MARY E.FINAN, Deceased. ) NOW on this 19th day of June, 1943, this cause came on to be heard upon the final report of Mary C.Lyhane, administratrix of the estate of Mary E.Finan, and it appearing to the court from the proof on file that all persons interested in said estate have been notified as required by law and the order of this court dated May 26, 1943, and there being no objection or protest to said report, the court proceeded to examine the same. After an examination thereof, the court finds that said report is correct in all respects and ought to be allowed and approved and that the administratrix has accounted for all of the estate of said deceased that came to her possession. IT IS THEREFORE CONSIDERED AND ADJUDGED by the court that the report of Mary C.Lyhane, admin- istratrix,be and the same hereby is approved and allowed for her final report. The court further finds that notice was given to all creditors of the said Mary E.Finan, de- for filing claims against said estate, that ceased, of the time limited and the place appointed the time for filing claims has fully expired, that all claims filed and allowed against said estate have been fully paid and satisfied, that all claims outstanding against said estate, if any such there be, are forever barred and precluded. IT IS, THEREFORE, CONSIDERED AND ADJUDGED by the court that all persons are forever barred from filing or setting up any claims or demands against the estate of Mary E.Finan, deceased. The court further finds that the said Mary E.Finan departed this life intestate on the 27th day of December, 1940, and that she was at the time of her death a resident of Hall County, Nebraska, that she left no children surviving her, that her heirs at law and only heirs at law were the following named persons, to -wit: James Finan, surviving husband, residing at Wood River, Nebraska, and Mary C.Lyhane, mother of the deceased, residing at Wood River, Nebraska. The court further finds that the said Mary E Finan, at the time of her death, was the owner i of the following described real estate situate n Hall County, Nebraska, to -wit: Lots Nine (9) and Ten (10) in Block Two (2) in Dodd & Marshall's Addition to the village of Wood River, subject to the life estate of Mary C.Lyhane in said premises. An undivided two- ninths interest in and to The South Half _(S-2) of the Northwest Quarter (NWJ) of Section 25, Township 10, Range 12. An undivided two-ninths interest in and to The Southwest Quarter (SWU of the southeast Quarter (SEj) of Section 31, Township 10, Range 11, Hall County, Nebraska, that under the law of descent of the State of Nebraska all of the right, title and interest of the said Mary E.Finan in said real estate did pass and descend at her death to the said James Finan and Mary C.Lyhane in equal shares as tenants in common, subject to the life estate of Mary C.Lyhane in Lots Nine (9), and Ten (101 in Block Two (2) above described. The court further finds that the said Mary E.Finah was the owner, at the time of her death, of certain items of personal property and that under the laws of the State of Nebraska, the same passed and descended to James Finan, her husband. The court further finds that all claims, court costs, funeral expenses, expenses of last illness and doctor bills have been paid and settled and that said estate is not subject to in- heritance tax under the laws of the State of Nebraska or of the United States. IT IS THEREFORE CONSIDERED, ADJUDGED AND DECREED by the court that the above described real estate did pass and descend at the death of Mary E.Finan, intestate, to James Finan and-Mary C. Lyhane, share and share alike, subject, however, to the life estate of Mary C.Lyhane in Lots Nine (9) and Ten (10) above described and that the personal property described in the inventory passed and descended to James Finan in absolute title. IT IS FURTHER ORDERED by the court that said estate is closed and settled, that the bond here - tofor given by Mary C.Lyhane as administratrix is hereby released and sureties discharged thereon.
