<br />ITEM FIVE,- 'Subject to the life estate devised to my sister Emma Templeton Kuhlsen,I give devise
<br />and bequeath all ray real estate to my brother,Emil Kuhlsen,shoul d he survive me and should my
<br />brother Emil Kuhlsen,die before me,then I give,devise and bequeath all my said real estate to my
<br />sister,Emma Templeton Kuhlsen,in fee simple to be her property absolutely.And should my sister,
<br />Emma Templeton Kuhlsen die before me,then I give,devise and bequeath all of my real and personal
<br />property to my brother,Emil Kuhlsen.
<br />ITEK SIX, - I direct that my sister,Emma Templeton Kuhlsen,be appointed executrix of this my last
<br />will and testament and direct that she be not required to give surety or bond as such executrix.
<br />Skould my said sister die before me,I direct that my brother,Emil Kuhlsen,be appointed executor
<br />of this will and direct that he be not required to give bond or surety as such executor.
<br />Item Seven, - I hereby revoke all former wills by me made.

<br />Now,on this 25th day of August,1943, this cause came on for hearing upon the final report of
<br />Emma Templeton Kuhlsen executrix of the estate of Clara Kuhlsen,deceased,and upon her petition
<br />for the allowance and approval of said report,the settlement of said estate,and her discharge
<br />herein,and the Court,having examined the records and files herein,and being fully advised in the
<br />premises,finds that due and legal notice has been given to all persons of the time and place fixed
<br />by the Court for the hearing upon said final report,and no one appearing to object to said report,
<br />and the Court,having examined the same,together with the vouchers on file,finds that said report
<br />is true and correct in all things and that the same ought to be allowed and approved as and for
<br />the final report of said executrix,said estate settled and closed and said executrix discharged.
<br />The Court further finds that the said Clara Kuhlsen departed this life on the 19th day of January,
<br />1943,and at the time of her death she was a resident and inhabitant of Hall County,Neb raska,and
<br />the Court further finds that on the 26th day of January,1943,a petition was filed herein for the
<br />probate of an instrument purporting to be the last will and testament of Clara Kuhlsen,deceased;
<br />that the Court thereupon fixed the 24th day of February,1943,as the date for making proof of said
<br />last will and testament,and due notice of filing said petition and of the time and place fixed
<br />for the hearing thereon was given by the Court in the manner provided by law;that on the 24th day
<br />of February,1943, said instrument was duly proven,allowed and admitted to probate in this Court
<br />as and for the last will and testament of said Clara Kuhlsen,deceased,and said Emma Templeton
<br />Kuhlsen executrix as named in said last will and testament,was appointed by the Court executrix
<br />of said estate,and duly qualified as such.
<br />The Court further finds that due and legal notice has been given to all persons of the time and
<br />place fixed by the Court for filing claims, and that all claims filed have been paid, and that the
<br />time fixed for filing claims has fully expired.
<br />IT IS,THEREFORE,ORDERED BY THE COURT that all persons having claims against said estate,if any
<br />such there be,and not filed herein,are forever barred and excluded from setting up or asserting
<br />any such claims "against said estate.
<br />The Court further finds that the special legacy to Emil Kuhlsen,in the amount of $500.00,has been
<br />paid,as provided for in the last will and testament,and his receipt is filed herein.
