<br />IN THE MATTER OF THE ESTATE OF
<br />GLEN H.MINER, DECEASED.
<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA
<br />D E C R E E
<br />NOW on this 22nd day of September, 1943, this cause came on for hearing on the final report of
<br />Gertrude Miner, executrix of the estate of Glen H.Miner,deceased, and upon her application for the
<br />approval and allowance of said report, settlement of said estate and her discharge as executrix in
<br />said estate, and the court having examined the records and files herein, including said report and
<br />vouchers thereto attached, and being fully advised in the premises finds as follows;
<br />That on the 5th day of December, 1942, Gertrude Miner, widow of said deceased, filed her petition
<br />in this court in which she alleged, among other things that Glen H.Miner departed this life in
<br />Hall County, Nebraska, on the Nth day of November, 1942, leaving a Last Will and Testament in which
<br />Gertrude Miner was named executrix thereof, which instrument she offered for probate as the Last Will
<br />and Testament of said deceased and asking that she be appointed executrix thereof; that upon reading
<br />and filing said petition this court entered an order fixing the time and place for hearing said
<br />petition and giving notice thereof, as provided by law, and that said matter coming on to be heard
<br />upon the date fixed by the court, said instrument was duly admitted to probate in this court as the
<br />Last Will and Testament of the said deceased and letter of administration were issued to the said
<br />Gertrude Miner; that due and legal notice has been given to all persons of the time and place fixed
<br />by the court for filing claims against said estate, and all claims not filed within the time fixed
<br />by the court, if any such there be, should be forever barred, excluded and enjoined from setting
<br />up or asserting any such claims against said estate.
<br />That the deceased departed this life leaving as his heirs at law and only heirs at law, legatees,
<br />devisees, and persons entitled to share in his said estate the following: Gertrude Miner, widow,
<br />Grand Island, Nebraska, Max Miner, son, Grand Island, Nebraska,Robert Miner son, Grand Island, Nebraska,
<br />Hugh Miner, son, a minor, Grand Island, Nebraska, and Richard Miner, a son, minor, Grand Island,
<br />Nebraska.
<br />That the deceased departed this life the owner in fee simple title in and to the following des-
<br />cribed real estate situated in Hall County, Nebraska, to -wit:
<br />An undivided one -half interest in and to
<br />Lots Six and Seven (6 & 7), and the West One -third of Lot Eight (8), all in Block Fifty -two
<br />(52), Original Town, now City of Grand Island,Nebraska.
<br />and certain personal property consisting of automobiles, hearses, and an ambulance, as set out in
<br />the inventory filed herein, and the said above described real estate and personal property did pass
<br />and descend under the terms of the said Last Will and Testament as follows: To Gertrude Miner, all
<br />of said real estate, in fee simple title, and all of said personal property as set out in the in-
<br />ventory filed herein.
<br />The Court further finds that all of the claims filed in said estate have been paid and satisfied
<br />or disallowed, as by law provided.
<br />That the final report filed herein is true and correct, in all things, and that the same should
<br />be approved and allowed as her final report in said estate, said estate settled and closed, said
<br />executrix and her official bondsman discharged and released of any further liability in said. matter.
<br />That there is no inheritance tax due the State of Nwbraska or the United States of America.
<br />IT IS THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims against
<br />said estate not filed within the time fixed by the court, if any such there be, are forever barred,
<br />excluded and enjoined from setting up or asserting any such claims against said estate and that the
<br />final report filed herein by Gertrude Miner be and the same is hereby, in all things, approved and
<br />allowed as and for said. executrix's final report, said estate settled and closed, and said execu-
<br />trix and her surety on her official bond are hereby released from any further liability in said
<br />matter.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the real estate, hereinbefore des-
<br />cribed, did pass and descend under and by virtue of the terms of the Last Will and Testament of
<br />the said Glen H.Miner,deceased, as follows: To Gertrude Miner, an undivided one -half interest in
<br />and to Lots Six and Seven (6 & 7)' , in Block Fifty -two (52), Original Town, now City, of Grand
<br />Island, Hall County, Nebraska an that said personal property, hereinbefore described, did pass
<br />and descend to the said Gertrude Miner, all in fee simple title, and distribution thereof is
<br />accordingly made.

<br />thereof, and of the whole of such original record; that said Court is a Court of Record having a
<br />seal, which seal is hereto attached; that said Court has no Clerk authorized to sign certificates
<br />in his own name, and that I am the legal custodian of said Seal and of the Records of said Court,
<br />and that the foregoing attestation is in due form of law.
