<br />The Court finds that on the 10th day of May, 1943, a petition was filed herein praying for the
<br />allowance and probate of an instrument purporting to be the last will and testament of Mary L.
<br />Costello, decesed.
<br />That the Court thereupon fixed the 5th day of June, 1943, as the date for making proof of said
<br />last will and testament and. due and legal notice of the filing of said petition and of the time
<br />and place fixed for the hearing thereon was given and provided by law, and on said date, June 5,
<br />1943, said instrument was duly proven, allowed and admitted to probate in this court as and for
<br />the last will and, testament of Mary L.Costello, deceased, and letters testamentary were duly
<br />issued thereon to Irma M.Costello,executrix, as named in said last will and testament, and that
<br />she thereupon qualified as such.
<br />The Court fines that due and legal notice has been given to all persons of the time and place
<br />fixed by the Court for filing claims against said estate; that said time has fully expired and
<br />an order has heretofore been entered herein barring all further claims against said estate; that
<br />all claims filed have been paid.
<br />The Court further finds that the said Mary L.Costello died seized as the owner, in fee simple
<br />of the following described real estate:
<br />All of Section T1ATenty- three (23), Township Eleven (11),Range Twenty -nine (29),west of the 6th
<br />Principal Meridian, Lincoln.County, Nebraska; and
<br />Lot Three (3), Block One Hundred Twenty -five (125) of Koenig & Wiebe's Addition to Grand
<br />Island,Hall County, Nebraska.
<br />The Court further Finds that under the last will and testament of Mary L.Costello, the following
<br />described real estate, to -wit:
<br />All of Section Twenty -three (23), Township Eleven (11),Range Twenty -nine (29),west of the
<br />6th Principal Meridian, Lincoln County, Nebraska,
<br />passed and descended, and is hereby assigned to Phillip Neill Costello,Sr.; and that the following
<br />described real estate, to -fait:
<br />Lot Three (3),Bl.ock One Hundred Twenty -five (125), of Koenig & Wiebe's Addition to Grand
<br />Island, Hall County, Nebraska,
<br />passed and decended, and. is hereby assigned to Irma M.Costello.
<br />The Court finds that this said estate is not subject to inheritance tax.
<br />The Court further finds that all debts against this said estate, and the costs of administration,
<br />have been paid; that distribution has been made of the residue of said estate as provided in said.
<br />last will and testament, and that nothing further belonging to said estate remains in the hands of
<br />the executrix.
<br />The Court further finf.s that Mary L.Costello, at the time of her death, left surviving hs her
<br />sole and. only heirs at law, and the sole and only persons interested in her estate,
<br />Irma. M.Costello, a. daughter
<br />Phillip Neill Costello,Sr., a son,
<br />both of legal age. That said. children are also the devisees and legatees under the last will
<br />and_ testament of the s ^.id Mary L.Costello.
<br />IT IS, THEREFORE', ORDERED, ADJUDGED,
<br />M.Costello, executrix, be, and the sam

<br />her bond as such is hereby released.
