<br />That said deceased died seized of and in possession of the following described real estate to -wit:
<br />Lot 1 Mainland, the East Half of the Southeast Quarter and the Southeast Quarter of the Nort�a,-
<br />east Quarter of Section 34; the Northwest Quarter and the Southwest Quarter of Section 35;
<br />Lots 1, 2, 3 and 4 Mainland, of Section 26; Lot 1 Mainland of Section 27; the South Half of
<br />the Southeast Quarter of Section 35,- all of .the above in Township 9 North,Range 12 West of
<br />the 6th P.M., Hall County, Nebraska., and
<br />the West Half of Section 2, Township 8 North,Range 12,West of the,6th P.M., Adams County,
<br />Nebraska.
<br />That the Southwest Quarter of Section 35, Township 9 North,Range 12,West of the 6th P.M., Hall
<br />County, Nebraska, above described was the homestead of the deceased and his widow, Anna Miller.
<br />4.
<br />That on or about the 27th day of October, 1942, Anna Miller and Howard W.Miller filed in this
<br />court their petition asking for the appointment of an administrator of said estate, that after the
<br />published notice of the time and place of the hearing on said petition, this court, on the 14th day
<br />of November,- 1942, a.p�ointed Howard W.Mil1Pr and J.Fred Ernstmeyer as the administrators of said
<br />estate and on that date they qualified as such by giving bond as required, and have since then been
<br />the duly apr.ointed, qualified and acting administrators of said estate.

<br />That on the 8th day of September, 1943, said Administrators filed in this court their Final Re-
<br />port, showing the amounts by the- received and disbursed as such administrators, which report
<br />showed a balance of $200.00 after the payment of the amounts by them expended.

<br />That this court apx)ointed one A.J.Luebs as appraiser for inheritance tax in said estate; that
<br />said appraiser made and entered in this court his report showing a tax due from the share inheri-
<br />ted by Howard W.Miller of $83.40, which has been by this court duly assessed against the shame and
<br />portion of Howard W.Miller, and. which has been paid and a receipt therefor appears in the files
<br />of this estate; that said appraiser found that the shore and portion of said estate due the widow,
<br />Anna Miller, was not liable for inheritance tax.

<br />The court further finds that due notice was given to creditors to file claims, if any, against
<br />said estate; that no claims were filed and that all other claims should be forever barred.

<br />That, as reflected by the final report of said administrators, all claims against said estate
<br />have been paid, including the expense of the last sickness and burial of said deceased and all of
<br />the costs and expenses of administering the estate.

<br />The court further finds that said final report should be accepted and approved as the final
<br />report of said administrators and that all of their acts as such administrators should be ratified
<br />and confirmed; that they should be discharged from their trust as administrators, their letters of
<br />administration cancelled and annuled and their bond relieved of further liability.
<br />The receipt of the widow, Anna Miller, and the son, Howard W.Miller, heirs, is filed in this
<br />court, showing the receipt by -3-
<br />them of the balance as shown oy said report.
<br />IT IS ORDERED, ADJUDGED AND DECREED:
<br />That the final report of said administrators be and the same is hereby in all things approved
<br />and their acts and doings as such administrators are ratified and confirmed and no balance shown
<br />to be in their possession; that they bA and they are hereby discharged from their trust as adminis-
<br />trators, their letters of administration cancelled and their bond relieved of further liability.

<br />That all of the findings above are hereby decreed to be true.

<br />That all of the real estate described in the above findings and all of the personal property
<br />belonging to the deceased is hereby assigned to Anna Miller and Howard W.Miller, to each an un-
<br />divided one -half (1/2) thereof.
<br />4.
<br />That the Southwest Quarter of Section 35, Township 9 North, Range 12, West of the 6th P.M. Hall
<br />County, Nebraska, be and the same is hereby assigned to the widow, Anna Miller, as a homestead,
<br />with all of the rights and liabilities appertaining to the same.
<br />5.
<br />That the court especially finds that the inheritance tax due on the share and portion assigned
<br />to Howard W.Miller has been paid and that the share and portion assigned to the widow, Anna Miller,
<br />is free from inheritance tax of government estate tax.
