<br />deceased,to -wit: The North Half of the Northeast Quarter of Section 14,Township 11,Range 10,West
<br />of the Sixth P.M.Hall County,Nebraska,pass.and descend according to the terms and provisions of
<br />said will to the following named persons in the following proportions in fee simple: To Donald
<br />L.Rathbun,a one - fourth interest,to Ralph W.Rathbun,a one - fourth interest,Georgiana Rathbun a
<br />one fourth interest and to Ellen I.Rathbun,a one- fourth interest;subject,however,to a life estate
<br />therein in Anna Rathbun.
<br />IT IF FURTHER ORDERED, ADJUDGED AND DECREED that according to the terms and provisions of the said
<br />last will and testament of the said Cyrus P.Rathbun,the said life estate of Anna Rathbun.ceases
<br />and comes to an end upon her death or upon her remarriage and that by operations of law that upon
<br />the happenings of such contingencies the aforementioned grandchildren are entitled to immediate
<br />possession of said real estate.
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED that there is no inheritance tax due the State of
<br />Nebraska upon any inheritance in this estate;that nothing remains to be done and said estate is
<br />hereby ordered closed,the executor discharged and his bond released.

<br />I declare this to be my last Will and Testament, made on this Fourteenth Day of July, 1939•
<br />I give, devise and bequeath to my wife, Allie Lee Carrell, all of my property of every kind
<br />and description and wheresoever situate.
<br />If my said wife shall predecease me, I give, devise and bequeath all of my aforesaid
<br />property to my daughter, Allie Stephens Carrell.
<br />I appoint my said wife as executrix of this Trilll, to serve without bond. I authorize my said
<br />executrix to sell all or any part of the property of my estate at public or private sale, as she
<br />may determine, and without the necessity of obtaining any order of court authorizing her so to do.
<br />In the event of the death, inability or refusal to act, resignation or removal of my wife as such
<br />executrix, I hereby appoint my daughter,Allie Stephens Carrell, as executor hereof in her place
<br />and stead to serve without bond and with full Power of Sale as hereinbefore set forth.

<br />The petition of ALLIE LEE CARRELL praying for admission to probate of a certain document filed
<br />in this court purporting to be the last will of LELAND JOY CARRELL, alias, etc. deceased, and for
<br />the issuance of Letters Testamentary to said petitioner coming on regularly this day for hearing;
<br />due proof being made that notice has been regularly given according to law of the time and place
<br />of hearing said petition, and no person appearing to contest the said. petition, the court pro-
<br />ceeds to hear the tettimony and thereupon finds the facts alleged in the said. petition to be true,
<br />that the above named deceased died January 201 1943, and at the time of his death was a resident
<br />of Alameda County, State of California, and that the said petition ought to be granted.
<br />It is therefore ordered, adjudged and decreed that the said document heretofore filed, pur-
<br />porting to be the last will of the said deceased, be and it hereby is admitted to probate as
<br />such; that ALLIE LEE CARRELL be and she hereby is appointed executrix thereof and that Letters
<br />Testamentary issue to her upon her taking the oath required by law.
