<br />William H.11arsh, a brother, Winnifred Kender'di.ne, a sister, Elsie E. Smith, a sister, and the following
<br />who are the children of a deceased sister Ada B.Elwick:
<br />Albert Stager,a nephew,hlyrtle Cox,a niece,Charles Stager,a nephew,Fred Stager,a nephew,Stanley
<br />Stager,a nephew,Della Scott,a niece, Delia Shaf er,a niece and Joe Stager,a nephew,and the follow-
<br />ing children of a deceased brother Richard L.1larsh;
<br />Emmett Marsh,a nephew,Howard Marsh,a nephew,Ethel True,a niece,Elva Webner,a niece,Doris Jones,a
<br />niece, and Wayne Marsh,a nephew,
<br />and the following children of a deceased brother Samuel B.Marsh;
<br />Gertrude Faye Mareh,a niece and Robert Marsh,a nephew
<br />FOURTH
<br />The Court further finds that on the 10th day of November21942,an order of this Court was made
<br />allowing creditors three months from and after the 9th day of December,1942,in which to file their
<br />claims against said estate and said Executrices oneyear in which to settle said estate,and further
<br />ordering that notice to creditors be published in the Grand Island Independent,a legal newspaper
<br />published and circulating in Hall County,Nebraska,f or three successive weeks prior to the 9th day
<br />of December,1942,and that a hearing on claims filed against said estate would be held at the office
<br />of the County Judge of Hall County,Nebraska,on the 11th day of March,1943,at 9 o'clock A.M.,and
<br />it appears by proof on file that notice of said order was published as ordered by this Court.
<br />FIFTH
<br />The Court further finds that on the 23rd day of February,1943,said William H.Marsh and Elsie E.
<br />Smith,Executrices of said estate,filed in this Court their inventory of the property of said
<br />estate,and that according to said inventory,the deceased died seized and possessed of the following
<br />described property,to -wit:
<br />The South Fifty feet (S50 ft) of Lot One (1) and the South Fifty feet of the East Forty Feet (S f.,t 40ft)
<br />of Lot Two (2) in Block Six (6) of the Village of Doniphan in Hall County,Nebraska,said two tracts
<br />forming together a rectangular piece of ground having an east frontage of fifty feet on First
<br />Street and depth of One Hundred Fifteen feet,and bounded on the south by the alley in said Block.
<br />The Westerly Forty -eight Feet (W 48 ft.) of Lot Six (6) in Block Eleven (11) of the Village of
<br />Doniphan in Hall County,Nebraska,and
<br />Personal property of the value of
<br />$231.07
<br />The Court further finds that according to the terms,eonditions and provisions of said Last Will and
<br />Testament of said deceased,said property was devised and bequeathed unto Gertrude Faye Marsh in
<br />fee simple absolute,said Gertrude Faye Marsh having survived said testatrix for more than six
<br />months after the death of said testatrix,she being alive on the date of the entry of this Decree
<br />and being over the age of 21 years.
<br />SIXTH
<br />The Court further finds that on the 11th day of Ylarch,1943, an order of this Court vials made allowing
<br />the claim of Cora Mattheson in the sum of $469.15 and the claim of Geddes Funeral Home in the sum
<br />of $365.00 against this estate and barring the filing of any and all other claims against said
<br />estate and excluding the holders thereof from setting up or asserting any such claims against said
<br />estate.
<br />SEVENTH
<br />The Court further finds that all claims against said estate,including the costs of administration
<br />hereof,have been fully paid by said Executrices and that the final report is correct in all respects
<br />and should be approved and allowed;that there remains in their hands the sum of $151.54 which sum,
<br />according to the terms and provisions of said Last Will and Testament,is payable unto said Gertrude
<br />Faye Marsh and that there is due and payable to the County Treasurer of Hall County,Nebraska,no
<br />inheritance tax herein whatsoever.
<br />IT IS THEREFORE ORDERED,ADJUDGED AND DECREED BY THE COURT that the final report of William H.
<br />Marsh and Elsie E.Smith,Executrices,be and the same is hereby approved. and allowed as such;that
<br />Sarah J.Bowden,also known ad Jannie Bowden and Janie Bowden,are one and the same persons irrespect-
<br />ive of the discrepancy in their names as appears of record with respect to the real estate here -
<br />in before described;that Gertrude Faye Marsh is over the age of 21 years and has survived said
<br />testatrix more than six months after the death of said testatrix and accordingly is the sole
<br />legatee and devisee under the Will of said decedent;that the property described in paragraph Fifth
<br />hereof,was devised and bequeathed according to the terms and conditions of said Last Will and
<br />Testament unto said Gertrude Faye Marsh; that there remains in the hands of said Executrices the
<br />sum of $151.54 which is undistributed by them and upon the payment thereof to said Gertrude Faye
<br />Marsh and filing her receipt therefor in this Court,that they be discharged, their bond released
<br />and said estate fully administered,settled and closed.
