<br />WILL AND DECREE
<br />LAST WILL AND TESTAMENT OF MARY L.COSTELLO.
<br />I, Mary L.Costello, of Grand Island,Hall County, Nebraska, being of sound mind and disposing
<br />memory, do make and publish this my last will and testament, by it revoking all former wills by
<br />me made:
<br />FIRST.
<br />I direct that my Executrix, hereinafter named, pay all of my just debts, including the expenses
<br />of my 1<�st sickneds and death, costs and exp -nses of admitting this will to probate and administer-
<br />ing my estate, from such personal property, excluding personal effects and household goods, as I
<br />may have at the time of my death, and if this is not sufficient to pay said debts and expenses
<br />I direct that the balance be a lien upon the Lincoln County land hereinafter devised to my son
<br />Philip Neill Costello, Sr.
<br />SECOND.
<br />I give and c?.evise to my son, Philip Neill Costello, Sr. the real Estate described as follows,
<br />to -wit: All of Section Twenty -three (23), ToTwnship Eleven (11),Range Twenty -nine (29), Lincoln
<br />County, Nebraska., to be by him held absolutely in fee simple.
<br />THIRD.
<br />I give and devise to my daughter, Irma M.Costello, my home located at 1015 West Division Street,
<br />Grand Island,Nebraskan, and described as follows, towit: Lot Three (3), Block One Hundred Twenty -
<br />five (125) Koenig & Wiebe's Addition to Grand Island.,Hall County, Nebraska, to be by her held_
<br />absolutely in fee simple.
<br />I give and bequeath to my daughter, Irma. M.Costello, all of the rest, residue and remainder of
<br />my property, of every kind and nature of which I may die seized, the same to include the household
<br />goods, personal effects, stoc ks bonds and other property.
<br />FOURTH.
<br />In the event that either my said. son, Philip Neill Costello, Sr., or my daughter, Irma. M.
<br />Costello, shall precede me in death, then it is my will that the share herein devised or bequeathed
<br />to said child shall not lapse but shall pass to my surviving child, absolutely.
<br />FIFTH.
<br />I name, nominate and appoint my daughter, Irma M.Costello, Executrix of this my last will and
<br />testament and direct that she be not required to furnish bond while serving in that capacity.
<br />IN WITNESS WHEREOF I have hereunto set my hand to the foregoing instrument, consisting of two
<br />pages of typewritten matter this 12th day of May, 1941, at Grand Island, Nebraska.

<br />Island, in said Coi.anty, on the 5th day of June, A.D. 1943-
<br />Present Paul N.Kirk, County Judge.
<br />In the Matter of the Estate of
<br />Mary L.Costello, Deceased.
<br />I, Paul N.Kirk, Judge of the County Court, in and for said County, do hereby certify that on
<br />the 10th day of May, 1943, the instrument purporting to be the last will and testament of Mary L.
<br />Costello, deceased, was filed for probate in this Court. That on the 5th day of June, 1943, said
<br />instrument to which this certificate is a,tta.ched was duly proved, probated and allowed as the
<br />last will and testament of the real and personal estate of said Mary L.Costello,decea.sed, and
<br />the same was ordered to be recorded in the records of the Court aforesaid..

<br />Now, on this 29th day of December, 1943, this matter came on for hearing upon the Final Report
<br />and Petition for Final Settlement of Irma. M.Costello, executrix, and upon her Application for
<br />Discharge, and was submitted to the Court.
<br />The Court having examined said report and the record and files in said estate, and after being
<br />fully advised in the premises, finds that due and legal notice has been given to all persons
<br />interested in said estate, of the time and place fixed for hearing upon said Final Report, as
<br />heretofore ordered by the Court, and no one appearinrr or objecting to said report, the Court
<br />examined the same together with the vouchers on file, and testimony in support thereof, and
<br />finds that said report is true and correct in all things, and should be approved and allowed
<br />as and for the Final Report of the Executrix.
<br />The Court finds that Mary L.Costello died on the 5th day of May, 1943, and at the time of her
