<br />WILL AND DECREE
<br />LAST WILL AND TESTAMENT OF GEORGE GRAHAM.
<br />KNOW ALL MEN BY THESE PRESENTS, That I, George Graham, of Doniphan, Nebraska, being of sound
<br />mind and disposing memory, do make, publish and declare this my Last Will and Testament in the
<br />manner and form following, to -wit:
<br />FIRST: I direct that all debts against my estate and the expenses of my last sickness be first
<br />paid by my Executor hereinafter named.
<br />SECOND: I give, devise and bequeath to Cedarview Cemetery of Doniphan, Nebraska, the sum of
<br />One Hundred ($100.00) Dollars absolutely.
<br />THIRD: I give, devise and bequeath the use of the sum of One Hundred ($100.00) Dollars to
<br />Cedarview Cemetery of Doniphan, Nebraska,-the same to be placed in a bank or in the hands of a
<br />trustee to be named by the County Judge of Hall County, Nebraska, and the interest therefrom to
<br />be paid to Cedarview Cemetery once each year, the same to be held in trust perpetually for the
<br />benefit os said Cemetery.
<br />FOURTH: I give, devise and bequeath to the Congregational Church of Doniphan, Nebraska., the sum
<br />of One Hundred 0100.00) Dollars absolutely.
<br />FIFTH: I give, devise and bequeath the use of the sum of One Hundred ($100000) Dollars to the
<br />Congregational Church of Doniphan, Nebraska, the same to 1�0. placed in a bank,,in the hands of a
<br />trustee to be named by the County Judge of Hall County, Nebraska, and the interest therefrom to
<br />be paid to the Congregational Church once each year, the same to be held in trust perpetually
<br />for the benefit of said Church.
<br />SIXTH: My nephew, Ray Derby, is indebted to me in the sum of Two Hundred ($200.00) Dollars.
<br />erect that said sum shall be deducted from his distributive share herein and that One - Hundred
<br />($100.00) Dollars thereof be paid to the Christian Orphans' Home at HoTdrege,Nebraska, and One
<br />Hundred ($100.00) Dollars thereof be paid to Father Flanigan Boys' Home at Omaha, Nebraska.
<br />SEVENTH: _I give, devise and bequeath to my friend, Anna Cowan, the sum of One Hundred ($100.00)
<br />Dollars; to my friend, Linda Collins, Fifty ($50.00) Dollars; and to my friend, A let't,a Shultz,
<br />the sum of Fifty ($50-00) Dollars.
<br />EIGHTH: I hereby authorize and empower my executor hereinafter named to sell and dispose of
<br />all of my property whether real, personal or mixed, and possessed by me at the time of my death,
<br />He is hereby given authority to do so without application to or authority from any court whatso-
<br />ever.
<br />NINTH: After the sale of all of my property, as above set forth, I direct that my debts and the
<br />bequests hereinbefore set forth be first paid and.the rest, residue and remainder of my property
<br />shall be divided equally among the following persons, to -wit:
<br />Ray Derby, a nephew
<br />George Graham, a nephew,
<br />Alex Graham, a nephew,
<br />Amelia Graham, a niece,
<br />Alma Richter, a. niece,
<br />Susie Cotton, a grandniece,
<br />John Watson, a second cousin.
<br />John Graham, a nephew,
<br />Mart Tannehill, a nephew,
<br />Theodore Derby, a nephew,
<br />John McDonald, a nephew,
<br />Thomas Warren, a friend, of Poneaka,
<br />Eleanor Voithoffer, a friend, and
<br />Minnie Graham, a half -s'_s ter.
<br />Alberta, Canada.
<br />All of the said rest, residue and remainder shall be divided equally among the above named
<br />persons, and should any of them precede me in death, I direct that his or her share shall not
<br />lapse, but shall be paid to his or her surviving children, and if no surviving children, the same
<br />to be paid to his or her legal heirs.
<br />TENTH: I have other cousins, nephews, nieces and blood relations but I do not desire to leave any
<br />of them any part of my property, other than the ones named in the foregoing will.
<br />ELEVENTH: I hereby name, nominate and appoint Lee Woodman of Doniphan, Nebraska, Executor of this
<br />my Last Will and Testament, and I hereby authorize and empower the said Lee Woodman to sell any and
<br />all real estate which may become necessary in the proper settlement of my estate, without applica-
<br />tion to or authority from any court whatsoever, hereby revoking any and all former wills by me
<br />made.
<br />TWELFTH: I hereby revoke any and all former wills and codicils by me made.
<br />IN WITNESS WHEREOF, I have signed the foregoing instrument consisting of two pages of.type-
<br />written matter this 21st day of November, A.D. 1939, at Grand Island,Nebraska.
