SIXTH.
<br />I give devise and bequeath to Jens N.Jensen, my brother, who is now residing in the City of
<br />Grand Island, County of Hall and State cf Nebraska., the sum of One Thousand ($1,000.00) Dollars
<br />in cash, if there be sufficient funds available after the three above bequests have been made,
<br />as set out in Paragraphs Third, Fourth and Fifth.
<br />SEVENTH.
<br />I give devise and bequeath all the r -st, residue and remainder of my estate, both real and
<br />personal, to all of my nieces and nephews, dxcept as hereinafter exempted, who are now living
<br />at the date of the signing of this will, namely, the 3rd day of May, 1940; that said nieces and
<br />nephews being the children of all of my brothers and sisters, whether the said brothers and sisters
<br />are living or deceased, they are to receive this property share and share alike, and in case of the
<br />death of any of the said nieces and nephews prior to my death, his or her share in my estate as
<br />set out herein, shall not lapse but.shall descend to his or her legal heirs. Save and Except
<br />that I hereby and herewith specifically exempt from receiving any share under this provision of
<br />my last Will and Testament, as set out herein in this paragraph seventh, the following named
<br />nieces and nephews for the reasons also set out,namely:
<br />1. Harold P.Jensen, who is already provided for in

<br />2. Alma Jensen, idno has already been provided for in Paragraph Fourth, as above set out.
<br />3. .Nets P.Jensen, who owes me certain notes, which I herewith direct shall be cancelled
<br />and returned to him in lieu of any share in my estate of whatsoever kind or nature.
<br />4. Arthur Jensen, who owes me certain notes, which I herewith direct shall be cancelled
<br />and returned to him in lieu of any share in my estate of whatsoever kind or nature.
<br />EIGHTH.
<br />I hereby name, nominate a 7d appoint Jens N.Jensen, my brother, of Grand Island, Nebraska.,
<br />as executor of this my last Will and Testament, and I direct that he shall not be required
<br />to give bond or surety as such.
<br />IN WITNESS WHEREOF, I have hereunto subscribed my name to this instrument at Grand Island,
<br />Nebraska, on this 3rd day of May A.D. 1940, and have written my name on the margin of each of
<br />the preceding two pages of this my last Will and Testament.

<br />on the 9th day of March, 1943, the instrument purporting to be the last will and testament of
<br />Jens S.Jensen, deceased, was filed for probate in this Court. That on the lst day of April,1943,
<br />said instrument to which this certificate is attached was duly proved, probated and allowed as the

<br />Now on this lst day of December, 1943, this cause came on for hearing on the final report
<br />of Jens N.Jensen, executor of the estate of the Deceased and his petition for distribution upon
<br />the will of the Deceased and upon the evidence introduced and the Court being fully advised in
<br />the premises, finds that due and legal notice of the filing of said final report and petition for
<br />distribution, and. the time and. place set for hearing thereon, has been given in the manner
<br />provided by law,. by publication as required by law and the Order of the Court, and proof thereof
<br />has been filed as required by law.
<br />The Court further finds that the Deceased died testate, leaving a last will and testament,
<br />and that the same has been allowed as and for the last will and testament of the Deceased,and the
<br />same was duly proved in this Court in the manner provided by law on the lst day of A;-)ril 1943 and
<br />is a part of the records in this case. A copy of said last will and testament is hereto attached,
<br />marked exhibit "A" and made a part of this Decree.
<br />The Court furt'.er finds that the final account of the Executor is true in all respects and that
<br />he has therein accounted for the assets of the estate coming into his knowledge or possession,
<br />that the creditors of the estate were duly notified in the manner provided by law and the order of
<br />the Court and that July _31st, 1943, was the day fixed for the final day of filing claims against the
<br />
