333 <br />E.Alden, sole legatee and devisee, all of the property of this estate as provided by said Will and <br />For these purposes, the 15th day of September, 1943, at 10 o'clock A.M. at the County Court <br />Room in said County, was assigned as the time and place for hearing said petition, examining and <br />allowing said account; and it wa.s ordered that notice of the pendency of said petition be given <br />to all persons interested in said estate by publishing said notice in the Grand Island Independent <br />a legal newspaper printed in said County, for three weeks prior to said. day of hearing; and it <br />appears by proof on file that said notice was given as ordered by Court and that no objections <br />to said final account have been made or filed. <br />Upon examination of the record and the evidence in this matter, and being duly advised in the <br />premises, the Court finds as follows: <br />FIRST <br />That Martin Harders departed this life on March 2, 1943,-at his residence in Hall County, <br />Nebraska, testate, and at the time of his death he was a resident of Hall County, Nebraska. <br />SECOND <br />That on the 8th day of March, 1943, Margaretha Harders, his widow, Carl Harders, his son, <br />and Herbert F.Mayer, filed in this Court an instrument purporting to be the Last Will and Testament <br />of said Martin Harders, deceased, wherein said petitioner Herbert F.Mayer was named Executor, <br />and they filed a petition offering said. Will-for probate, alleging that said Martin harders de- <br />parted this life on March 2, 1943, in Hall County, Nebraska, and on the 8th day of March, 1943, <br />an order of this Court was made therein assigning the 31st day of March, 1943, at 10 o'clock A.M, <br />in the County Court Room in said County, as the time and place for hearing said petition, proving <br />said Will and admitting the same to probate and ordering that notice of the pendency of said <br />petition and hearing thereof be given to all persons interested in said matter by publishing said <br />notice in the Grand Island Independent, a legal newspaper printed in said County, for three suc- <br />cessive weeks prior to said day of hearing, and it ap?Dears by proof on file that notice of said <br />order was so given. <br />THIRD. <br />The Court further finds that on the 27th day of March, 1943, said hearing on said petition <br />for probate was continued from March 31, 1943, until such time as the same was called up for <br />hearing by Herbert F.Mayer and Harold A.Prince, but in no event longer than thirty days from <br />March 27, 1943; the Court further finds that on the 14th day of April, 1943, said cause was <br />called up for hearing by said Herbert F.Mayer and Harold A.Prince and said instrument was proven, <br />allowed and admitted to probate as the Last Will and Testament of said Martin Harders, deceased, <br />which Last Will and Testament is in words as follows: <br />that the final report of said Executrix is correct in all respects and should be approved and <br />allowed and that there remains nothing in her hands for further distribution herein, said estate <br />being fully settled. <br />IT IS THEREFORE ORDERED ADJUDGED AND DECREED BY THE COURT that the final report of Maud T. <br />Alden, Executrix, be and the some is hereby approved and allowed as such; that the property <br />described in paragraph Fifth hereof was devised and bequeathed according to the tems and con- <br />ditions of said Last Will and Testament and Codicil thereto, as set forth in paragraph Fifth <br />hereof;
