<br />In the matter of the estate of Mary Neal, deceased.
<br />DECREE OF FINAL SETTLEMENT AND DISTRIBUTION.
<br />On this 22nd day of March, 1943, before me W.Halsey Bohlke, County Judge of Adams CQuntyo
<br />Nebraska, this matter came on to be heard having been continued by agreement from March 15, 1943,
<br />upon the petition of final account filed herein and the final report and supplemental report of
<br />W.M.Whelan, Executor of the Will and estate of Mary Neal,deceased.
<br />Lawrence Dunmire appearing for and representing some of the parties interested in said estate
<br />and upon the application filed herein by Bruckman & Dunmire, attorneys for the heirs of William
<br />Neal, deceased, in which application the applicants pray for an order of the Court directing the
<br />executor to assign to them, the said heirs at law of William Neal, deceased, the real estate de-
<br />vised to them under the Will, described as follows, to -wit:
<br />Northeast Quarter (NE4) of Section Twenty -three (23), Township Nine (9), North of Range
<br />Nine ( 9), Hall County, Nebraska, and
<br />two residence properties located at the corner of Seventh street and Denver Avenue, Hastings,
<br />Nebraska, described as follows;
<br />Lots 4 and 5, and the West 8 feet of the North 85 feet of Lot 3, Block 1, Original Town
<br />of Hastings, Adams County, Nebraska, and to make and enter an order herein
<br />directing the executor to distribute to said heirs all of the rentals collected and received from
<br />said described real estate and accounted for by the executor in his final report since the death
<br />the the said Mary Neal, which application, after due consideration, is denied insofar as the same
<br />has reference to the distribution of said rentals to said heirs.
<br />WHEREUPON the Court finds that due notice has been given by publication of the filing of the
<br />final report of the Executor herein and of his petition for final settlement, and that proof of
<br />said notice is on file herein.
<br />CERTIFICATE OF PROBATE
<br />The State of Nebraska, Adams County:ss At a session of the County Court, held in and for said
<br />County, at the County Court Room in Hastings, on this 6th day of July, A.D. 1942. Present, W.
<br />Halsey Bohlke, County Judge: In the Matter of the estate of Mary Neal,deceased.
<br />I, W.Ha.lsey Bohlke, County Judge in and for said County, do hereby certify that on this 6th
<br />day of July, A.D. 1942, the instrument purporting to be the last Will and testament of the said
<br />Mary Neal, deceased, which was filed in this court, on the 18th day of June, A.D.1942, and being
<br />the instrument to which this is annexed, was duly proved, approved, probated and allowed, as the
<br />last Will and testament of the said Mary Neal, deceased, in and for the state of Nebraska; and
<br />it was ordered to be recorded in the records of the County Court aforesaid.
<br />In Witness whereof, I have hereunto set my hand, and the --seal of said County Court at Hastings,
<br />The Court further finds that said report of receipts and expenditures, and assets on hand for
<br />assignment and distribution is true and correct, and that said report should be and it is hereby
<br />approved and allowed as such.
<br />The Court further finds that said Mary Neal died on the 13th day of June, 1942 in Hastings,
<br />Adams County, Nebraska,,where she had resided for a number of years; that said deceased left an
<br />instrument in writing purporting to be her last Will and Testament; which instrument has been
<br />duly and regularly probated herein, and that a copy of said Last Will and Testament together
<br />with the Certificate of Probate is incorporated herein as a part of this final decree, as follows:
<br />"LAST WILL AND TESTAMENT OF MARY NEAL.
<br />I, Mary Neal, being of sound mind and memory and anxious to arrange all of my worldly affairs
<br />while in the full possession of my faculties, do hereby make, publish and declare this my last
<br />will and testament, hereby revoking any and all former wills by me made, in words and figures
<br />as follows:
<br />FIRST, I hereby direct my executor hereinafter named to pay out of my estate all of my just
<br />debts and obligations, including expenses of last illness, funeral expenses and expense of
<br />administering my estate.
<br />SECOND. All of my personal belongings including household effects and personal property I
<br />hereby direct shall be sold and converted into cash by my executor, and after the payment of all
<br />debts and other charges as provided in paragraph first hereof, I hereby direct that the residue
<br />and remainder of said proceeds shall be turned over for the use and benefit of charity as more
<br />apecifically directed in memoranda I have left in my bank box.
<br />THIRD, I hereby give, devise and bequeath the sum of Five Hundred ($500.00) Dollars to the
<br />Pastor of St. Cecilia's Church of Hastings Nebraska, to be paid by my executor for the spiritual
<br />�homas
<br />intention of the members of the family of Dunn, deceased, including the testatrix.
<br />FOURTH, I hereby give, devise and bequeath the home property located at the corner of 7th street
<br />and Denver Avenue and the real estate immediately South thereof, in Hastings, Nebraska, and the
<br />real estate described as the Northeast Quarter of section 23 Township 9,Range 9, Hall County,
<br />Nebraska, to the heirs at law of William Neal, deceased, living at the time of my death.
<br />FIFTH, All the rest, residue and remainder of my estate, whether real, personal or mixed and
<br />wherever situate, I hereby give, devise and bequeath unto my beloved cousin Thomas Dunn of Hastings,
<br />Nebraska.
<br />LASTLY, I name, nominate and appoint as Executor of my last will and testament, W.M.Whelan, of
<br />Hastinggs, Nebraska.
<br />In Witness Whereof, I have hereunto set my hand this 21st day of September, 1939•
<br />Mary Neal, Testatrix.
<br />We, whose names are hereto attached do hereby certify that Mary Neal, the testatrix signed the
<br />foregoing instrument in our presence and acknowledged said instrument to be her last will and
<br />testament in our presence and hearing, and we at her request sign our names hereto in her presence
<br />and in the presence of each other as attesting witnesses.
