After an examination thereof, the court finds <br />that said report is correct in all respects and ought to be allowed and approved and that the <br />administratrix has accounted for all of the estate of said deceased that came to her possession. <br />IT IS THEREFORE CONSIDERED AND ADJUDGED by the court that the report of Mary C.Lyhane, admin- <br />istratrix,be and the same hereby is approved and allowed for her final report. <br />The court further finds that notice was given to all creditors of the said Mary E.Finan, de- <br />for filing claims against said estate, that <br />ceased, of the time limited and the place appointed <br />the time for filing claims has fully expired, that all claims filed and allowed against said estate <br />have been fully paid and satisfied, that all claims outstanding against said estate, if any such <br />there be, are forever barred and precluded. <br />IT IS, THEREFORE, CONSIDERED AND ADJUDGED by the court that all persons are forever barred from <br />filing or setting up any claims or demands against the estate of Mary E.Finan, deceased. <br />The court further finds that the said Mary E.Finan departed this life intestate on the 27th <br />day of December, 1940, and that she was at the time of her death a resident of Hall County, <br />Nebraska, that she left no children surviving her, that her heirs at law and only heirs at law <br />were the following named persons, to -wit: <br />James Finan, surviving husband, residing at Wood River, Nebraska, and <br />Mary C.Lyhane, mother of the deceased, residing at Wood River, Nebraska. <br />The court further finds that the said Mary E Finan, at the time of her death, was the owner <br />i <br />of the following described real estate situate n Hall County, Nebraska, to -wit: <br />Lots Nine (9) and Ten (10) in Block Two (2) in Dodd & Marshall's Addition to the village of <br />Wood River, subject to the life estate of Mary C.Lyhane in said premises. <br />An undivided two- ninths interest in and to The South Half _(S-2) of the Northwest Quarter <br />(NWJ) of Section 25, Township 10, Range 12. <br />An undivided two-ninths interest in and to The Southwest Quarter (SWU of the southeast Quarter <br />(SEj) of Section 31, Township 10, Range 11, Hall County, Nebraska, <br />that under the law of descent of the State of Nebraska all of the right, title and interest of <br />the said Mary E.Finan in said real estate did pass and descend at her death to the said James <br />Finan and Mary C.Lyhane in equal shares as tenants in common, subject to the life estate of Mary <br />C.Lyhane in Lots Nine (9), and Ten (101 in Block Two (2) above described. <br />The court further finds that the said Mary E.Finah was the owner, at the time of her death, <br />of certain items of personal property and that under the laws of the State of Nebraska, the same <br />passed and descended to James Finan, her husband. <br />The court further finds that all claims, court costs, funeral expenses, expenses of last <br />illness and doctor bills have been paid and settled and that said estate is not subject to in- <br />heritance tax under the laws of the State of Nebraska or of the United States. <br />IT IS THEREFORE CONSIDERED, ADJUDGED AND DECREED by the court that the above described real <br />estate did pass and descend at the death of Mary E.Finan, intestate, to James Finan and-Mary C. <br />Lyhane, share and share alike, subject, however, to the life estate of Mary C.Lyhane in Lots <br />Nine (9) and Ten (10) above described and that the personal property described in the inventory <br />passed and descended to James Finan in absolute title. <br />IT IS FURTHER ORDERED by the court that said estate is closed and settled, that the bond here - <br />tofor given by Mary C.Lyhane as administratrix is hereby released and sureties discharged thereon. <br />Paul N.Kirk <br />COUNTY JUDGE. <br />
