BELL, DECEASED. ) <br />Now on this 3rd day of November, 1943, this matter came on to be heard upon the pleadings <br />and the evidence and was submitted to the Court, on consideration whereof the Court finds that <br />due and legal notice of this proceedings has been given to all persons interested in said matter <br />both creditors and heirs as required by law; that all of the statements and allegations set forth <br />in 'said petition are true; that the said Joseph S.Bell died intestate in Hall County, Nebraska, <br />on September 30, 1888, at which time he held a contract for the purchase of the following described <br />real estate owned by the Union Pacific Railway Company, to -wit: The West Half of the Southeast <br />Quarter (WzSE4) of Section One (1), Township Eleven (11),North,Range Twelve (12),West of the 6th <br />P.M., Hall County, Nebraska. That he died prior to the issuance of the deed and that on October <br />10, 1889 a deed was executed conveying said premises to the "heirs at law of Joseph S.Bell, de- <br />ceased." That no administration of the Estate of Joseph S.Bell for the purpose of determination <br />of heirs has been had and no finding of heirship has ever been made in this estate; that the said <br />Josenh S.Bell left surviving him at the time of his death as his only heirs at law, Sarah L.Bell, <br />his widow, and George B.Bell, Grace L.Bell and Fred C.Bell, children, all of whom were then of <br />legal age, and the Court hereby finds and determines that they were the sole and only heirs at <br />law of Joseph S.Bell, deceased, and that subject to the dower rights of the said Sarah L.Bell, <br />said real estate descended to said children in equal shares. <br />It is therefore considered and adjudged by the Court that the above described real estate be <br />and the same hereby is assigned, subject to the dower rights of Sarah L.Bell, the widow, to the <br />said George B.Bell, Grace L.Bell and Fred C.Bell, e4ch an undivided one -third therein.
