THEAUGUSTINECO. 20112.2.41 <br />DECREE <br />IN THE COUNTY COURT <br />IN THE MATTER OF THE ESTATE OF SOREN NIELSEN <br />ALSO KNOWN AS SAM NELSON AND SAMUEL NELSON, <br />DECEASED. <br />OF HALL COUNTY, NEBRASKA <br />D E C R E E <br />NOW on this 9th day of February, 1944, this cause came on for hearing upon the final report <br />filed. herein by Marie Nielsen, administratrox of the estate of Soren Nielsen, also known as.Sam <br />Nelson and Samuel Nelson, deceased, and upon the approval and allowance of said report, settlement <br />of said estate and his discharge and the court being fully advised in the premises finds as follows: <br />That Soren Nielsen, also known as Sam Nelson and Samuel Nelson, departed this life in Hall <br />County, Nebraska on the 4th day of July, 1943, intestate, and at that time was a resident and in <br />habitant of Hall County, Nebraska and was the owner of an estate to be administered in said <br />County; that Marie Nielsen filed her petition in this court on the 10th day of July, 1943, praying <br />for administration of said estate; that upon reading and filing said petition an order was entered <br />fixing the time and place for hearing the evidence in support of said petition, giving notice <br />thereof to all interested parties by publication of said notice for three successive weeks in the <br />Grand Island Daily Independent, a legal newspaper published and circulated in said county, and <br />that said hearing was held, as heretofore ordered by the court, as by law required, and letters of <br />administration granted to said administratrox upon the filing of her bond in court and the same <br />being approved, as by law required. <br />That due and legal notice has been given to all persons of the time and place fixed by thi court <br />for filing claims against said estate by publishing for three successive weeks in the Grand sland <br />Daily Independent, as required by law, and that all persons having claims against said estate, not <br />filed within the time fixed by the court, if any such there be, are forever barred, excluded and <br />enjoined from setting up or asserting any such claims against said estate. <br />That said deceased departed this life leaving him surviving as his heirs at law and only heirs <br />at law, legatees, devisees, and persons entitled to share in his said estate the following: Marie <br />Nielsen, widow, Grand Island,Nebraska, James Harold Nielsen, also known as James Harold Nelson, <br />son, Grand Island, NebreAka, Irma Beebe,daughter, Sacramento, California, Olga Shields, daughter, <br />Doniphan, Nebraska, all over 21 years of age. <br />The court further finds that said deceased died the owner of an estate situated in Hall County, <br />Nebraska consisting of both real and personal property; that said personal property, being the <br />remaining sum of $957.31 on hand at the time the final report was filed has been properly distributed <br />among the heirs, as by law provided; said real estate being described as follows: <br />Lot Four (4),Block Fourteen (14) Russel "Wheeler's Addition to the City of Grand Island, Hall <br />County, Nebraska. <br />The Westerly Sixteen feet of Lot One (1) and the E.6 ft. of Lot Two (2), in Block Forty -seven <br />(47),ariginal Town, now City, of Grand Island,Hall County, Nebraska. <br />An undivided one -half interest in Lot Four (4) in Block One hundred thirty -four (134), in <br />Union Pacific Railway Company's Second Addition to the City of Grand Island, Hall County, <br />Nebraska.. <br />Lot Two (2), in Block One hundred thirty -four (134) in Union Pacific Railway Company's <br />Second Addition to the City of Grand Island,Hall County, Nebraska. <br />That said real estate did pass and descend to Marie Nielsen, widow, a one -third interest therein, <br />and to James Harold Nielsen, also known as James Harold Nelson,.'son, Irma Beebe, daughter, and <br />Olga Shields, daughter, an undivided two- thirds interest therein and Marie Nielsen, widow, =has,';a <br />homestead interest in and to Lot Four (4), Block Fourteen (14), Russel wheeler's Addition to the <br />City of Grand Island,Hall County, Nebraska. <br />The court further finds that due and legal notice has been given to all persons of the time <br />and place for hearing on said final report by publication of said notice for three successive <br />weeks in the Grand Island Daily Independent, as by law required, and no one appearing to object to <br />said report, and the court having examined the same, together with the vouchers attached thereto, <br />finds that said re!)ort is tri..ze and correct in all things and should be approved and allowed as and <br />fPIP said administratrix's final report; that there is no. inheritance tax due the State of Nebraska <br />or the United States under the Inheritance Tax Laws and. that said estate should be settled and the <br />administratiox discharged. <br />IT IS, THERrFORE, ORDERED, <br />against said estate not filed <br />are forever barred, excluded <br />estate; it is further ordered <br />be and the same is hereby, in <br />final report, and said estate <br />ADJUDGED AND DECREED BY THE COURT that all persons having claims <br />and allowed within the time fixed by the court, if any such there be, <br />and enjoined from setting up or asserting any such claims against said <br />that the final report filed herein by Marie Nielsen, administratrox, <br />all things, approved and allowed as and for said administratrix's <br />is hereby settled and closed and said administra.trix fully discharged. <br />IT IS FURTHER ORDERED that the real estate owned by the deceased, at the time of his death, <br />hereinbefore described, did pass and descend under and. by virtue of the Statutes of Descent of <br />the State of Nebraska., as hereinbefore found by the court, and distribution thereof is accordingly <br />made.
