise said real estate to my son Charles and to his heirs and assigns forever.
