333 E.Alden, sole legatee and devisee, all of the property of this estate as provided by said Will and For these purposes, the 15th day of September, 1943, at 10 o'clock A.M. at the County Court Room in said County, was assigned as the time and place for hearing said petition, examining and allowing said account; and it wa.s ordered that notice of the pendency of said petition be given to all persons interested in said estate by publishing said notice in the Grand Island Independent a legal newspaper printed in said County, for three weeks prior to said. day of hearing; and it appears by proof on file that said notice was given as ordered by Court and that no objections to said final account have been made or filed. Upon examination of the record and the evidence in this matter, and being duly advised in the premises, the Court finds as follows: FIRST That Martin Harders departed this life on March 2, 1943,-at his residence in Hall County, Nebraska, testate, and at the time of his death he was a resident of Hall County, Nebraska. SECOND That on the 8th day of March, 1943, Margaretha Harders, his widow, Carl Harders, his son, and Herbert F.Mayer, filed in this Court an instrument purporting to be the Last Will and Testament of said Martin Harders, deceased, wherein said petitioner Herbert F.Mayer was named Executor, and they filed a petition offering said. Will-for probate, alleging that said Martin harders de- parted this life on March 2, 1943, in Hall County, Nebraska, and on the 8th day of March, 1943, an order of this Court was made therein assigning the 31st day of March, 1943, at 10 o'clock A.M, in the County Court Room in said County, as the time and place for hearing said petition, proving said Will and admitting the same to probate and ordering that notice of the pendency of said petition and hearing thereof be given to all persons interested in said matter by publishing said notice in the Grand Island Independent, a legal newspaper printed in said County, for three suc- cessive weeks prior to said day of hearing, and it ap?Dears by proof on file that notice of said order was so given. THIRD. The Court further finds that on the 27th day of March, 1943, said hearing on said petition for probate was continued from March 31, 1943, until such time as the same was called up for hearing by Herbert F.Mayer and Harold A.Prince, but in no event longer than thirty days from March 27, 1943; the Court further finds that on the 14th day of April, 1943, said cause was called up for hearing by said Herbert F.Mayer and Harold A.Prince and said instrument was proven, allowed and admitted to probate as the Last Will and Testament of said Martin Harders, deceased, which Last Will and Testament is in words as follows: that the final report of said Executrix is correct in all respects and should be approved and allowed and that there remains nothing in her hands for further distribution herein, said estate being fully settled. IT IS THEREFORE ORDERED ADJUDGED AND DECREED BY THE COURT that the final report of Maud T. Alden, Executrix, be and the some is hereby approved and allowed as such; that the property described in paragraph Fifth hereof was devised and bequeathed according to the tems and con- ditions of said Last Will and Testament and Codicil thereto, as set forth in paragraph Fifth hereof; that said estate has been fully settled, the terms of said will and Codicil fully carried out and that said Maud E.Alden be and she hereby is discharged as Executrix herein, her bond released and said estate fully administered, settled and closed.
