<br />HALL COUNTY ) I, Paul N.Kirk, County Judge of Hall County, Nebraska, do hereby
<br />certify that I have compared the Foregoing copy of Last Will and Testament, Certificate of
<br />Probate thereof and Final Decree - IN THE MATTER OF THE ESTATE OF HOMER BOWEN, DECEASED, with
<br />the original record thereof, now remaining in said Court, that the same is a correct transcript
<br />thereof, and of the whole of such original record; that said Court is a Court of Record having a
<br />seal, which seal is hereto attached; that said Court has no Clerk authorized to sign certificates
<br />in his own name, and that I am the legal custodian of said Seal and of the Records of said Court,
<br />and that the foregoing attestation is in due form of law.

<br />LAST WILL AND TESTAMENT
<br />LAST WILL AND TESTAMENT OF JOHN J.PRICE
<br />I, John J.Price, of the County of York a.nd State of Nebraska, being of full age, sound mind
<br />and disposing memory, do make, publish and declare this my last will and testament, in manner
<br />and form following:
<br />1. I give and bequeath all my moneys,.bonds, evidences of indebtedness, securities for money;
<br />my stock, goods, chattels and. personal estate -; and I give and devise all my lands, tenements and
<br />hereditaments, and real estate of every tenure of or to which I shall, at my death, have power to
<br />dispose by will, unto and to My children,, Catharine Kaspari, Mary Cunningham and Gertrude Johnson,
<br />their heirs, executors, administrators, successors and assigns, as trustees and upon trust as
<br />follows:
<br />(a). That said trustees shall, as executors of my estate, pay my just debts and funeral
<br />expenses, the taxes due and payable upon my estate, and the costs and expenses of administering
<br />the same.
<br />(b). That said trustees shall give, turn, deliver and distribute to my daughter Anna Price
<br />my beds, bedding, dishes and cooking utensils, books and pictures, chairs, tables, radio, rugs,
<br />carnets and. curtains and any and all household furniture that may be in and about my home at the
<br />time of my death, the same to be hers, absolutely.
<br />rc). That said Catharine Kaspari, Mary Cunningham and Gertrude Johnson and /or the successors
<br />or successor of them, shall, as such trustees, sell my real estate and, from time to time, divide
<br />the rentq, profits and proceeds thereof, together with the income, profits and proceeds of any and
<br />my moneys, securities, bonds, goods and chattels as follows: To my beloved children, Catharine
<br />Kaspari of York Neb -aska; Nellie Manion of Oregon Wisconsin; Mary Cunningham of York Nebraska;
<br />Anna Price of York.Nebraska; Ada Wochner of Wood River, Nebraska; Gertrude Johnson of Grand Island,
<br />Nebraska, to each of them a. one- seventh part thereof; and to my grandchildren,the children of my
<br />deceased son Arthur J.Price, Maxine Samson, Patricia Price and Mary Price, to each of them a one-
<br />twenty first part thereof.
<br />2. I have loaned and advanced., and may hereafter loan or advance, moneys to certain of my
<br />children, which loans and advancements are and will be evidence by statements signed by them
<br />respectively, or by charges made upon my books; and I will and direct that such sums as have
<br />been or shall hereafter be so advanced shall be reckoned as if the same were part of my residuary
<br />estate, and. as a satisfaction to that extent of the portion hereby given to such child or grand-
<br />child. I have advanced to my deceased son Arthur J.Price the sum of 44.32, and I have paid his
<br />funeral expenses in the sum of $469.75; and I direct that the sum of $ 14.07 be reckoned as part
<br />of my residuary estate and as a satisfaction to that extent of the provision hereby made for and
<br />the portion given to his three children, Maxine Samson, Patricia Price and Mary Price.
<br />3., In order to carry out the provisions of this trust, I direct said trustees and /or the
<br />successors or successor of them, to lease said real estate, and to collect the rents and profits
<br />thereof, and to insure, repair and maintain the same, and to pay the taxes thereon until the time
<br />is, in the opinion of said trustees, opportune to Bell it; whereupon I direct, authorize and
<br />empower said trustees, the successors or successor of them to sell and dispose of said real estate,
<br />either together or in parcels, and for the purnose aforesaid to execute all such deeds and assur-
<br />ances as they may see fit; and to sell and convey the same without asking or receiving the aid,
<br />consent, license, approval or confirmation of any court; and none of the beneficiaries herein shall
<br />be required to join in any conveyance so executed by said trustees, but their deed shall be suf-
<br />ficient; and no purchaser of such real estate shall be required to see to the application of the
<br />proceeds of any sale made under the provisions above conferred.
<br />4. Whenever the number of trustees herein provided shall be reduced by death, inability to
<br />act, resignation or otherwise to two or less, I direct that the trustee or trustees surviving and
<br />continuing to act, from time to time shall appoint in writing under their hands, another trustee or
<br />trustees in place of .the person or persons whose office shall have become vacant, so that there
<br />shall be at all times, three trustees of the trust. in thiswill established, and the person or
<br />persons so appointed shall be vested with the same power and authority in every respect under this
<br />will as the persons nominated and appointed as trustees herein.

<br />5. I nominate, constitute and appoint said Catharine Kaspari, Mary Cunningham and Gertrude
<br />Johnson, the survivors or survivor, and the successors or successor of them to be executors and
<br />trustees of this, my last will and testament.
<br />In witness whereof, I the said. John J.Price have, to this, my last will and testament, con-
<br />sisting of three sheets of typewritten paper, hereunto signed and subscribed my name this 21st day
<br />of March, A.D. 1936. . John J.Price
