317 <br />premises,the Court finds as follows: <br />FIRST <br />That Sarah J.Bowden,also known as Jannie Bowden and Janie Bowden,departed this life on the 12th <br />day of October,1942,at her home in Doniphan,in Hall County,Nebraska,testate,and at the time of <br />her death she was a resident of Hall County,Nebraska. <br />4WINWE <br />7 <br />J <br />SECOND <br />In the event she survives me for the period of six months after my death,I give,devise,and bequeath <br />all the estate,both real and personal,owned by me at the time of my death,to my hiece,Gertrude <br />Faye Marsh,who has been with me and whom I have raised since she was a baby,and in the event I <br />should die before the said Gertrude Faye Marsh arrives at the age of twenty -one years,I appoint <br />my sister,Elsie E.Smith,as testamentary guardian,without bond,of the said Gertrude Faye Hafth. <br />THIRD <br />In the event my said niece, Gertrude Faye Marsh, does not survive for the period of six months after <br />my death,then and in that event I give,devise,and bequeath all of the estate,both real and personal, <br />of which I shall die the owner,to my sisters and brothers,Ada B.Elwick,William H.Marsh,Richard <br />L.Marsh,Winnifred Kenderdine, Samuel B.MArsh,and Elsie E.Smith, share and share alike, the child <br />or chil dyed of any of my said brothers or sisters,who may be deceased at />testament of the real and personal estate of said Sarah J.Bowden,deceased,and the same was order- <br />ed to be recorded in the records of the Court aforesaid. <br />In witness whereof I have and Testament of said Sarah J.Bowden,deceased,wherein <br />said petitioners were named Executrices,and a petition offering said Will for probate,alleging <br />that said Sarah J.Bowden,departed this life on October 12,1942,in Hall County,Nebraska,and on the <br />17th day of October,1942,an order of this Court was made therein assigning the 10th day of Novem- <br />ber,1942,at 10 o'clock A.M.in the County Court Room in said County as the time and place for <br />hearing said petition,proving said Will and admitting the same to probate and ordering that notice <br />of the pendency of said petition and hearing thereof be given to all persons interested in said <br />matter by publishing said notice in the Grand Island Independeht,a legal newspaper printed in said <br />County,for three successive weeks prior to said day of hearing,and it appears by proof on file <br />that notice of said order was so given. <br />THIRD <br />The Court further finds that on the 10th day of November,1942,said instrument was proven,allowed <br />and admitted to probate as the Last Will and Testament of said Sarah J.Bowden,deceased,which Last <br />Will and Testament is in words as follows: <br />I Sarah J.Bowden,widow,of �bniphan,Nebraska,being of sound mind and disposing memory,do make and <br />publish this,my last will and testament,in the manner and form following,that is
