IN THE MATTER OF THE ESTATE ) OF ) DECREE HENRY STANGE, DECEASED Now on this 25th day of August,1943,this matter came on to be heard upon the pleadings and the evidence and was submitted to the Court,on consideration whereof the Court finds that due and legal notice of this proceedings has been given to all persons interested in said estate both creditors and heirs as required by law.That all of the statements and allegations set forth in said petition are true;that the said Henry Stange died intestate in Hall County,Nebraska,on Feb- ruary 15,1941,seized and possessed at the time of his death of the following described real es- tate, to -wit : The Westerly Eighty -Three (W-83) Feet of the Easterly Half (E.I) of Block (Or Half Block) No. Sixteen (16),of Windolph's Addition to Grand Island,Nebraska,being a rectangular piece of ground having a Northerly Frontage of 83 Feet on Anna Street,and a depth of 140 Feet,off of the West- erly side of the Easterly Half of said Block. That no application has been made in the State of Nebraska for the appointment of an administ- rator of the estate of said deceased.That he was survived at the time of his death by his widow, Emma Stange,and eight children namely,Arthur Stange,Thekia Schultz,11a.r aret Kickbusch,Emma Thee - envitz,Ella Scharnow,Otto Stange,Frieda Osborne and Antone Kuhsmann;and the Court hereby finds and determines that the said widow and eight children are the sole and only heirs at law of the said Henry Stange,deceased;that said real estate is the homestead of the widow,Emma Stange, and that subject to her homestead interest said real estate descended to Emma Stange an"undivided one- third and to each of the aforesaid children an undivided one - twelfth to each. IT IS,THEREFORE,CONSIDERED AND ADJUDGED BY THE COURT that the real estate above described be and the same hereby is assigned to the said Emma Stange an undivided one- third,ard to Arthur Stange, Thekla Schultz, Margaret Kickbusch,Emma Thesenvitz,Ella Scharnow,Otto Stange,Frieda Osborne, and Antone Kuhsmann each an undivided one- ttelf:th subject to the homestead rights of the widow, Emma Stange.It is further considered and adjudged by ]ay the Court that all claims and demands against the estate of the deceased,whether due or to become due,whether absolute or contingent, be and the same hereby are forever barred. I,Clara Kuhlsen,residing at 307 East Third Street,Grand Island,in Hall County,Nebraska,do make, publish and declare this my last will and testament,in manner and form following,that is to say: ITEM ONE, -I direct that the expense of my last illness,my funeral charges and all of my just debts shall be paid as soon after my death as practical,from my personal estate and if that be insufficient,from the income of my real estate. ITEM TWO, -I give devise and bequeath the rest and residue of my personal eetate,after paying the -expenses of my last illness,funeral and death,to my only sister Emma Templeton Kuhleen,now re- siding with me. ITEM THREE, - I give devise and bequeath all of my real estate now owned or hereafter acquired the premises where I now reside at 307 East Third Street, by me and wherever situated,including feet Lot Four 4) and the West in Grand Island,Nebraska,being the East Twenty -two (E.22) of (69) the Original town, Twenty -two feet (W.22) feet of Lot Three (3),all iii Block Sixty -nine of now City of Grand Island in Hall County,Nebraska,to my sister,Emma Templeton Kuhlsen for and during her natural lifetime and_,sbp shall be permitted to collect the rents,issues and profits from my real estate during 7per,ldfetime and she shall be required to pay the taxes,insurance and reasonable repairs on my real estate after my death and during her lifetime,providing my brother,Emil Kuhlsen may have a room in my home at 307 East Third Street during his lifetime. ITEN FOUR, -- Item Two above is subject to this proviso;- if my net personal property after pay- ing expenses exceeds One Thousand Dollars,I direct my executrix to pay my brother Emil Kuhlsen the sum of $500.00 and if the net personal estate is less than One Thousand Dollars and exceeds $500.00.1 direct my executrix to pay my brother Emil Kuhlsen the sum of $250.00(These payments to my brother,Emil Kuhleen,shall not be subject to the claims of his creditors,if any,and shall not be assignable by him and shall hot be subject to be taken by his creditors,if any by garn- ishment or other legal process and shall be paid by my executrix only to Emil Kuhlsen on his own receipt,if my personal estate permits.
