<br />An undivided half interest in Northeast quarter (NE14� of Section Thirty -one (31),,Township Sixteen
<br />(16),North,Range Eighteen (18),West of the 6th P.M.I., except one and 63 /100ths.of an acre in
<br />Southwest quarter of the Northeast quarter (S714NE),which has been deeded to Railroad Company),in
<br />Custer County,Nebraska,to have and to hold the same absolutely and forever,as provided by the
<br />last will and testament.
<br />To the four sons,Earl V. Foster, Charlie H.Foster,Wayne S.Foster,and Carl W.Foster,share and share
<br />alike, Lots Ten (10) and Eleven (11),in Section Eleven (11J,consisting of ap roximatel_y Eighty -
<br />five (85) ac,re.s;and Lots One (1),Two (2) and Four (4),in Section Fourteen (N),consieting of
<br />approximately One Hundred Fifteen (115) acres all of which is located on an island in the Platte
<br />River,in Township Ten (10) North,Range Nine (9),West of the 6th P.1111.,all in Hall County,TYebraska,
<br />together with all of the appurtenances thereunto belonging,the same being known as "The Ranch."
<br />subject to the life estate of 'ancy B.Foster,also known as Nan Foster.
<br />That due and legal notice has been given to all persons of the time and place fixed by the Court
<br />for a hearing on said final report by publication of said notice for three successive weeks in
<br />the Grand Island Daily Independent,as by law required,and no one appearing to object to said
<br />report,and the Court raving examined the same,together with the you deers attached thereto finds
<br />that said report is true and correct in all things and should be approved and allowed as and for
<br />said Executrix's final renort,said estate settled and closed and said Executrix discharged,
<br />The Court further finds that all of the claims and expenses against said estate have been paid
<br />by said Executrix and that the balance of the personal property,as shown by the final report,
<br />should be turned over to said fancy B.Foster,widow.
<br />That said estate is not subject to the payment of any inheritance tax under the laws of the State
<br />of Nebraska,or the United States.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED BY THE COURT that all persons having claims against
<br />said estate not filed and allowed within the time fixed by the 0ourt,if any such there be,are
<br />forever barred,excluded and enjoined from setting up or asserting any such claims against said
<br />estate;
<br />IT IS FURTHER ORDERED that the final report filed herein by Nancy B.Foster,Executrix,be and the
<br />same is hereby in all things approved and allowed as for said Executrix's final report,said
<br />estate settled and closed and said Executrix and her official bondsmen discharged from any further
<br />liabilit* said estate.
<br />IT IS FURTHER ORDERED that the balance of the personal property now on hand be and the same is
<br />hereby awarded to the said fancy B.Foster,widow of said deceased.
<br />IT IS FURTHER ORDERED that the real estate owned by the deceased at the time of his death,and
<br />hereinbefore described, did pass and descend under and by virtue of the last will and testament,
<br />as hereinbefore found by the Court,and distribution thereof is accordingly made.

<br />Now on this 4th. day of August, 1943, this matter came on for hearing on the petition of Raymond
<br />Dahlke,for the determination of heirship of the estate of John H.Dahlke,deceased,and was submitted
<br />to the Court,Raymond Dahlke appeared in person and by S.J.Shada,his attorney,.
<br />It appearing from the record and files in said matter that notice of the time and place fixed for
<br />the hearing on said petition has been given by publication thereof as by order of said court here-
<br />to fore made and entered,whereupon Raymond Dahlke was sworn and testified.On consideration of the
<br />evidence the Court finds that said John H.Dahlke,departed this life intestate on the lst.day of
<br />Oct6ber,1939;that said John H.Dahlke was at the date of his death a resident and inhabitant of
<br />the said county of Hall and State of Nebraska, and died seized of an estate of inheritance in the
<br />following described real estate.to wit: Lot Six (6),in Block Sixteen (16),Packer & Barr's
<br />Addition to the City of Grand Island,Hall County,Nebraska; That more than two years have elapsed
<br />since the death of the said John H.Dahlke,and no application for the appointment of an administrator
