<br />IN THE MATTER OF
<br />SOMETIMES KNOWN
<br />IN THE COUNTY COURT
<br />THE ESTATE OF ERNST LUETH
<br />AS ERNEST LUETH,DECEASED..
<br />OF HALL COUNTY, NEBRASKA.
<br />DECREE.
<br />Now on this 22nd day of March, 1939, this cause came on for hearing upon the final report filed
<br />herein by Hans Lueth, administrator of the estate of Ernst Lueth, sometimes known as Ernest Lueth,
<br />deceased, and upon his petition for the approval and allowance of said report, settlement of said
<br />estate, determination of the heirs and his discharge herein and the Court having examined the records
<br />and. files and being fully advised in the premises finds as follows:
<br />Thpt Hans Lueth, son of the said Ernst Lueth, sometimes known as Ernest Lueth,filed his petition
<br />in this Court on the 3rd day of February, 1938 alleging among other things that Ernst Lueth,some-
<br />times known as Ernest Lueth departed this life intestate on the 14th day of January, 1938 and at
<br />the time of his death was a resident and inhabitant of said County and State and was the owner of
<br />an estate to be administered in said County; that upon reading and filing said petition an order
<br />was entered fixing the time and place for hearing the evidence in support of said petition, giving
<br />notice thereof to all interested parties by publishing said notice for three successive weeks in
<br />the Grand Island Daily Independent, a legal newspaper published and circulated in said County;
<br />that said hearing was held, as heretofore ordered by the Court, and as by law required, and
<br />letters of administration granted to Hans Lueth upon the filing of his bond in this Court, as
<br />required by law.
<br />That due and legal notice has been given to all persons of the time and place fixed by the
<br />Court for filing claims against said estate by publishing for three successive weeks in the Grand
<br />Island. Daily Independent, as by law provided and that 911 persons having claims against said estate,
<br />not filed within the time fixed by the Court, if any such there be, are forever barred, excluded
<br />and. enjoined from setting up or asserting any such claims against said estate.
<br />That said deceased departed this life leaving surviving him as his hiers at law and only hiers
<br />at law, legatees, devisees and persons entitled to share in his estate the following, to -wit:
<br />Martha Lueth,widow, Grand Island,Nebraska, Hans Lueth,son, Grand Island,Nebraska, Ernest Lueth,
<br />son, Colorado Springs, Colorado, Eldine Dalton, daughter, Kokoma, Ind., and Elizabeth Wegner,
<br />daughter, Grand Island,Nebraska.
<br />That said deceased died the owner of an estate situated in Hall County, Nebraska, consisting
<br />of real property, said real estate being described as follows:
<br />All of Block Number One (1) in Koehler Subdivision, according to the recorded plat thereof, now
<br />on file in the office of the Register of Deeds of Hall County, Nebraska, with the exception of
<br />that portion of said Block One 1) which is conveyed to the Lyman- Richey Sand Company by warranty
<br />deed dated April 18, 1923, and recorded in Book 62 at Page 156 Warranty Deeds in the office of the
<br />County Register of Deeds of Hall County, Nebraska said Koehler Subdivision being a part of the
<br />Southeast Quarter of the Southwest Quarter (SE4SW4) of Section Fifteen (15), Township Eleven (11),
<br />Range Nine (9),West of the 6th P.M. and part of Lot Fourteen (14),County Subdivision of the West
<br />Half of the Southwest Quarter (WiSW�) of said Section Fifteen (15), Township Eleven (11),Range
<br />Nine (9),West of the 6th P.M., Hall County,Nebraska.
<br />The North Fifty (50) feet of the South One Hundred (100) feet and the East One hundred ninety -
<br />eight and six tenths (199.6) feet of the South Fifty 50) feet of Block Three (3), Koehler
<br />Subdivision of Hall County, Nebraska: said Koehler Oubdivision being a part of the Southeast
<br />Quarter of the Southwest Quarter (SE -SW4) of Section Fifteen (15), Township Eleven (11), Range
<br />Nine (9),West of the 6th P.M., and art of Lot Fourteen (14), County Subdivision of the West
<br />Half of the Southwest Quarter (*Swi) of said Section Fifteen (15), Township Eleven (11),Range
<br />Nine (9),West of the 6th P.M., Hall County, Nebraska.
<br />and that said real estate did pass and descend at the death of the deceased to the following
<br />named biers: Martha Lueth, widow, Grand Island,liebraska, an undivided one -third (1/3) interest
<br />and to Hans Lueth,a son, Eldine Daltont a daughter, Ernest Lueth, a son, Elizabeth Wegner, a
<br />daughter, an undivided two- thirds (2/31 interest therein, in equal shares.
<br />That due and legal notice has been given to all persons of the time and place for a hearing on
<br />said final report by publication of said notice for three successive weeks in the Grand Island
<br />Daily Independent, as by law required, and no one appearing to object to said report, and the
<br />Court having examined the same, together with the vouchers attached thereto, finds that said
<br />report is true and correct in all things and sho ld be approved and allowed as and for said
<br />administrator's final report, said estate settled and closed and said administrator discharged.
<br />The Court f,irther finds that the expenses of paying the claims, Court costs, attorney fees
<br />and costs of administration were $881.79 and paid by Martha Lueth, widoS,i. of said deceased and
<br />that the total income from said estate, the sale of the personal property, amounted to $50+.90,
<br />leaving a balance over and above said total -- income of $376.99 paid by the said Martha Lueth,
<br />widow of said deceased, for which said Martha Lueth makes no claim against said estate.
<br />That said estate is not subject to the payment of any inheritance tax under the laws of the
<br />State of Nebraska.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims
<br />against said estate not filed and allowed within the time fixed by the Court, if any such there
<br />be, are forever barred, excluded and enjoined from setting up or asserting any such claims
<br />against said estate.
<br />IT IS FURTHER ORDERED that the final report filed herein by Hans Lueth, administrator, be,
<br />and the same is hereby in all things, approved and allowed as and for said administrator's final
<br />report, said estate settled and closed and said administrator discharged from any further lia-
<br />bliity in said estate.
<br />IT IS FURTHER ORDERED that the real estate owned by
<br />and hereinbefor.e described, did pass and descend Ender
<br />of the State of Nebraska as hereinbefore found by the
<br />accordingly made.
