361 <br />FINAL DECREE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />In the Matter of the Estate <br />of ) FINAL DECREE. <br />THOMAS LAMS, Deceased. ) <br />Now on this 29th day of September, 1943, this matter came on to be heard on the Final Report <br />and Petition for Settlement Thereof of Minnie W.Iams, Administratrix of the Estate of Thomas Iams, <br />Deceased, and the evidence, and was submitted to the Court; onconsideration whereof, the-Court <br />finds that due and legal notice of the time and place for hearing of said Final Report and Pe- <br />tition for Settlement Thereof has been given to all persons interested in said estate, as pro- <br />vided by law; thereupon the Court, being fully advised in the premises, finds as follows: <br />1. That the final account of the said Minnie W.Iams, Administratrix of the estate of Thomas <br />Iams, deceased, is in all respects just, true and correct, and said report is in all respects <br />approved and allowed; that due notice to creditors has been given; that there were no claims filed <br />or allowed against said estate; that an order barring claims was entered on February 23, 1943; <br />that an order was entered on October 24, 1942 granting the widow, Minnie W.Iams, an allowance of <br />$75 per month, and that none of the $900 due'the widow for her allowance for one year has been <br />paid, and tfla.t said widow has a lien against the real estate in said estate hereinafter described <br />for said amount; that the cash received by said administratrix as the net proceeds from the estates <br />of George W.Iams,deceased and Nancy L.Iams, deceased, has been used for the payment of court costs <br />and exb_ense of administration of said estate. <br />2. That said estate is not subject to the payment of inheritance tax to the State of Nebraska <br />or to the United States of America. <br />3. That Thomas Iams,deceased, died intestate a resident of Wood River, Hall County, Nebraska, <br />on March 17, 1942, leaving as his heirs and only heirs -at -law, the following persons, all of <br />legal age; <br />Minnie W. Iams, widow, of Wood River, Nebraska, <br />Bryan J.Iams, a brother, of Casper, Wyoming, and <br />John Iams, a brother, of Modesto, California. <br />4. That the deceased left personal property in the nature of household goods and personal <br />effects only, all of which is exempt to the widow, and should be confirmed to her. <br />5. That the deceased was the owner at the time of his death of the following described real <br />estate, to -wit: <br />Lots One (1), Two (2) and Three (3), in Block Five (5), of Dodd & Marshall's Addition <br />to Wood River, Hall County, Nebraska; f <br />An undivided one -third interest in and to Lots Five (5) and Six (6) in Block Five (5) of <br />Dodd & Marshall's Addition to Wood River, Hall County, Nebraska; being property in the <br />Nancy L.Iams Estate; <br />An undivided one -third interest in and. to Lot Four (4) in Block Five (5);-also Lots Six (6) <br />and Seven (7) in Block Six (6); also Lots Eleven (11),Twelve (12), Thirteen (13) and Fourteen <br />(14),in Block Seven (7); all in Dodd & Marshall's Addition to Wood River, Hall County, Nebraska; <br />being property in the George W.Iams Estate. <br />Lots Eleven (11) and Twelve (12) in Block Two (2) of Clark's Addition to Wood River, Hall <br />County, 1�ebraska, except the North twenty -five (25) feet of both of said lots. <br />that said property descends and should be assigned, an undivided one -half interest therein to the <br />said. Minnie W.Iams, widow of deceased, and an undivided one - fourth interest. therein to each of <br />Bryan J.Iams and John Iams, brothers of deceased. <br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that all of the above findings be, <br />and they hereby are, adopted as the decree of this court; that the Bove- described real property <br />descends, and it is hereby assigned, to the heirs above named in the proportions above stated; <br />that said Minnie W.Iams, widow, have a lien against said real estate in the amount of $900.00 for <br />her unpaid widow's allowance; that the personal property be - confirmed in said Minnie W.Iams; <br />that the said Minnie W.Iams, Administratrix of said estate of Thomas Iams, deceased, be and she <br />hereby is discharged as such administratrix, and her bond and sureties thereto released.
