Kirk <br />(SEAL) County Judge <br />HALL COUNTY, NEBRASKA F I L E D FEB 3, 1943 PAUL N.KIRK COUNTY JUDGE. <br />i IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />In the matter of the estate ) <br />NO. 3274 <br />of ) FINAL DECREE. <br />) <br />JA14ES McLellan, Deceased. ) <br />Now, on this 21st day of July, 1943, this cause came on for hearing upon the final report of <br />Gertrude McLellan, Executrix of the last will and testament of James McLellan, deceased, and upon <br />her petition for settlement of said estate. <br />The Court, having examined said report and the records and files in said estate, and being duly <br />advised, finds that due and legal notice has been given to all persons interested in said estate of <br />the time and place fixed for hearing upon said final report, as heretofore ordered by the Court, <br />and no one appearing to object, the Court examined the same together with the vouchers on file <br />and testimony in support thereof, and being duly advised, finds said report true and correct in <br />all things and that said report be approved and allowed as and for the final report of said <br />executrix. <br />The Court finds that said James McLellan departed this life on the 21st day of December, 1942, <br />and at the time of his death was a resident and inhabitant of Hall County, kebraska, that a <br />petition was filed in the County Court of Hall County, Nebraska, praying for the allowance and <br />probate of an instrument purporting to be the last will and testament of James McLellan,deceased, <br />and the Court thereupon fixed the 3d day of February, 1943, as the date for making proof thereon, <br />due and legal notice thereof was given, and on the 3d day of February, 1943, said instrument was <br />duly proven, allowed, and admitted to probate in this Court as and for the last will and testa- <br />ment of James McLellan, deceased, and letters testamentary were duly issued thereon to Gertrude- <br />WILL AND DECREE . <br />I, James McLellan, of Hall County, Nebraska, being of sound mind and disposing memory, do make <br />and publish this, my last will and testament, in the manner and form following, that is to say: <br />FIRST. <br />I direct that my just debts, if any, the expenses attending my burial, and the costs of <br />administering my estate, be first paid. <br />SECOND. <br />I give, devise, and bequeath all the rest, residue, and remainder of the personal estate of <br />which I shall die the owner to my wife, Gertrude McLellan, to have and to hold the same forever. <br />THIRD. <br />I give, devise, and bequeath to my said wife, Gertrude McLellan, in the event she survives me, <br />the life use, rents, income, and profits, from all of the real estate of which I shall die the <br />owner. - <br />FOURTH. <br />I give and devise to my adopted daughter and son, Lois McLellan and Hurst McLellan, and to the <br />survivor of them, living at the time of my death, without right, power, or authority, in them, or <br />either of them, to in any manner sell, alienate, or incumber the same, within the period of ten <br />years after my death, all of the real estate of which I shall die the owner, subject only to the <br />life estate bequeathed to my said wife in the third paragraph hereof. <br />FIFTH. <br />I nominate and appoint my said wife, Gertrude "allan, as executrix of this will, and request <br />that she be not required to furnish surety upon her official bond as such. <br />IN TESTIMONY WHEREOF, I have hereunto set my hand this 29" day of April, 1930 <br />Witnesses; <br />Bernice E.Matthews James McLellan <br />Nor th <br />We, whose names are hereunto subscribed, do hereby certify that James McLellan, the testator,' <br />subscribed his name to the foregoing instrument in our presence and in the presence of each of us, <br />and, at the same time and in our presence and hearing, declared the same to be his last will and <br />testament, and we, at his request and in his presence, have hereunto subscribed our names as <br />attesting witnesses. <br />Bernice E.Ma.tthews <br />R.R.Horth <br />Of Grand Island,Nebraska. <br />ENDORSEMENT: LAST WILL AND TESTAMENT OF JAMES McLELLAN. <br />HALL COUNTY, NEBRASKA F I L E D JAN 6 1943 PAUL N.
