<br />That Charles K.Hart is and has been the administrator with will annexed of the estate of the
<br />deceased since the 5th day of May, 1941.
<br />That the court, by order herein, fixed and limited the time within which claims might be filed
<br />against the estate of the deceased; that notice thereof was given as required by law and by the
<br />order of this-court; that the time fixed has expired; that the claims filed have been paid; that
<br />any claims not filed have become and should be by order of this court, forever barred.
<br />That the deceased was, at the time of this death, a widower,and he left surviving him as his
<br />heirs at law and next of kin and the only persons interested in his estate, children and grand-
<br />children as follows:

<br />That the six persons last named are the children of Martha A.Lockwood, daughter of the deceased,
<br />named in his will as Martha A.Kroll; that she married Cortney W.Lockwood and thereafter died on
<br />March 30, 1940, before the death of her father; that the deceased left surviving his no other son
<br />or daughter and no other child or children of any deceased child; that the children and grand-
<br />children of the deceased are of legal age, except the three grandchildren last named, and they are
<br />the only beneficiaries of the will of the deceased.
<br />That the will of the deceased was by due proceedings had herein, examined, approved and admitted
<br />to probate on the 5th day of May, 1941, and the following is a copy thereof, together with the
<br />Certificate of- Probate thereto attached;
<br />"I, Peter Klooll, of the village of Prosser, ,llaama County, Nebraska, do hereby make, publish
<br />and declare this my last will and testament as follows:
<br />1. I give, devise and bequeath unto my wife, Elisabeth Kroll, all of the real estate, wherever
<br />situated, which I may own at the time of my death, including the north west quarter of section
<br />thirty three, town nine, range eleven, in Hall county, Nebraska, and lots five and six in block one,
<br />and lots one, two, three and four in block two, all in South Prosser, Adams County, Nebraska, and
<br />the tract of land one hundred feet wide, east and west, and three hundred and seventy feet long,
<br />north and south, in the southeast quarter of section five, town eight, range eleven, in said Adams
<br />County; all for and during her natural life.
<br />2. Upon the death of my wife I give, devise and bequeath the said north west quarter of section
<br />thirty three, town nine, range eleven, in Hall county,- Nebraska, unto my son, August Kroll, subject
<br />to the payment of the legacies of twelve hundred dollars each to my three daughters, as hereinafter
<br />provided.
<br />2. Upon the death of my wife I give, devise and bequeath the said lots five and six in block
<br />one, and lots one, two, three and four in block two in South Prosser, and the said tract of land
<br />one hundred feet wide'east and west and three hundred and seventy feet tong north and south, in the
<br />southeast quarter of section five, town eight, range eleven (being the tract deeded to me by William
<br />Weaver and wife), unto my four children, August M.Kroil, Anastasia M.Monthey, Maria E.Kroll and
<br />Martha A.Kroll, to be divided equally between them and the lawful issue of any of said children
<br />who may be deceased, by right of representation; and any other real estate which I may own at my
<br />death shall, upon the death of my wife, be divided in the same manner, to -wit: equally between
<br />my said children and the lawful issue of any deceased child, by right of representation.
<br />3. I give, devise and bequeath unto my wife, Elisabeth Kroll, all of my personal property of
<br />every kind.
<br />4. I give, devise and bequeath unto each of my three daughters, Anastasia M. Monthey, Maria
<br />E.Nroll and Martha A.Kroll and the lawful issue of any of them, by right of representation, the sum
<br />of twelve hundred dollars, the same to be paid by my said son August Kroll; and I hereby make the
<br />payment of these bequests a charge upon said north west quarter of section thirty three, town
<br />nine, range eleven, in Hall county, Nebraska.
<br />4. In case of the death of my wife before my death, then it is my will that all of my personal
<br />property, of every kind, shall be divided equally between my said four children, and the lawful
<br />issue of any deceased Child, by right of representation.
<br />5. I hereby constitute and appoint my said wife, Elisabeth Kroll, executrix of this my last
<br />will and testament,and request that no other bond be required of her as such executrix except her
<br />own personal obligation.
<br />Dated at Prosser, Nebraska, this 24th day of March, 1911.
