THE AUG USTI NE CO. 20112.2.41 <br />WILL AND DECREE <br />11111'116 [Z <br />LAST WILL AND TESTAMENT OF DIETRICH BRASE OF GRAND ISLAND, <br />NEBRASKA. <br />I, Dietrich Brase of Grand Island, Hall County, Nebraska, being of sound mind, memory and <br />understanding, do hereby make, publish and declare this my last will and testament. <br />FIRST: <br />I give, devise and bequeath to my wife, Anna Brase, should she survive me, all of my property, <br />real and personal, for her sole use and benefit during the term of her natural life, with full power <br />to sell and convey same or any part thereof, and at her death the remainder I give and bequeath to <br />my children in equal shares, to be theirs absolutely. <br />SECOND: <br />Should my wife die prior to my death then I give and bequeath all of my property, real and <br />personal, to my children, share and share alike. <br />THIRD: <br />I hereby nominate and appoint my said wife, Anna Brase, to be the executrix of this my last will. <br />In witness whereof I have hereunto subscribed my name this 6th day of August, 1926. <br />Dietrich Brase <br />We whose names are hereunto subscribed, do hereby certify that Dietrich Brase, the testator, <br />subscribed his name to this instrument in our presence and in the presence of each of us, and <br />declared at the same time in our presence and hearing that this instrument was his last will and <br />testament, and we at his request sign our names hereto in his presence as attesting witnesses. <br />J.E.Lyle of Grand Island Neb <br />R.A.Odum of Grand Island Nebr <br />HALL COUNTY, NEBRASKA F I L E D JUN 10 1942 PAUL N. Present Paul N.Kirk County Judge <br />In the Matter of the Estate of <br />Dietrich Brase, Deceased. <br />I, Paul N.Kirk, Judge of the County Court, in and for said County, do hereby certify that on <br />the 10th day of June, 1942, the instrument purporting to be the last will and testament of Dietrich <br />Brase, deceased, was filed for probate in this Court. That on the 11th day of July, 1942, said <br />instrument to which this certificate is "attached was duly proved, probated and allowed as the last <br />will and. testament of the real and personal estate of said Dietrich Brase deceased, and the same <br />was ordered to be recorded in the records of the Court aforesaid. <br />IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the County Court, this <br />11th day of July, 1942. <br />( SEAL) <br />HALL COUNTY, NEBRASKA F I L E D <br />JUL 11 1942 PAUL N.KIRK COUNTY JUDGE <br />IN THE COUNTY COURT OF <br />HALL COUNTY, NEBRASKA. <br />IN THE MATTER OF THE ESTATE DECREE OF DISTRIBUTION. <br />OF DIETRICH BRASE, DECEASED. <br />Paul N.Kirk <br />County Judge <br />Now on this 12th day of January, 1944, this cause came on for hearing on the final report of <br />4 is Campbell, administratrix with the will annexed of the estate of the Deceased and her petition <br />for Distribution, upon the Will of the Deceased and upon the evid,6nee introduced-and the Court <br />being fully advised in the premises, finds that due and legal notice of the filing of said final <br />report and petition for Distribution,and the time and place set for hearing thdreon,.. has been <br />given in the manner provided by law, by publication as required by law and the Order of the Court, <br />and proof thereof has been filed as required by law. <br />The Court further finds that the Deceased died testate, leaving a last will and testament and <br />that the same has been allowed as and for the last will and testament of 'the` Deceased ;on the 11th <br />day of July 1942 and is a part of the records in this case. <br />The Court further finds that the final account of the administratrix. with the'will annexed, is <br />true in all respects and that she has therein accounted for all of the asse_ts.,ot the_e.state coming <br />into her knowledge or possession, that the creditors of the estate were dtAy notified in the manner <br />provided by law and the order of the Court and they were required to file their claims within three <br />months from Sept., 2nd, 1942 nd December 4th,1942 was the day fixed for the proof of claims, that <br />such day has long since passe and all claims not so filed should be forever barred; that all claims <br />filed against the estate of the Deceased and allowed by the Court, have been paid in full, that all <br />allowances, taxes, expenses of administration Court Costs, and every other charge against the <br />estate of the Deceased, except those hereinafter mentioned, have been paid in full and upon filing <br />receipts for the same and upon the final payment of the items set forth herein, the same should <br />be allowed as and for her final account; the Court further finds that Lydia Campbell advanced to <br />the Estate for the payment of taxes the sum of Seven hundred fifty six &.52/100 dollars and Fritz <br />C.Brase advanced to the Estate for the payment of taxes, the sum of Three hundred Forty two & 53/100 <br />dollars, that the administra.trix does not have on hand sufficient funds of the estate for the re- <br />payment of said sums so advanced and that said advances should constitute a lien upon the real <br />property of the Deceased until the rentals therefrom together with the cash on hand is sufficient <br />to repay such advances; that upon the final payment of such items and the filing of receipts thereof, <br />the administratiox be discharged and her bond released. <br />The Court further finds that the grocery store of the Deceased, was closed and the stock and <br />part of the fixtures have been sold to Edward J.Brase for the sum of Three Hundred Fifty dollars, <br />that the same has not been paid and that said Account should be assigned to the heirs of the <br />Deceased as provided by the will of the Deceased. <br />The Court further finds that the Deceased uied possessed of the following described real estate: <br />1 <br />1 <br />1 <br />1 <br />
