Wazc <br />l �� \ ,l 1,1 I •I I • l•� • FEE, <br />THEAUGUSTINECO. 20112.2.41 <br />Upon examination of the record and the evidence in this matter,and being duly advised in the prem- <br />ises,the Court finds as follows: <br />FIRST <br />That Martha R.Keilig departed this life on the 1st day of Uune,1942,at Grand Island,Nebraska,intestate, <br />and'-that at the time of her death she was a resident of Hall County,Nebraska. <br />SEPOND <br />That on the 9th. day of June,1943,Frank Keilig,a son pf said deceased,filed in this Court a petition <br />praying for the appointment of said Frank Keilig,as Administrator of the Estate of said deceased, <br />and on the 9th day of June,1942,an order of this Court was made therein,assigning the 8th day of <br />July,1942,at 10 o'clock A.M. at the County Gourt Room in said County,as the time and place for hearing <br />said petition,and ordering that notice of the pendency of said Petition and hearing thereon be <br />given to all persons interested in said matter by publishing said notice in the Grand Island <br />Independent,a legal newspaper printed in said County,for three successive weeks prior to said day <br />of hearing,and it appears by proof on file that notice of said order was given as ordered by this <br />Court. THIRD <br />The Court further finds that Frank Keilig,named in said petition, was, upon his giving bond in the <br />sum of $2,000.00 as ordered by this Court,appointed Administrator as prayed and Letters of Admin- <br />istration were duly issued to him on July 5,1942: the Court further finds that the deceased at <br />the time of her death,was a widow and that she left the following heirs -at -law; Meta Keilig,a <br />daughter,Ernest F.Keilig,also known as Ernst Keilig,a sbn,Frank W.Keil'ig,a son,Maria Keilig <br />Koerner,a daughter,and the following children of a predeceased son Martin Keilig,to -wit: <br />Marvin Keilig,a nephew,h1erle F.Keilig,a nephew,ald William E.Keilig,a nephew,all of whom are over <br />the age of 21 years excepting said William E.Keilig,who was a minor of the age of 18 years. <br />FOURTH <br />That on the 8th day of July,1942,an order was made herein allowing creditors three months from <br />and after the 5th day of August,1942,in which to file their claims against said estate and said <br />Administrator one year in which to settle said estate,and further ordering that notice to cred- <br />itors be published in the Grand Island Independent,a legal newspaper published and circulating <br />in Hall County,Nebraska,for three successive weeks prior to said 5th day of August,1942,and that <br />a hearing on claims filed against said estate would be held at the office of the County Judge <br />of Hall County,Nebraska,on November 6,1942,at 9 o'clock A.M.,and it appears by proof on file that <br />notice of said order was published as ordered by this Court. <br />FIFTH <br />The Court further finds that on the 15th day of July,19442,said Frank Keilig,as Administrator,filed <br />in this Court his inventory of the property of said estate,and that according to said inventory, <br />the deceased died seized and possessed of the following described property,to -wit: <br />An undivided one -half interest in the Northwest Quarter (NWj) of Section Thirty -six (36),in <br />Township Eleven (11) North,Range Eight (S),West of the 6th P.M.in Hamilton County,Nebraska; <br />An undivided one -half interest in Lot One (1) in Block Sixteen (16) of Rollins' Addition to the <br />City of Grand Island, Hall County, Nebraska; <br />Cash and miscellaneous personal property of the approximate value of $3500.00. <br />SIXTH <br />The Court further finds according to the laws of descent and distribution,said property descends <br />as follows: an undivided one -fifth share to each of the following :Meta Keilig ;Ernest F.Keilig, <br />also known as Ernst Keilig;Frank W.Keilig;Maria Keilig Koerner ;and an undivided one - fifteenth <br />interest to each of the following: Marvin Keilig,M erle F.Keilig and William E.Keilig. <br />SEVENTH <br />The Court further finds that on the 9th day of November,1942,an order of this Court was made <br />barring all claims not filed against said estate and allowing certain claims filed prior thereto; <br />the Court further finds that all debts and claims against said estate,including costs of admin- <br />istration io sa9_d estate,have been fully paid. <br />EIGHTH <br />The Court further finds that on the 29th day of Iyarch,1943,said Frank Keilig,Administrator,filed <br />his resignation as Administrator herein and a report of his acts and doings as such Administrator <br />from the date of his appointment to the 29th day of March,1943,which report the Court finds is <br />true and correct in all respects ;that on the lst day of Apri1,1943,Ernest F.Keilig,a son of said <br />deceased,filed in this Court his petition praying for the appointment of said Ernest F.Keilig as <br />Administrator de bonis non of the estate of said deceased,and on the lst day of April,1943,an <br />order of this Court was made therein assigning the 24th day of Apri1,1943,at 10 o'clock A.M.at <br />the County Court Room in said County as the time and place for hearing said petition,and ordering <br />that notice of the pendency of said petition and hearing thereon be given to all persons inter- <br />ested in said matter by publishing said notice in the Grand Island Independent for three success- <br />ive weeks prior to said day of hearing,and it appears by proof on file that notice of said order <br />was given as ordered by this Court. <br />NINTH <br />The Court further finds that said Ernest F.Keilig named in said petition was,upon his giving bond <br />in the sum of $4,000.00 as ordered by this Court,appointed Administrator de bonis non as prayed and <br />Letters of Administration were duly issued to him ;that an order of this Court was entered on <br />April 24,1943,accepting the resignation of said Frank Keilig as Administrator herein and approving <br />his report as such Administrator; <br />TENTH <br />The Court further finds that on the 28th day of April,1943,said Ernest F.Keilig,as Administrator <br />de bonis non,filed in Court his inventory of the property of said estate coming into his hands, <br />which inventory included all of the property set forth in the inventory of FranK Keilig,A dminis- <br />trator,filed herein on July 15,1942,excepting such personal property as had been disposed of by <br />said Frank Keilig prior to his resignation,as set forth in his report filed herein on March 29, <br />1943. ELEVENTH <br />The Court further finds that there remains in the hands of said Administrator de bonis non for <br />distribution,no money or assets of whatsoever nature,he having fully distributed said estate to <br />the persons entitled thereto as set forth in his said final report herein filed and receipts of <br />the heirs -at -law of said Martha R.Keilig,deceased,on file in this Court. <br />TWELFTH <br />The Court further finds that after deducting from the assets of said estate,all debts,claims, <br />costs of administration and all other proper expenditures,and the statutory exemptions allowed <br />the heirs -at -law in said estate,there is due and payable to the County Treasurersof Hall County <br />and Hamilton County,Nebraska,no inheritance tax whatsoever. <br />77 <br />1 <br />1 <br />
