Charles William Kelley appeared in person and <br />his attorney. <br />the petition of <br />J.Kelley deceased, <br />by Wm.P.Mullen, <br />It appearing from the records and files in said matter that notice of the time and place fixed <br />for the hearing on said petition has been given by publication thereof as by the-order of said <br />court heretofore made and entered, where upon Charles William Kelley was sworn and testified. On <br />consideration of the evidence the court finds that said Mary J.Kelley departed this life intestate <br />on the 12th day of April, 1935, that the said Mary J.Kelley was at the date of her death a resident, <br />and inhabitant of said County of Hall and State of Nebraska and died dazed of an estate of inher- <br />itance in the following described real estate, viz: an undivided one -half (21) interest in Lot <br />one (1) Block one hundred thirty six (136) in Union Pacific Railway Company Second Addition to the <br />City of Grand Island,Hall County, Nebraska., that more than two (2) years have elapsed since the <br />date of the death of the said Mary J.Kelley and no application for the appointment of an adminis- <br />trator of her estate has been made in this State by any heirs or persons claiming to be creditors <br />of the said deceased. That Henry B.Kelley w,-..s the surviving husband of said Mary J.Kelley, and <br />that your petitioner said Charles William Kelley, Loye Edward Kelley, Dora May Crapscy, Isaac <br />Ralph Kelley, Annie Gladys Juker, Hattie Minerva Longfellow, Alice Priscilla Rapp and Violet <br />Beatrice Deeds are Children and sole heirs of said Mary J.Kelley, being sons and daughters of <br />d.ecendent and all of lawful age. <br />IT IS CONSIDERED AND ADJUDGED BY THE COURT that one third (1/3) of said estate be and the same <br />hereby is assigned to Henry B.Kelley, surviving husband, and the remaining two thirds (2/3) of <br />said estate is hereby assigned to Charles William Kelley, Loye Edward Kelley, Dora May Crapscy, <br />Isaac Ralx)h Kelley, Annie Gladys Juker, Hattie Minerva Longfellow, Alice Priscilla Rapp and Violet <br />Beatrice Deeds, sons and daughters 'respectfully, share and share alike. <br />BY THE COURT <br />Paul N.Kirk <br />COUNTY JUDGE <br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA <br />CERTIFICATE. <br />STATE OF NEBRASKA )Ss. <br />HALL COUNTY ) I, Paul N.Kirk, County Judge of Hall County, Nebraska, do hereby certify <br />that I have compared the foregoing copy of Decree Determining Heirship entered IN THE MATTER OF <br />THE ESTATE OF MARY J.KELLEY, DECEASED, with the original record thereof, now remaining in said <br />Court, that the same is a correct transcript thereof, and of the whole of such original record; <br />that said Court is a Court of Record having a seal, which seal is hereto attached; that said <br />Court has no Clerk authorized to sign certificates in his own name, and that I am the legal <br />custodian of said Seal and of the Records of said Court, and that the foregoing attestation is <br />in due form of law. <br />IN TESTIMONY TtdHEREOF I have hereunto set my hand and affixed the seal of the County Court, at <br />Grand Island, this 13th day of October, 1943- <br />Paul N.Kirk <br />(SEAL) County Judge <br />Filed for record this 19 day of October, 1943, at 8:00 o'clock A.M.�� <br />Register of Deeds <br />-0-0-0-0-0-0-0-0-0-^-0-:-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-'0-^-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0- <br />SUPPLEMENTAL DECREE <br />' IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />IN THE MATTER OF THE ESTATE ) <br />OF ) SUPPLEMENTAL DECREE. <br />HENRY B.KELLEY, ) <br />DECEASED. <br />Now on this 13th d.ay of October, 1943, this cause came on further to be heard upon the appli- <br />cation signed by all the heirs -at -law of Henry B.Kelley, deceased, praying for a midification of <br />the Decree entered by this Court in said Estate on the 5th day of October, 1938, wherein the <br />Court decreed that the real estate, described as Lot one (1) Block one hundred thirty -six (136) <br />Union Pacific Railway Company Second Addition to the City of Grand Island, Hall County, Nebraska <br />owned by the deceased at the time of his death, descended by operation of the Statues of Descent <br />of the State of Nebraska to Charles William Kelley, a son, Loye Edward Kelley, a son, Dora May <br />Cra.psey, a daughter, Alice Priscilla Rapp, a daughter, Isaac Ralph Kelley, a son, Annie Gladys <br />Juker, a daughter, Hattie Minerva Longfellow, a daughter and Violet Beatrice Deeds, a daughter; <br />and. the Cou -t having examined the records and files of said estate together with the Decree entered <br />therein, and the ammended inventory filed by C.W.Kelley, Administrator of the Estate of Henry B. <br />Kelley deceased, find that the court erred in decreeing that the entire fee in and to the real <br />estate herein before described passed to said children for the reason that when said property <br />eras acquired that the said Henry B.Kelley we.s the owner of undivided one half ( 2 ) interest therein <br />and his r -rife Mary J.Kelley was the oT,4Tner of the 'other undivided one half ( i ) interest therein; <br />that the said Mary J.Kelley died intestate on date of April, 12th, 1935, a resident and inhabitant <br />of Hall County, Nebras'_�a, and that under the intestate laws of the State of Nebraska one third <br />(1/3) of her undivided one half (21) interest in and to the afore described real estate passed <br />and descended to Henry B. Kelley, he- surviving husband and the other two- thirds (2/3) of her <br />undivided one half (1 interest therin. nassed and descended to her children the afore named <br />Charles William Kelley, Loye Edward Kelley, Dora May Crapsey, Alice Priscilla Rapp, Isaac <br />Ralnh Kelley, Annie Gladys Juker, Hattie Minerva Longfellow and Violet Beatrice Deeds share and <br />share alike. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the application of the heirs - <br />at -law of Henry B.Kelley, deceased, filed herein on the 13th Qctober,1943, praying for a midification <br />of the Decree entered in said Estate on the 5th day of October, 1938, wherein all of the interests <br />in the above described real estate was decreed to Charles William Kelley, Loye Edward Kelley,Dora <br />L� <br />J <br />I <br />1 <br />
