<br />NOW on this 1st day of December, 1943, this cause came on for hearing upon the petition of
<br />Charles W.Mercer, praying for a settlement of the estate of said deceased, for a determination
<br />of her heirship and the right of descent of her real estate, and the degree of kinship of her
<br />heirs -at -law and a decree settling her estate. Arid it appearing to the court from the proof on
<br />file and from the evidence submitted that due and legal notice has been given by publication
<br />for three successive weeks, as by law and the order of this court provided, to all creditors,
<br />heirs -at -law and other persons interested in said estate, of the filing of said petition and of
<br />the time and place fixed for the hearing on the same, and there being no objections thereto, this
<br />cause was duly submitted to the court upon the petition and the evidence in supoort thereof, and
<br />the court being fully advised in the premises finds that the allegations of said petition are true,
<br />and that said petitioner, Charles W.Mercer, is the owner of an undivided one -third interest in said
<br />real estate, and is a competent and proper pe-•son to prosecute this proceeding.
<br />The court further finds that the said Hannah E.Mercer departed this life intestate on the 27th
<br />day of July, 1931, and at the time of her death, she was a resident and inhabitant of Hall County,
<br />Nebraska; that she died seized as trie owner in fee simple title of the North half (NI) of Lots
<br />One (1), Two (2), and Three (3) in Block 'Lwo (2), First Addition to the village of Wood River,
<br />Hall County, Nebraska; that more than two years have elapsed since her death, and that no appli-
<br />cation lips ever been made in the State of Nebraska for the appointment of an administrator of her
<br />estate, and no petition has been filed for that purpose, and no administration has been had upon
<br />her estate.
<br />The court further finds that the said Hannah E.Mercer left surviving her, as her only heirs -at-
<br />law, the following named persons, to -wit: Charles W.Mercer, her husband, and Gladys E.Clark and
<br />Lucile E.Johnson, her daughters, all of whom are of legal age.
<br />The court further finds that under the laws of the State of Nebraska in force at the time of
<br />the death of the said Hannah E.Mercer, the said real estate above described passed and descended
<br />by absolute title, share and share alike, to the said Charles W.Mercer, Gladys E.Clark and Lucile
<br />E.Johnson, subject, however, to the homestead rights of tree said Charles W.Mercer in said premises.
<br />The court further finds that the funeral expenses of the said decedent have been fully paid,
<br />and that all debts of said deceased and of her estate, if any such existed, are forever barred
<br />and precluded, and the court finds that the costs of this proceeding have been paid.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the court,that the said Hannah E.Mercer died
<br />intestate in Hall County, Nebraska, on the 27th d,,;y of July, 1931; that more than two years have
<br />elapsed since the date of the death of the said Hannah E.Mercer; that no application for appoint-
<br />ment of an administrator of her estate has been made, and that there has been no administration
<br />on her estate in the State of Nebraska; that the said deceased died seized as the owner of the
<br />real estate hereinabove described, situate in Hall County, Nebraska; that the said Charles W.
<br />Mercer is a competent and cualified person to prosecute this proceeding;.that the deceased left
<br />as her heirs -at -law and only heirs-at-law, the said Charles W.Mercer, her husband, Gladys E.Clark
<br />and Lucile E.Johnson, her daughters; that upon the death of the said Hannah E.Mercer, the real
<br />estate above described passed and descended by absolute title to Charles W.Mercer, Gladys E.Dlark
<br />and Lucile E.Johnson, in eaua.l shares to each, subject to the homestead rights of the said Charles
<br />W.Mercer in said premises.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the court that all debts
<br />her estate, if any such existed, are forever barred and precluded; that the
<br />ing have been paid and that further administration of said estate is hereby
<br />estate is finally settled and forever closed.

<br />NOW on this 13th day of December, 1943, this matter came on to be heard upon the final account
<br />and petition for settlement thereof of E.Gertrude Younkin, administratrix of the Estate of Pacia
<br />L.C.Boettcher, Deceased, and tale evidence, and was submitted to the court; on consideration whereof,
<br />the Court finds that due and legal,notice of the time and place for hearing on said final account
<br />and petition for discharge has been given to all persons interested in said estate, as provided by
<br />law.
