<br />HENRY KNUTH, DECEASED. )
<br />Now on this lst day of September, 1943, this cause came on for hearing upon the Final Report
<br />of Martha Knuth, Executrix of the Estate of Henry Knuth, deceased, and upon her petition for the
<br />allowance and approval of said report, settlement of said estate, and her discharge herein, and
<br />the Court having examined the records and files herein, and being fully advised in the premises,
<br />finds that due and legal notice has been given to all persons of the time and place fixed by the
<br />Court for the hearing upon said report, and finds that said report is true and correct in all
<br />things and that the same ought to be approved and allowed as and for the Final Report of the said
<br />Executrix, said estate settled and closed and said Executrix discharged.
<br />The Court further finds that the said Henry Knuth departed this life on the 31st day of January,
<br />1940, and that at the time of his death he was a resident and inhabitant of Hall County, Nebraska;
<br />that he left surviving as his heirs at law and only heirs at law, his wife, Martha Knuth, and five
<br />children, Rudolph Knuth, Emil Knuth, Marie Criser, Emma Schwieger and Ella Knuth Wegner; that
<br />he left a Last Will and Testament, which was upon the consideration of this Court duly proven,
<br />allowed and admitted to probate on the 11th day of April, 19+0, and letters Testamentary were
<br />duly issued by this Court to the said Martha Knuth.
<br />The Court further finds that due and legal notice has been given to all persons of the time
<br />and place fixed by the Court for filing against the estate of said deceased and that the time so
<br />fixed has fully expired and that all persons having claims against said estate and not filed
<br />within the time limited by the Court are forever barred and excluded from setting up or asserting
<br />any such claims against said estate.
<br />The Court further finds that said Executrix has paid the funeral expenses of said deceased,
<br />all debts against said estate, and the costs of these proceedings and has made distribution of
<br />the residue of the personal property of said estate as under the Will of the deceased provided,
<br />and nothing further remains in her hands as Executrix belonging to said Estate.
<br />The Court further finds that the deceased was possessed at the time of his death as the owner
<br />by fee simple title of the following described real estate,to -wit:
<br />The Southwest Quarter (SW4) and the West Half of the Northeast Quarter of the Northeast Quarter
<br />(W�1NE4NE4), of Section Three (3), Township Ten (10),North,Range Nine (9),West of the 6th P.M.
<br />Hall County, Nebraska, containing 180 acres;
<br />The Southeast Quarter (SE4) of Section Nineteen (19), Township Thirteen (13), North, Range
<br />Nine ( 9) , Wes t of the 6th P.M., Howard County, Nebraska, containing 160 acres.
<br />The Court further finds that under the terms and provisions of the Last Will and Testament of
<br />the said Henry Knuth deceased, the real estate described as the Southwest Quarter (SW4) of section
<br />Three (3), Township �en (10),Range Nine (9),West of the 6th P.M., Hall County, Nebraska, and the
<br />Southeast Quarter (SE4) of Section Nineteen (19),Township Thirteen (13), Range Nine (9),West of
<br />the 6th P.M., Howard County, Nebraska, passed and descended to Martha Knuth, the widow, for and
<br />during her lifetime and subject to her life interest therein to Rudolph Knuth and Emil Knuth,
<br />share and share alike, absolutely and in fee, subject to the payment of 01000.00 to Marie Criser,
<br />to Emma Schwieger and Ella Knuth Wegner within one year after the termination of the life interest,
<br />which constitutes a lien against said real estate.
<br />The Court further finds that the real estate described as the West Half of the Northeast
<br />Quarter of the Northeast Quarter (W *_:NE4 NE4), Section Three (3), Township Ten (10), Range Mine
<br />(9) Hall County, Nebraska, containing 20 acres, passed and descended under the residuary clause
<br />to Martha Knuth, to have and to hold the same forever.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the Final Report of the said
<br />Martha Knuth, Executrix of the Estate of Henry Knuth, be, and the same hereby is in all things
<br />approved and allowed as and for the Final Report of said Executrix and said estate is hereby
<br />settled and closed and said Executrix discharged.
<br />IT IS FURHTER ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims
<br />against the estate, if any such there be, are forever barred, enjoined and excluded from setting
<br />up or asserting any such claim against said estate.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all personal property, claims
<br />and judgments in the possession of the Executrix after payment of all taxes, claims and administra-
<br />tive expense is assigned and set over to the said Martha Knuth, to have and to hold the same for-
<br />ever.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT
<br />West Half of the Northeast Quarter of the Northeast Quarter
<br />Township Ten (10), North, Range Nine (9),West of the 6th P.]
<br />20 acres, passed and descended to Martha Knuth, to have and
<br />the remaining real estate hereinabove described, passed and
<br />provisions of the Last Will and Testament of the said Henry
<br />that the real estate described as the

<br />to hold the same forever, and that
<br />descended pursuant to the terms and
<br />Knuth.
