<br />Administrator and a petition praying that said account be allowed,for a decree of hheirship,an order
<br />of distribution,a final settlement thereon and discharge.
<br />For these purposes the 27th day of October,1943,at 10 o'clock A.11.at the County Court Room in
<br />said County was assigned as the time and place for hearing said petition,examining and allowing
<br />said account;and it was ordered that notice of the pendency of said petition be given to all
<br />persons interested in said estate by publishing such notice in the Grand Island Independent,a
<br />legal newspaper printed in said County,for three weeks prior to said day of hearing;and it appears
<br />by proof on file that said notice was given as ordered by Court and no objections to said final
<br />account have been made or filed.
<br />Upon examination of t1ae record and the evidence in this matter and being duly advised in the
<br />premises,the Court finds as follows:
<br />FIRST
<br />That Marie Senkbeil de -oarted this life on the 19th day of November,1942,at her home in Grand
<br />Island,Hall County,Nebraska,testate,and at the time of her death she was unmarried and a resident
<br />of Hall County, Nebraska.
<br />SECOND
<br />That on the 23rd day of November,1942,Antonie Voss,Anna Forster,Adolph Senkbeil and mathilda
<br />Barth,sisters and brother of said l,.arie Senkbeil,filed in this Court an instrument purporting to
<br />be the Last Will and Testament of said Marie Senkbeil,deceased, wherein nb Executor was named by
<br />said Testatrix,and a �tition offering said Will for probate,nominating Herbert F.11ayer to act
<br />as Administrator Witlh,� ill Annexed,alleging that said Marie Senkbeil departed this life on the
<br />19th day of November,1942,in Hall County,Nebraska,and on the 24th day of November,1942,an order
<br />of this Court was made therein assigning the 16th day of December,1942,at 10 „o'clock A.M.in the
<br />County Court Room in said County as the time and place for hearing said petition,proving said
<br />Will and admitting the same to probate,and ordering that notice of the pendency of said notice
<br />and hearing thereof be given to all persons interested in said matter by publishing said notice
<br />in the Grand Island Independent,a legal newspaper printed in said County,for three successive
<br />weeks prior to said day of hearing,and it appears by proof on file that notice of said order was,r;
<br />so given..;
<br />THIRD
<br />The Court further finds that on the 16th day of December,1942,said instrument was prvven,allowed
<br />and admitted to probate as the Last Will and Testament of said Marie Senkbeil,deceased,which Last
<br />Will and Testament is in words as follows:
<br />LAST WILL AND TESTAiviENT OF MARIE SENKBEIL
<br />I,Idarie Senkbeil of Grand Island,Nebraska,being of sound mind and disposing memory,do hereby make,
<br />publish and declare this my Last Will and Testament in words as follows:
<br />1.
<br />I make no appointment of an Executor in this Will,but provide that a majority in interest of the
<br />legatees and devisees hereinafter named,shall control the appointment of an Executor hereof;in
<br />,the event that a majority cannot agree on smeh person,then I provide that the County Judge of
<br />Hall County,Neb-raska,be authorized to appoint an Administrator of my estate with thi1j Will
<br />Annexed.
<br />2.
<br />I hereby direct said Executor or Administrator,as the case may be,to pay all my just debts,expen-
<br />ses of my last illness and burial and to have erected at my grave and pay for out of my estate,
<br />a marker similar to and in keeping with the markers now erected for my parents in the Grand Island
<br />Cemetery.
<br />3.
<br />I hereby bequeath unto my niece Alma Lassen the sum of One Hundred Dollars ($100.00) and I hereby
<br />bequeath unto her husband Harry Lassen the sum of One Hundred Dollars ($100.00),in consideration
<br />of the help'and assistance they have so kindly given me during the past year and for their help
<br />to me until I am gone.
<br />4.
<br />All of the rest,residue and remainder of my estate,both real and personal wheresoever situate,I
<br />hereby devise and bequeath as follows:
<br />To Antonie Voss,my sister,one- 'sixth part (1/6)
<br />Adolph Senkbeil,my bro ther,one -sixth part (1/6)
<br />Anna Forster,my sister,one -sixth part (1/6)
<br />M athilda Barth,my sister,one -sixth part (1/6)
<br />Alma Lassen,my niece,one- twenty- fourth part (1/24)
<br />George HeidkaTnp,my nephew,one- twenty - fourth part (1/24)
<br />Ella Bancroft,my niece,one- twenty - fourth part (1/24)
<br />Martha Weeks,my niece,one- twenty - fourth part (1/24)
<br />Arthur Senkbeil,my nepheZ, one- eighteenth part (1/18)
<br />Hilda Senkbeil,my niece,one- eighteenth part (1 15))
<br />George Senkbeil,my nephew,one- eighteenth part 1 /15)
<br />to them and to their heirs forever;my sister -in -law Antonie Senkbeil,is indebted to me on three
<br />promissory notes which I now hold of hers;I specifically provide that in the event said Antonie
<br />Senkbeil fails to nay said notes with interest in full during my lifetime or after my death to
<br />my estate withinsix months after my deceased,then I hereby provide that her three children Arthur
<br />Senkbeil,Hilda Senkbeil and George Senkbeil,shall in no wise receive anything from my estate and
<br />the above devises and legacies to them shall lapse and their share shall be divided among the
<br />other residuary legatees named in this Will,as a part of my estate and the share of each of said
<br />other residuary legatees and devisees shall be increased by that amount.

<br />I thereby revoke any and all former Wills by me made.
