<br />Now on this 20th day of August, 1943s this matter came on to be heard upon the pleadings and the
<br />evidence and was submitted to the Court, on consideration whereof the Court finds that due and
<br />legal notice of this proceeding has been given to all persons interested in said matter, both
<br />creditors and heirs, as required by law; that all of the statements and allegations set forth in
<br />said petition are true; that the said Julia M.Parker died intestate in Hall County, Nebraska, in
<br />the year 1906 seized and possessed at the time of her death of the following described real estate,
<br />to -owit: Lot 'three (3)in Block Forty -five (45) in Russel Wheeler's Addition in the City of Grand
<br />Island,Nebraska; that no application has been made in the State of Nebraska for the appointment
<br />of an Administrator of the estate of said deceased; that the husband of said Julia M.Parker, de-
<br />ceased, predeceased her; that she did not remarry and that her only heirs -at -law were and are her
<br />.children and'andchildren, namely: George L. Coon, Mary E. Henke, Samuel H. Coon, Walter B. Coon,
<br />Otis B. Coon, =da Freel, Christina Victoria Clore, Elza Coon, David Coon, Millie G. Sanders, Lillie
<br />Mack and Dorothy Hanneman; and the Court hereby finds and determines that said children and grand-
<br />children are the heirs7-.at -law and only heirs -at -law of the said Julia M.Parker, deceased, and that
<br />said real estate descended unto said children and grandchildren in fee simple absolute.
<br />IT IS THEREFORE CONSIDERED AND ADJUDGED BY THE COURT that the real estate above described be
<br />and the same hereby is assigned unto said George L.Coon, Mary E.Henkle; Samuel H.Coon, Walter B.
<br />Coon, Otis B. Coon, Ida Freel, Christina Victoria Clore, Elza Coon, David Coon, Millie G. Sanders,
<br />Lillie Mack and Dorothy Hanneman.
<br />IT IS FURTHER CONSIDERED AND ADJUDGED BY THE COURT that all claims and demands against the
<br />estate of the deceased, whether due or to become due, whether absolute or contingent, be and the
<br />same hereby are forever barred.

<br />I, Daniel J.Hoye, being of sound mind and memory, do make and publish this my last Will and
<br />Testament in the manner and form following:
<br />FIRST: I direct my executor hereinafter named to pay all my just debts, expenses of last sick -
<br />ness, funeral expenses and expenses of administering my estate out of my personal property.
<br />SECOND: I give, devise and bequeath unto my beloved wife, Elizabeth T.Hoye, all of my estate,
<br />both real estate and personal property of every kind and character, wheresoever the same may be
<br />situated, to have and to hold the same absolutely.
<br />THIRD: I hereby appoint Elizabeth T.Hoye, Executor of this my last Will and Testament, hereby
<br />revoking all former wills by me made.
