<br />FINAL DECREE
<br />Now on this 26th day of November, 1943, this matter came on
<br />and petition for settlement of final account of W.P.Lauritsen,
<br />Orilla May Modesitt, deceased, and the evidence, and was submi
<br />whereof, the Court finds that due and legal notice of the time
<br />final account and petition for discharge has been given to all
<br />as provided by law.

<br />persons interested in said estate,
<br />Thereupon the Court, being fully advised in the premises finds as follows:
<br />11 That the said final account of the said W.P.Lauritsen.. Administrator of the estate of
<br />Orilla. May Modesitt, deceased, is in all respects just, true and correct, and upon a full examina-
<br />tion, said account and report is in all respects approved and allowed.
<br />2. That due and proper notice, as provided by law, ,%ras given to all creditors; that the time
<br />fixed by the court for the filing of claims against said estate has elapsed; that one claim was
<br />filed against said estate, being the claim of the County of Hall for $1,518.56 for past relief
<br />granted to the deceased, which claim was allowed by order dated October 26, 1943; that said claim
<br />was released by resolution passed by the County Board of Supervisors on November 3, 1943, a
<br />certified copy of said resolution having been filed with the court on said date; that said claim
<br />is now fully satisfied and released, and there are no other claims; that an order barring claims
<br />was entered on October 26, 1943-
<br />3. That said estate is not subject to the payment of any inheritance tax to the State of
<br />Nebraska or to the United States of America; that the court costs are paid in full.
<br />4. That Orilla May Modesitt, deceased, departed this life on November 7,1942, a resident and
<br />inhabitant of Hall County, Nebras'�a; that said decedent died intestate; that said deceased left
<br />surviving her the following persons as her heirs -at -law:
<br />Byron Robert Modesitt, a son, of legal age, of Natchez, Miss.;
<br />Robert Donald Modesitt, Ida May Modesitt, Evelyn Louise Modesitt, Bell Jean Modesitt, and
<br />June Helen Modesitt, grandchildren of Deceased; they being the five children of Donald
<br />Modesitt, a deceased son of Orilla May Modesitt, deceased, all minors, all of Grand Island,
<br />Nebraska.
<br />5. That the personal property has been disposed of as reported by said Administrator; that
<br />parts of said personal property were sold and fully accounted fo° that other personal property
<br />in the nature of personal effects and belongings were set off as exempt property to said son by
<br />the order of this court dated and entered July 21, 1943.
<br />.6.The court further finds that said deceased was the owner at the time of her death of the
<br />following described real estate;
<br />Lots Nine (9) and Ten (10) in Block Eleven (11) of Clarkson's First Addition to the
<br />Village of Alda, Hall County, Nebraska.
<br />That said property should be assigned, and descends as follows:
<br />An undivided one half interest therein to the said Byron Robert Modesitt, and an undivided one -
<br />tenth interest therein to each of Robert Donald Modesitt, Ida May Modesitt, Evelyn Louise Modesitt,
<br />Bell Jean Modesitt, and June Helen Modesitt.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the final account of the said
<br />W.P.Lauritsen, Administrator of the estate of Orilla May Modesitt, deceased, be and the same is
<br />hereby in all things a.pnroved, confirmed and allowed; that all of the above findings be and the
<br />sa.me are hereby declared to be the decree of this court; that the real estate heretofore described
<br />passed and descended to the heirs above mentioned in the shares above set forth; that the said
<br />W.P.Lauritsen, Administrator of said estate be and he is hereby discharged as such Administrator,
<br />and his bond and the sureties thereto released.
