<br />At a session of the County Court held in the County Court Room in Grand Island, in said County,

<br />Cyrus P.Rathbun,Deceased
<br />I,J.H.Mullin,Judge of the County Courtin and for said County,do hereby certify that on the 4th
<br />day of November 1927,the instrument purporting to be the last will and testament of Cyrus P.
<br />Rathbun deceased,was filed for probate in this Court.That on the 23 day of November 1927 said
<br />instrument to which this certificate is attached was duly proved,probated and allowed as the last
<br />will and testament of the real and personal estate of said Cyrus P.Rathbun deceased,and the same
<br />was ordered to be recorded in the records of the Court aforesaid.

<br />Now on this 21 day of June 1928,this cause
<br />executor of the last Will and Testament of
<br />settlement of said estate and the court ha,
<br />advised in the premises finds that due and
<br />in said estate of the time and place fixed
<br />the court.
<br />came on for hearing upon the
<br />Cyrus P.Rathbun,deceased,and
<br />ring examined the records and
<br />legal notice has been given
<br />for hearing upon said report
<br />final report of D.L.Minor,
<br />upon his petition for
<br />files and being flay
<br />to all persons interested
<br />as heretofore ordered by
<br />And no one appearing to object to said report,and the court being fuly advised in the premises
<br />finds that the report is true and correct and that the same should be allowed and approved as and
<br />for the final report of the said executor.
<br />The court further finds that the said Cyrus P.Rathbun on the 22nd day of October,1927 departed this
<br />life testate,and at the time of his death was resident and inhabitant of Hall County,Nebraska.
<br />That on or about the 4th day of November,1927 the said Anna Rathbun,filed in this court her duly
<br />verified petition praying for the allowance and probation of an instrument purported to be the
<br />.last will and testament of the said Cyrus P.Rathbun,deceased; that the court thereupon fixed the
<br />23rd day of November 1927,as the day of making proof of said will and due notice of the filing
<br />of said petition and the time and place fixed for hearing thereon was given by the court in the
<br />manner provided by law,and that on the 23rd day of November,1927 the date fixed for that purpose,
<br />said instrument was duly proven,allowed and admitted to probate as and for the last Will and
<br />testament of Cyrus P.Rathbun,deceased, and Letters Testamentary were duly issued to D.L.Minor,the
<br />executor named in said will and he duly qualified as such.
<br />The court further finds that due and legal notice has been given to all persons of the time and place
<br />fixed by the court for the presentation of claims against the said estate,and that the time so
<br />fixed has fully expired,and that all persons having claims against said estate are forever barred
<br />and excluded from ever settng up or asserting such claims.
<br />The court further finds that by the terms and provisions of the last will and testament of the
<br />said Cyrus P.Rathbun,all of the real estate,to -wit: The ,�NVorth Half of the Northeast Quarter (RJNEJ)
<br />of Section Fourteen (14) Township Eleven (11) Range Teri' °West of the Sixth P.M. ,Hall County,
<br />Nebraska,passed and descended to the following named grandchildren of the said Cyrus P.Rathbun,
<br />deceased,in the following proportions:
<br />To Donald L.Rathbun,a one - fourth interest therein
<br />To Ralph W.Rathbun,a one - fourth interest therein
<br />To Georgiana Rathbun,a one- fourth interest therein
<br />To Ellen I.Rathbun,a one- fourth interest therein.
<br />in fee simple;subject to a life estate in Anna Rathbun,daughter -in -law of the said Cyrus P.Rathbun,
<br />deceased.
<br />The court further finds that upon the death or the remabriage of the said Anna Rathbun the said
<br />life estate created in said will terminates and comes to an end and that the aforementioned grand-
<br />children are entitled to immediate possession of said premises upon the happenings of the afore-
<br />mentioned contingencies.
<br />The court further finds that the executor has no personal property on hand for distribution.
<br />The court further finds that the said Cyrus P.Rathbun,deceased left as his heirs and only heirs at
<br />law the following named persons, to -wit: Donald L.Rathbun,Ralph W.Rathbun,Georgiana Rathbun, and
<br />Ellen I.Rathbun.
<br />The court further finds that all of the claims against said estate have been paid,including the
<br />funeral expenses and the costs of these proceedings ;that no inheritance tax is due the State of
<br />Nebraska from any of the devisees ;that no assets remain in the hands of the executor ;that the
<br />estate should be closed,the executor discharged and his bond released.
<br />IT IS THEREFORE,ORDERED,ADJUDGED AND DECREED BY THE COURT that the final report of the said D.L.
<br />Minor,as executor of the last Will and Testament of Cyrus P.Rathbun,deceased,be and the same is
<br />hereby approved and allowed as his final report ;that the estate is hereby settled and closed, the
<br />executor discharged and his bond released.
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED that all claims against said estate have been paid and
<br />
