<br />further finds that said Martin Harders, at the time of his death, was married and he left the
<br />following heirs -at -law and only heirs -at -law, to- wit :: Margaretha Harders, his widow, John Harders,
<br />a son, Julius Harders, a son, Otto Harders, a son, Ernest Harders, a son, Hugo Harders, a son,
<br />Carl Harders, a son, Emil Harders, a son, Ella Thomsen, a daughter, Frieda Hargens, a daughter,
<br />Edith Eich,Jr., a daughter,
<br />FOURTH
<br />The Court further finds that on the 15th day of April, 1943, an order of this Court was made
<br />allowing creditors three months from and after the 12th day of May, 1943, in which to file their
<br />claims against said estate and said Executor one year in which to settle said estate, and further
<br />ordering that notice to creditors be published in the Grand Island Independent, a legal newspaper
<br />published and cirulating in Hall County, Nebraska, for three successive weeks prior to the 12th
<br />dety of May, 1943, and that a hearing on claims filed against said estate would be held at the
<br />office of the County Judge of Hall County, Nebraska, on the 16th day of August, 1943, at 9 o'clock
<br />A.M., and it appears by proof on file that notice of said order was published as ordered by this
<br />Court.
<br />FIFTH.
<br />The Court finds that on the 16th day of April, 1943, said Herbert F.Mayer, Executor of said
<br />estate, filed in this Court his inventory of the property of said estate, and that according to
<br />said inventory, the deceased died seized and possessed of the following described property,to -wit:
<br />Southeast Quarter (SEJ) of Section Eight (8) in Township Eleven (11) North,Range Eleven (11),
<br />West of the 6th P.M. in Hall County, Nebraska.
<br />Southeast Quarter of Section Seventeen X17) in Township Eleven (11) North,Range Eleven (11),
<br />West of the 6th P.M. in Hall County, Nebraska.
<br />Southwest Quarter (SW4) and South Half of Northeast Quarter (S ;NE4) and Southeast Quarter
<br />of Northwest Quarter (SEiNW4) and Northwest Quarter of Southeast Quarter (NW4SE4) of Section
<br />Sixteen (16), in Township Eleven (11) North,Range Eleven (11),West of the 6th P.M. in Hall
<br />County, Nebraska.
<br />Cash in the sum of $1591.44 aild household furniture and promissory note of Thomas Thomsen.
<br />The Court further finds that according to the terms, conditions and provisions of said Last
<br />Will and Testament of said deceased, the Southeast Quarter of Section 8 in Township 11 North,
<br />Rarge 11, West of the 6th P.M. in Hall County, Nebraska, was devised in fee simple absolute to
<br />Otto Harders, subject to a life estate in Margaretha Harders for and during the term of her
<br />na.t,zral life; that the Southeast Quarter of Section 17 in Township 11 North,Ran�e 11,West of
<br />the 6th P.M. in Hall County, Nebraska, was devised in fee simple absolute to Ernest Harders
<br />subject to a life estate in Margaretha Harders for and during the term of her natural life;
<br />that the Southwest Quarter of Section 16 in Township 11 North,Range 11,West of the 6th P.M.
<br />In Hall County, Nebraska, was devised in fee simple absolute to Carl Harders subject to a life
<br />estate in Margaretha Harders for and ditiring the term of her natural life; that the South Half
<br />of the Northeast Quarter and the Southeast Quarter of the Northwest Quarter and the Northwest
<br />Quarter of the Southeast Quarter of Section 16 in Township 11 North,Range 11,West of the 6th
<br />P.M. in Hall County, Nebraska, was devised in fee simple absolute to Hugo Harders subject to a
<br />life estate in Margaretha Harders for and during the term of her natural life; that the promissory
<br />note of Thomas Thomsen was bequeathed unto Ella Thomsen, daughter of , I testator; the sum of
<br />$5.00 each was bequeathed unto John Harders, Julius Harders and Emil Harders; and the sum of
<br />$1.00 was bequeathed unto Paul Jessen; the income from all real estate and personal property
<br />was devised unto said Margaretha Harders for and during the term of her natural life with the
<br />right to use so much of the corpus of the personal property as is necessary for her care in such
<br />manner as she may desire; the rest, residue and remainder of said estate was devised and bequeathed
<br />unto John Harders, Julius Harders, Emil Harders, Edith Eich, Ella Thomsen, Frieda Haraes, Otto
<br />Harders, Ernest Harders, Carl Harders and Hugo Harders, share and share alike.
<br />SIXTH
<br />The Court further finds that on the 16th day of Aril, 1943, said Margaretha Harders, widow,
<br />of said testator, filed herein her duly verified petition for a widow's allowance, in the sum of
<br />$30.00 per month, and on the 16th day of April, 1943, an order of this Court was entered granting
<br />unto said Margaretha Harders, a widow's allowance in the sum of $30.00 per month commencing March
<br />2, 1943, for the term of the administration of this estate, not exceeding twelve months.
<br />SEVENTH.
<br />That on the 21st day of April, 1943, said Ella Thomsen and Thomas Thomsen filed in this Court,
<br />a receipt and waiver d-ly executed by them consenting to the terms and conditions of said Last
<br />Will and Testament of Martin Harders, deceased, and. acknowledgidg receipt of the legacy of the
<br />promissory note of Thomas Thomsen by Ella. Thomsen under paragraph 5 of said Last Will and Testa-
<br />ment, from said Herbert F.Mayer, Executor.
<br />EIGHTH
<br />The Court further finds that the time has expired for filing claims against said estate
<br />and that if any claims exist which are not paid, that the same are hereby forever barred and fore-
<br />closed from being asserted against this estate or the assets thereof and. the Court further finds
<br />that all claims against said estate, including; the, costs of administration hereof, have been fully
<br />paid by said Executor, that said legacies have been fully paid and that the final report of said
<br />Executor is correct in all respects and should be apr_.roved and allowed; that there remains nothing
<br />In his hands for further distribution herein and treat said estate is fully settled and that there
<br />is due and. payable to the County Treasurer of Hall County, Nebraska, no inheritance tax herein
<br />whatsoever.
<br />IT IS THEREFORE ORDERED, ADJUDGED Ai'1D DECREED BY THE COUr:T that the final report of Herbert
<br />F.Mayer, Executor, be and the sage is hereby approved and allowed as such; that the property
<br />described in paragraph Fifth here °of was devised and bequeathed according to the terms and con-
<br />ditions of said Last Will and Testament as set forth in paragraph Fifth hereof; that said estate
<br />has been fully settled the terms of said Will fully carried out and that said Herbert F.Mayer, be
<br />and he hereby is discharged as Executor herein, his bond released and said estate fully administered
<br />settled and closed.
