286 T HE AUGUSTINE CO. 20112.2.41 The Court finds the said Louise Lucas,deceased,departed this life testate,on the 23rd day of April, 1942,and that at the time of her death she was a resident and inhabitant of Hall County,Nebraska. That on the 29th day of Apr11,1942,Ella H.Gray;Anna E.Beman ;and Frieda M.Meadows,filed in this Court their duly verified Petition praying for the allowance and probation of an instrument pur- porting to be the last Will and Testament of Louise Lucas,deceased; that the Court thereupon fixed the 27th day of May,1942,as a date for making proof of said Will and due notice of the filing of said Petition and the time and place fixed for hearing thereon was given by the Court in the manner provided by law and that on the 27th day of May,1942,said instrument was duly proven, allowed and admitted to probat_ as and for the last Will and Testament of Louise Lucas,deceased, and Letters Testamentary were issued to Thomas W.Lanigan,administrator with will annexed and he duly qualified as such. The Court further finds that due and legal notice has been given to all persens:of the time and place fixed by the Court for the presentation of claims "against the said estate,and that the time so fixed has fully expired and that all persons having claims against said estate are forever barred and excluded from setting up or asserting such claims. The Court further finds that the said Louise Lucas, deceased, left as her heirs and only heirs -at- law the following named persons,to -wit: Ella H.Gray,a daughter;Anna E.Beman,a daughter,and Frieda M.Meadows, a daughter. The Court further finds that the said Louise Lucas, deceased, died seized in fee simple of the following described real estate,to -wit: Lot One (1) in Lucas Addition to the City of Grand Island,Hall County, Nebraska. An undivided One -tenth (1 /10) interest in fee in and to the North Forty -four (44) feet of Lots One and Two (1 & 2) in Block Thirty -nine (39) in the original Town,now City,of Grand Island, Hall County, Nebraska'. and the Court further finds that by the terms and provisions of the last Will and Testament of the said Louise Lucas,deceased,all of the real estate hereinbefore described passed and descended to the following named children of the same Louise Lucas,deceased,in the following proportions: To Ella H.Gray,a daughter,and undivided one -third (1/3) interest To Anna E.Beman,a daughter,an undivided one -third (1/3) interest To Frieda M.M eadows,a daughter,an undivided one -third (113) interest in fee simple. The Court further finds the said administrator,with will annexed,has received from all sources the sum of $3953.75,and after the payment of funeral expenses,eosts of this proceedings and other debts against said estate there remains in his possession for distribution to the legatees of the said Louise Lucas,deceased,the sum of $3007.27. The Court further finds that there is no Inheritance Tax due under and by virtue of the Laws of the State of Nebraska nor is there any Federal Estate Tax due.under and by virtue of the Laws of the United States. IT IS THEREFORE, ORDERED, ADJUDGED, AND DECREED by the Court that the Final Report of the said 'Thomas W.Lanigan as administrator,with will annexed,of the last Will and Testament of Louise Lucas,deceased,be and the same is hereby approved and allowed as and for his Final Report;that the estate is hereby settled and closed,the administrator,with will annexed,dis charged and his bond released. IT IS FURTHER ORDERED,ADJUDGED,AND DECREED,by the Court that all claims filed have been paid,that due and legal notice has been given to all persons of the time and place fixed by the Court for filing of claims against said estate and that the time fixed for filing claims has fully expired, and that all persons having claims against said estate not filed herein,if any such there be,are forever barred and excluded from setting up, and asserting any such claims against said estate. IT IS FURTHER ORDERED,ADJUDGED,AND DECREED by the Court that under and by virtue of the last Will and Testament of said Louise Lucas,deceased,the absolute title to the following described real estate,to -wit: Lot One (1) in Lucas Addition tothe City of Grand Island,Hall County,Nebraska ;and an undivided One -tenth (1 /10) interest in the North Forty -four (44) feet of Lots One and Two (1 & P) in Block Thirty -nine (39) in the original town,now City,bf Grand Island,Hall County,Nebraska, passed and descended to Ella H.Gray, Anna E.Beman,and Frieda M.Meadows,daughters,share and share alike. IT IS FURTHER ORDERED,ADJUDGED AND DECREED by the Court that according to the terms and provis- ions of the last Will and Testament of the said Louise Lucas,deceased,the balance of the money now in the hands of Thomas W.Lanigan,administrator,with will annexed, shall be paid in equal parts to the said Ella H.Gray,Anna E.Beman,and Frieda M.Meadows,each to receive an undivided one - third (1/3) interest thereof and distribution thereof is hereby accordingly made. IT IS FURTHER ORDERED,ADJUDGED,AND DECREED,that there is no Inheritance Tax due in the State of Nebraska upon any inheritance in this estate;that administrator,with will annexd4pupon the filing receipts from the afore named legatees for their proportionate part of the $3007.27 in his hands, shall be discharged and his bond released and said estate settled and closed.
