<br />That the bequests named in said will in favor of Catharine Kountze, the widow of said
<br />Augustus Kountze, have all ben by the executors delivered to her and to the trustees named in
<br />said will, in exact accordance with its provisions, she having duly elected, and manifested her
<br />election, to take and accept said bequests in lieu of all dower and statutory rights in and to
<br />the estate of said Augustus Kountze, wherever located.
<br />That the devise and bequest made in said will to Herman Kountze in trust for the General
<br />Synod of the Lutheran Church of the United States never became operative or of effect, for the
<br />reason that said General Synod, although having due and full notice of said devise and bequest
<br />and of the conditions and provisions concerning the same, never in any manner, nor to any ex-
<br />tent, fulfilled any of said conditions and provisions, and never made any claim or demand for said
<br />devise and bequest, but allowed said devised and bequest to lapse, and to become parts of the
<br />residuary estate; and said devise and bequest did lapse and become long ago parts of the residuary
<br />estate.
<br />That pursuant to the powers granted to and conferred upon them in and by said will, and with
<br />the expressed asset of all of said heirs, said brothers and sisters, who were the beneficiaries
<br />named in said will, said executors sold, granted and conveyed unto The United Heal Estate and
<br />Trust Company, a corporation organized and existing under the laws of the State of Nebraska for
<br />the purpose among others of owning and dealing in real property, all of the lands hereinabove
<br />described; and said executors distributed and paid over the proceeds of said sales to said
<br />brothers and sisters, said beneficiaries, in accordance with the proportions to which each was
<br />entitled under said will. Said Catherine Kountze, the widow of said Augustus Kountze, by deed
<br />executed, relinquished all her dower and statutory rights in and to all of the said lands unto
<br />said brothers and sisters; and said brothers and sisters, to -wit: Herman Kountze, then a widower,
<br />Luther Kountze and Annie P.Kountze his wife, Charles B.Xountze, and Mary E.Kountze his wife,
<br />Mitilda K.Gardiner a widow, Adaline kluth, then living, and William Ruth her husband, Clementine
<br />Brown a, widow, Margaret Berger a widow, and Mary Dorothea Oliver and George T.Oliver her husband,
<br />each and all, granted and conveyed all of the interests and ownerships of each and all in and to
<br />all of said lands unto said United Real Estate and Trust Company; that each of said brothers and
<br />sisters, with the proceeds of the sales which each received from said executors, subscribed for
<br />United Real Estate and Trust Company
<br />or purchased and received shares of the capital stock of said
<br />in the exact proportions to their interest in said lands, as said beneficiaries, prior to the
<br />thereof; and that said United Real Estate and Trust Company through said conveyances be-
<br />sales
<br />came seized of said lands with the title which was in said Augustus Kountze at the time of his
<br />death.
<br />That there is now no property or assets or any description in the possession or under the
<br />control of said executors within the State of Nebraska and jurisdicition of this court by virtue
<br />of this ancillary administration; all of the property and assets of the estate of said Augustus
<br />Kountze deceased, which came into the hands of said executors by virtue of the issuance of
<br />letters to them by this court being shown hereinabove, and the same having been sold and con-
<br />veyed and the proceeds distributed as hereinabove found.
<br />That after completing the record in this matter there will be due this court for costs of
<br />administration the sum of twenty -six dollars and eighty -five cents.
<br />WHRERFORE, it is ordered and considered by the Court; that all of the doings of Herman
<br />Kountze, Luther Kountze, and Charles B. Kountze, as the executors of the will of Augustus
<br />Kountze, deceased, as shown herein, be, and the same, each and all, are hereby approved, ratified
<br />and confirmed; that said final administration report and account is hereby settled, allowed and
<br />as filed; that said executors pay the said costs herein taxed wPo-u—n �aQS .9A s;

<br />and that upon the payment of the said costs of administration said Herman ze, as executdrs
<br />of the will of said Augustus Kountze, deceased, be forever discharged from their trust as said
<br />executors and their bonds released.
