<br />COUNTY OF HALL ) and State of Nebraska,this 25th day of August,1943.
<br />Present: Paul N.Kirk,County Judge.
<br />BE IT REI.&IBERED, that on the 31st day of July,1943,Herbert F.Ivlayer,Administrator de bonis non of
<br />the Estate of Gottfried Gisel,deceased,Piled in this Court his final account as such administrat-
<br />or and a petition praying that said account be allowed,for a decree of heirship,an order of dis-
<br />tribution,a final settlement thereon and discharge.
<br />For these purposes,the 25th day of August,1943,at 10 o'clock A.M.at the County Court Room in said
<br />County was assigned as the time and place for hearing said petition,examining and allowing said
<br />aceount;and it was ordered that notice of the pendency of said petition be given to all persons
<br />interested in said estate by publishing such notice in the Grand Island Independent,a legal news-
<br />paper printed in said County,for three weeks prior to said day of hearing;and it appears by proof
<br />on file that said notice was given as ordered by Court and that no objections to said final aac -,:
<br />ount have been made or filed.
<br />Upon examination of the record and the evidence in this matter and being duly advised in the prem-
<br />ises,the Court finds as follows:
<br />FIRST
<br />That Gottfried Gisel departed this life on the 27th day of August,1880,at his home in Hall County,
<br />Nebraska,intestate,and at the time of his death he was a resident of Hall County,Nebraska.
<br />SECOND
<br />That on the 24th day of June,1982,J.J.Gisel,his father,filed in this Court a petition praying for
<br />the appointment of said J.J.Gisel as Administrator of the estate of said deceased,and on the
<br />29th day of June,1882,an order of this Court was made therein,assigning the 17th day of July,
<br />1882,at 9 o'clock A.M.at the County Court Room in said County as the time and place for hearing
<br />said petition,and that notice of the pendency of said petition and hearing thereof was given to
<br />all persons interested in said matter by publishing said notice in the Grand Island Independent,
<br />a legal newspaper printed in said County for three consecutive weeks prior to said day of hearing,
<br />and it appears by proof on file that notice of said order was so given.
<br />THIRD
<br />The Court further finds that J.J.aisel named in said petition was,upon his giv ing bond in the
<br />sum of $500.00,as ordered by this Court,appointed Administrator as prayed;the Court further finds
<br />that the deceased at the time of his death,was unmarried and that he left the following heir-at-
<br />law and only heir- at- law,J.J.Gisel,his father.

<br />SEVENTH
<br />The Court further finds that on the 8th day of iviarch,1943,an order of this Court was made therein
<br />assigning the 31st day of March,1943,at 10 o'clock A.M.at the County Court Room in said County
<br />as the time and place for hearing said petition,and ordering that notice of the pendency of said
<br />petition and hearing t- .e -eof be given to all persons interested in said matter by publishing said
<br />notice in the Grand Island Independent,a legal newspaper printed in said County,for three succ-
<br />essive weeks prior to said day of hearing,and it appears by proof on file that notice of said
<br />order was given as ordered by this Court.
<br />EIGHTH
<br />The Court further finds that Herbert F.Mayer named in said petition,aas upon his giving bond in
<br />the sum of $100.00 as ordered by this Court,appointed Administrator de bonis non.
<br />NINTH
<br />The Court further finds that on the 31st day of Lllarch,1943,an order was made herein allowing
<br />The Court further finds that on the 15th day of November,1882,said J.J.Gisel,as Administrator,
<br />filed in this Court his inventory of the property of said estate,and that according to said in-
<br />v entory,the deceased died seized and possessed of the West Half of the Southwest quarter (W25Wi)
<br />of Section Four Win Township Eleven (11) North, Range Eleven (11),West of the 6th P.M. in Hall
<br />County,Nebraska.
<br />FIFTH
<br />The Court further finds that on the 9th day of Ilarch,1883,said J.J.Gieel,as Administrator,filed
<br />In this Court a final report,but that no publication was had on said final report,and on the 12th
<br />day of March,1983,this Court entered a Final Decree in said matter finding that Johann J.Gisel
<br />was the sole and only heir -at -law of said Gottfried Gis;.&-,deceased,and found that the real estate
<br />described in his said inventory did pass by operation of law,unto him.
<br />SIXTH
<br />The Court further finds that on the 6th day of March,1943,Alvin Gascho,then the owner of the real
<br />estate described in the inventory mentioned in paragraph Fourthhereof,filed in this Court his
<br />petition setting forth the above facts and further setting forth that no notice was given to
<br />cred ors n this estate as by law required and that said Final Decree was therefore inadvertent-
<br />se se w out administration having been completed,and petitioning the Court for the appoint-
<br />ment of an Administrator de bonis non,suggesting that Herbert F.Mayer be appointed such and that
<br />be had according to law and notice thereof given as by law required.
