294 <br />THEAUGUSTINECO. 20112.2.41 <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />In the matter of the estate ) NO. 3243 <br />of ) <br />Eunice I.Wilson, Deceased ) FINAL DECREE <br />Now, on this 21 day of July, 1943, this cause came on for hearing upon the final report of <br />Delia Ward Athey, Executrix, the Court, having examined the report, the records and files in said <br />estate, and being duly advised in the premises, finds that due and legal notice has been given to <br />all persons interested in said estate of the time and place fixed for hearing upon said final <br />report, as ordered by the Court, and no one appearing to object to said final report, the Court <br />examined the same, together with the vouchers on file and testimony in support-thereof, and being <br />duly advised in the premises, finds that said report is true and correct in all things and ought <br />to be approved and allowed as and for the final report of said executrix. <br />The Court finds that said Eunice I.Wilson died on the 3d day of July, 1942, that at the time <br />of her death she was a resident and inhabitant of the county of Orange in the state of California, <br />that she left a last will and testament which was, on the Nth day of July, 1942, duly proven, <br />allowed and admitted to probate in the Superior Court of the state of California in and for the <br />County of Orange, said court having jurisdiction of the probate of wills in said county and state, <br />and being the court having original jurisdiction of the probate of the will of said Eunice I. <br />Wilson, deceased, a duly certified copy of which said last will �.nd testament, together with the <br />certificate of probate thereof, was herein filed for allowance and probate in this county as a <br />foreign will. <br />The Court further finds that on the 23 day of November, 1942, a petition was filed herein for the <br />allowance and probate of said foreign will, that due and legal notice of the date for making proof <br />thereof on the 16 day of December, 1942, was given, that upon said date said instrument was duly <br />proven, allowed, and admitted to probate in this Court as and for the last will and testament of <br />said Eunice I.Wilson, deceased,.and letters testamentary were issued to Della Ward Athey, who filed <br />her bond and qualified as such. <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed by the Court for filing claims against said estate and that all claims filed have been <br />paid in full. <br />The Court further-finds that said Eunice I.Wilson died as the owner in fee simple of the follow- <br />ing described real estate in the state of Nebraska: <br />An undivided one -third interest in the north half of the northwest quarter of Section Twenty - <br />three (23), in Township Nine (9),North of Range Ten (10) West of the 6th P.M., in Hall County, <br />state of Nebraska. <br />The Court further finds that said estate is not subject to an inheritance tax in the state of <br />Nebraska. <br />The Court further finds that all claims have been paid, and the costs of this proceeding have <br />been paid, and that possession of said real estate has been delivered to Della Ward Athey an <br />undivided one -half interest and to Jeanette W.Chiles an undivided one -half interest, as provided <br />by the terms of the said last will and testament of Eunice I.Wilson, deceased. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that said final report be, and <br />the same is hereby, approved and allowed as and for the final report of said Executrix, and said <br />estate is hereby settled and closed and said Executrix discharged from her bond as such, and is <br />hereby released. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all claims, if any such there be, <br />against said estate, and not filed herein, are forever barred and precluded. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that under and by virtue of said last <br />will and testament all of the real estate hereinbefore described was devised to Della Ward Athey <br />and Jeanette W.Ohiles, share and share alike, to -wit: <br />To Della Ward Athey, an undivided one -half interest, <br />To Jeanette W.Chiles, an undivided one -half interest. <br />Paul N.
